Abstract

The article argues that the U.S. Supreme Court's reliance on a theory of the nature of corporations to uphold the Day Law in Berea College v. Kentucky was pretextual. Topics discussed include Berea College's decision to open itself to black students after the end of the Civil War, the enactment of the Day Law in Kentucky in 1904, and the use of a corporate law principle known as the grant theory to resolve the parties' constitutional law dispute.
