Abstract

This article proposes to shed light on the gender stereotypes in relation to the body and the sexuality of women. It shows how the Ecuadorian judicial authorities fall into these stereotypes, as well as the Constitutional Court itself, which is the highest administrative constitutional justice body in charge of protecting constitutional and human rights. For that effect, it is established that the law may be used both as an emancipation and control device by judicial operators; and taking into consideration the influence that the judicial lexicon has on society, the occurrence of gender stereotypes in judicial rhetoric leads to a restriction of rights, the assertion of cultural patterns of discrimination and the bolstering of unfair power relations between both genders.
