Abstract

It analyzes the improper sharing of information on social networks that constitute a cyber crime committed against women based on the analysis of the influence of social networks, privacy in the virtual environment, the flow of information and digital law. To this end, it considers: the legislative changes resulting from Law 12,737 of 2012, known as the Carolina Dieckmann Law, which typified the crime of invasion of a computer device; Laws 13,718 and 13,772 of 2018 that typify the unauthorized sharing and registration of intimate content; and Law 11,340 of 2006 (Maria da Penha Law). The research adopts the inductive method and is configured as exploratory and descriptive, using historical and comparative methods. It is characterized as a documentary type, based on Brazilian legislation and the Police Reports from the Specialized Police Station for Assistance to Women (DEAM) in the city of Sousa in Paraíba, Brazil, selected from January 2015 to January 2020, which recorded cases of improper information sharing. In addition to these records, interviews with professionals working from the same Specialized Police Station were also used. The research uses Content Analysis to organize and analyze data. It aims to contribute to the identification of facilitating and intervening factors for the protection of the rights of women victims of these crimes, making it possible to establish guidelines for the protection of the victim and the responsibility of the perpetrator of the crime. The partial results indicated the existence of social and cultural factors that prevent women from reaching the police station, such as the social judgment. The need for specific resources for the investigation of digital crimes was perceived. It was found that different social networks were used to commit crimes, such as WhatsApp and Facebook, and that the improper sharing of intimate information was accompanied by insult, defamation and threats to disseminate the content.
