Abstract

This article aims to conduct a brief regarding Jeremy Utilitarian Ethics Bentham and John Stuart Mill, who developed distinct rationales for the same philosophy when they award the calculation inherent in use quantitative (Bentham) and qualitative (Mill). Utilitarianism will be addressed as a rational theory that originated in the Enlightenment, broad European cultural movement, the second half of the eighteenth century, which was reflected in philosophical thought, the arts, literature, science, political theory and legal doctrine. As a result of utilitarianism classification as a normative ethical theory and teleological hedonist consequentialist, adentraremos the concepts of ethics and morals, the subdivisions of ethics (ethics rules and meta-ethics) and its consequences. The topic for the quantitative and qualitative empirical research in law, will deal with conceptual aspects of the term "empirical" and quantitative and qualitative research, with emphasis on Jurimetrics branch of knowledge that is primarily concerned with the application of statistics to the law, if analyzing quantitative and qualitative reports prepared by the National Council of Justice.
