论水权交易的功能导向与优化措施.

In response to the shortage of water resources in China, the state has promoted market-based trading of water rights in order to promote the optimal allocation of water resources. This paper used current policy theory and local reform practice on water rights trading as the object of study, and considered that the water right transaction had three functions of promoting the paid use of water resources, the strictest management of water resources, and protecting private rights. It used the empirical analysis method to identify shortcomings in the logic, compatibility and practicality of these functions, which might lead to the deviation of the correct direction of water right transaction and the public doubt about the illegal and unsafe trading method, the public’s right to know and participation, and the unreasonable trading price. The research thinks that the function of water trading should be repositioned and optimization initiatives pursued. At the macro level, it should be repositioned from the perspectives of maintaining national ownership of natural resources, promote the transformation of government functions and achieve sustainable development. At the micro level, the water rights transaction system should be optimized by promoting the electronic and dynamic registration data of water rights, legalize and rationalize water rights trading rules and expand the participation of the public and the interested party, and scientifically assess trading prices.
