"COM SEU SEXO VOCÊ VAI FABRICAR VERDADE": O CASO LUIZA MELINHO VS. BRASIL DO SISTEMA INTERAMERICANO DE DIREITOS HUMANOS.

Contemporaneity has made visible previously existential aesthetics, with special relevance to the subjects' concrete experiences. The emergence of such a phenomenon disorganizes traditional juridical dichotomies and challenges the government to develop new perceptions on the subject. However, when the government fails or does not want to adapt itself to this new modality, entities, such as the Interamerican System of Human Rights, may become an efficacious alternative for the acknowledgement and protection of these rights. Current research analyzes in what manner the theme of sexual rights is being incorporated to the ISHR agenda. The emblematic case Luiza Melinho vs. Brazil reveals that, in spite of structural limitations, the Interamerican System has done its utmost towards the concretization of the sexual rights of minorities on the American continent.
