The CLT is an old legal diploma, that was borned in a historical reality distinct from the current. The recent insertion of norms that regulate the succumbency in the labor process, has caused doctrinal and jurisprudential repercussions, as far as the fundamental right of access to the labor jurisdiction is concerned; given the restriction to judicial gratuity. Therefore, this work intends to analyze the application of the fees of succumbency in the Labor Court, in order to understand what the future of the Labor Process in the face of this mitigation the fundamental right of action and access to justice.
