Abstract

The article presents information on the history of trover. The trespasser, like a disseisor, acquired a tortious property. Trespass, therefore, would not lie for a wrongful distress; for the distrainor did not claim nor acquire any property in the distress. This is shown by the fact that he could not maintain trespass or trover if the distress was taken from him on the way to the pound, or taken out of the pound, but must resort to a writ of rescous in the one case, and a writ of deparco fracto in the other case.
