PRISÃO EM FLAGRANTE: ANÁLISE DOS CRITÉRIOS UTILIZADOS NAS AUDIÊNCIAS DE CUSTÓDIA ORIGINADAS DAS PRISÕES DA 5ª DELEGACIA DE PALMAS/TO.

The present research aims to analyze the custody hearings in the period from January to June 2019, of the arrests in flagrante delicto occurred in the district of the 5th Civil Police Station of Palmas / TO. To this end, the central problem is related to the compliance with legal procedures by the judge to grant or not the provisional release or the application of precautionary measures other than prison. Exploratory research was used with consultation with the doctrines that deal with the theme and documentary analysis. It was concluded with the brief survey, that in only one of the custody hearings analyzed, the legal criteria were disrespected and that 29% of the arrested individuals were released. However, this number is insignificant and requires a detailed investigation given to the prison overpopulation. [ABSTRACT FROM AUTHOR]
