Abstract

The Supreme Court's ruling on June 14, 2011 declares null and void Royal Decree 1666/2008, which transferred functions and services from the General State Administration to the Autonomous Community of Andalusia regarding the resources and hydraulic uses of the Guadalquivir River. The Supreme Court bases its decision on the unconstitutionality of Article 51 of the Statute of Autonomy of Andalusia. Although there is a collaboration agreement between both administrations, it does not affect the validity or nullity of the Royal Decree. The current situation of the Guadalquivir River Basin Authority is independent of the validity of the challenged provision. [Extracted from the article]
