Abstract
- The article discusses the U.S. Court of Appeals for the Ninth Circuit's determination in the 2016 case Doe v. Internet Brands Inc. that immunity under Section 230 of the U.S. Communications Decency Act of 1996 (CDA) does not protect the website owner defendant from a failure-to-warn claim. American Internet law and tort immunity are addressed, along with the court's decision not to adopt an alternative understanding of the CDA. California law and rape claims are also assessed.
