Abstract

The article presents a court case in which the U.S. Court of Appeals for the Ninth Circuit denied a rehearing en banc of a lawsuit allowing domestic corporate liability claim. In the case Doe I v. Nestle, S.A., six former enslaved children on a cocoa plantation in Cote d'Ivoire filed a case due to forced labor without pay, intimidation, and torture. The circuit ruled that a domestic corporation can be sued under the Alien Tort Statute (ATS).
