Abstract

Yemeni scholar al-Shawkānī, who lived between the years 1173-1250 (1760-1834), declared himself as an absolute mujtahid by leaving the Zaydiyya sect when he was at thirties. After that, in both his works and fatwas, he ruled with his own opinions without being attached to any sect. al-Shawkānī has almost three hundred writings and one of the most important work of him called es- as-Sayl al-Jarrār which he wrote in the field of furu al-fiqh (branches). His famous writings, as-Sayl al-Jarrār, is the commentary of al-Ezhār, one of the main texts of Hadawī, the dominant fiqh sect in Yemen. This commentary, which is also a denial of Hadawism, is important for understanding how al-Shawkānī positioned himself against both the Zaydī-Hadawī fiqh and the Ahl al-Sunnah fiqh sects. al-Shawkānī criticizes both the views of the Hadawism and the views of different Sunnī sects in many jurisprudence issues and criticizes them and also, replaces their ijtihads. as-Sayl al-Jarrār, which shed light on al-Shawkānī's understanding of fiqh and included his ijtihads, has encountered many positive and negative criticisms.
