Abstract

The article argue that, in determining how to handle this relatively uncharted terrain, a normative approach should guide the courts on issues related to climate change. Topics discussed include conclusions of the scientific community on climate change; ways to examining whether climate change infringes the right to life, liberty, and security of the person; and evidentiary burden and justifiability.
