This paper is intended to analyse whether the requests for rectification of substantial errors made in resolutions issued by judges and court clerks should result in deadlines for filing an appeal being extended. On a preliminary approach -pursuant to Article 215.5 of the Spanish Code of Civil Procedure ('LEC' in its abbreviated form in Spanish)-the answer to this question would seem to be in the affirmative; however, some case law is in fact contrary to the position established by legislators for reasons that we consider to be rather convincing.
