Abstract
- The article provides a general background of how the immigration system interacts with federal courts and the statutory framework that strips federal courts of jurisdiction in certain cases in the U.S. Topics include recent jurisprudential trend wherein federal district courts have found jurisdiction over habeas petitions; statute's constitutionality under the Suspension Clause; and implementation of section 1252(g) of Immigration and Nationality Act.
