Abstract

The article discusses judicial deference and the expansion of the U.S. Federal Arbitration Act (FAA) in the wake of the U.S. National Labor Relations Board's determination in the 2012 case of D.R. Horton Inc. that it is unlawful under the country's National Labor Relations Act (NLRA) for employers to require employees to arbitrate all employment-related claims on an individual basis. Substantive statutory rights are mentioned, along with class and collective action claims in America.
