Abstract

The current societies in the so-called "democracies" face imminent social and political risks derived from the incipient participation of cultural diversity, where only sectors of power control the management and operation of social processes, this latent risk maximizes the possibility of the State of Law and therefore, of the functioning of the Nation. Based on this context, this article, whose methodology is supported by documentary-phenomenologicalhermeneutical analysis, seeks to reflect on the functioning of the Rule of Law based on the management of multiculturalism and gender equality with an emphasis on political systems in Latin America that is immersed in an exuberant multicultural wealth. It is imperative and hierarchical that the Rule of Law produces collective social functioning, implementing governance management systems based on legislative support, where multiculturalism and gender equality are recognized, recreating a framework of collective participation, not rethinking the systems of multicultural participation, as the essence of the State, the region will continue to be submerged in constant social and political conflicts.
