Abstract
- The article examines whether courts should impose strict liability for earthquake damage caused either by hydraulic fracturing or the underground injection of frack fluids. It presents a primer on the strict liability cause of action in tort for abnormally dangerous activities. It summarizes cases that have addressed whether oil and gas operations other than hydraulic fracturing are abnormally dangerous activities.
