Abstract
- The article presents information on a court case related to negligence of a hospital in Great Britain. In Rees v Darlington Memorial Hospital National Health Service (NHS) Trust, a seven-member panel of the House of Lords unanimously reaffirmed the decision in McEarlane v Tayside Health Board that the parents of a healthy child born after a negligently performed sterilization cannot recover the costs of the child's upbringing from the negligent doctor's NHS Trust. However, the house was split by 4 to 3 in holding that, in accordance with McEarlane, a disabled mother of a healthy child, born after a negligently performed sterilization operation, cannot recover the additional costs of raising the child attributable to her disability.
