Abstract

The monarchy was restored in Spain in 1947 by the Law of Succession of the Head of State (Ley de Sucesión en la Jefatura del Estado). It was one of the compromises that the regime had to accept to get the political support of Catholics and the monarchist sectors, who were reluctant to certain Falangist positions. But the established Monarchy did not follow the traditionalist parameters of the Bourbon Restoration. It was a new Monarchy: a Monarchy whose top leader was a Military Leader (Caudillo) and not a King. Hence the dichotomy between historicism and legality. [ABSTRACT FROM AUTHOR]
