Abstract

A significant discrepancy exists between human rights discourse and its practice, contributing to its ineffectiveness. As such a context is, however, more reflective of an erroneous perspective than a true misrepresentation, the following article aims to readjust such perspectives, contrasting human rights as discourse and human rights as action, suggesting a critical approach and pointing to several possible ways to restore meaning. In terms of methodology, a phenomenological-hermeneutical approach is adopted, allied with the methods of historical and monographic procedure and the research technique of indirect documentation. The results highlight that alternatives for restoring the meaning of human rights depend on the very recognition of state, theoretical and tangible shortcomings, as well as a reinforcement of social movements and bonds in favor of discourse and practice that are truly emancipatory.
