Abstract

The article examines the approaches of the U.S. Supreme Court to waivers of state sovereign immunity and criminal constitutional protections. Topics discussed include the requirement of the Court that constitutional waivers must meet the voluntariness and knowingness conditions in the case Johnson v. Zerbst, the double standard established by the Court for criminal defendants and states, and the basis of the waiver jurisprudence of the Court.
