Abstract

This paper analyzes the regulation of the single sex education model in our legal system. The LOE and the LOMCE have regulated differently the single sex education. The LOE expressly prohibited discrimination based on sex in schools financed with public funds; whereas the LOMCE allows single sex education in the framework of the Convention against Discrimination in Education adopted by UNESCO in 1960. The legislative change has had a special impact on the jurisprudence of the Supreme Court, which has been modified accordingly to the legislative changes. Finally, this paper studies the recent doctrine of the Constitutional Court about the constitutionality of the single sex education model, as well as the possibility of financing this educational option with public resources.
