Delimiting Competences in the EU: CFSP versus AFSJ Legal Bases.

The article presents a distinction between policy areas of the common foreign and security policy (CFSP) and the area of freedom, security and justice (AFSJ) under the provisions of the Treaty of Lisbon. It discusses the judicial decision of the European Court of Justice in the case of European Parliament v. Council of the European Union, in which the Court determined the supranational and intergovernmental competences under the Article 40 of the Treaty on European Union.
