Abstract

In an opinion by Justice Don Willett, nowa judge on the U.S. Court of Appeals forthe Fifth Circuit, the court said, "Texas'smore than five million school children deservebetter than serial litigation theydeserve transformational, top-to-bottomreforms." Powell also saidthat when the Court considered wealthdiscrimination in past cases, it was becausean individual was deprived entirely of aright, for example, the inability to obtaina court transcript for a criminal appealwithout funds to pay for it. The TexasSupreme Court found the state educationfunding system unconstitutional in 1991and 1992, constitutional in 1995, unconstitutionalagain in 2005, leading to new legislation,and constitutional again in 2016.The decades of school funding litigationtook place under the state constitution'sguarantee of an "efficient system of publicfree schools" to promote "a general diffusionof knowledge.".
