Abstract
- The article discusses how attorneys need to be wary of formality when drafting arbitration agreements, and it mentions how judicial bodies such as the Supreme People's Court of China have determined that such agreements are subject to the law of the jurisdiction with the most significant relationship to the underlying contract. Conflict of law rules, Chinese arbitration laws, and the Convention on the Recognition & Enforcement of Foreign Arbitral Awards (New York Convention) are examined.
