The injured party for a wrongful act, for which the public administration is liable, can bring, along with other options, an action against, only and exclusively, the insurance company of the public administration, with the action residing in the civil jurisdictional order. This question has been the subject of a lively controversy, which still persists, and which has been echoed by the Supreme Court very recently. Although the considerable number of papers about the subject, there are many questions that are still awaiting a solution. The singularity of the substantive and procedural triangle that exists between the injured party, the insured Administration and the insurance company, means that there are many questions of a theoretical and practical nature that arise.
