Abstract

19 December 2016 should have been the beginning of the first democratic transfer of power in the troubled history of the Democratic Republic of Congo. Unfortunately, this did not happen. Elections were not organised and the ruling majority maintain an electoral stalemate by involving public institutions and taking advantage of the impotence of counter-powers and the softness of academics. In this context, the jurisprudence of the African Court on Human and Pe oples' Rights provides useful lessons with regard to the referendum aimed at unlocking the limitation of the presidential terms of office, the truncated composition of the electoral commission, the issue of independent candidates the offense of contempt of the authorities and the notion of continued violation of human rights.
