Abstract

By now, the opioid epidemic is no secret, and neither is the flood of litigation resulting from it in courts throughout the United States over the past few years. The highest-level courts to rule on the issue are the Delaware Supreme Court (in favor of insurers) and the Seventh Circuit (in favor of policyholders), amongst an array of various federal trial level and state trial and appellate court rulings. As these lawsuits come to a head, the pursuit of reimbursement through liability insurance available to these defendants has sparked insurance coverage litigation in courts throughout the country.
