Abstract
- The article discusses the author's claim that the U.S. Supreme Court should repudiate the nation's constitutional avoidance and severability statutory interpretation legal doctrines, and it mentions the case Erie Railroad Co. v. Tompkins which deals with U.S. common law and legal positivism. The U.S. Patient Protection and Affordable Care Act cases National Federation of Independent Business v. Sebelius and King v. Burwell are assessed, along with a textualism legal interpretation doctrine.
