Abstract
- The article addresses the social management of legal figures in trials for female abduction. The chosen setting corresponds to the Maule province, in the central zone of Chile, during the first half of the 19th century. In this context of "justice of proximity" the research aims are to analyze the relationship between the use of these legal resources and the social interests that motivated them. The investigation examined a sample of 16 court records for female abduction, selecting a representative case study. The work contributes to the discussion on judicialization of intra-family conflicts in contexts of proximity justice. It emphasizes the links between pre-existing interests and practical knowledge of women litigants, to understand the origin and course that this type of trial had. [ABSTRACT FROM AUTHOR]
