Abstract

Presents a case study in the law of torts. Case of the owner of a tract of land bounded on two sides by a river, who brought separate actions against six mining companies to recover compensation for alleged damage done to the land by the deposit of tailings from the tin mine into the river and to subsequently to the land during flood-time; Equitable remedy of an injunction as a concurrent remedy for a wrong actionable under the common law; Requirements for invoking of the doctrine of public utility in support of the denial of a remedy by injunction.
