Abstract

'Temporality': Clarifying the Extent to Which Self-Defence, Defence of Property and Prevention of Crime Operate: R v Williams [2020] EWCA Crim 193 In relation to prevention of crime, any alleged robbery of W's property, or wounding of W, was complete before the victim fled from the flat. I Williams i , therefore, concerns W's renewed application for leave to appeal against his conviction on the basis that the learned trial judge erred in not leaving the defence of self-defence to the jury. In relation to prevention of crime, Flaux LJ confirmed that: 'This defence is only available in relation to preventing crimes in progress not in relation to reacting to crimes already committed' (at [21]).
