This program guide on the right to die provides policy issue information where ethical concerns have a prominent place. Three positions about the right to die are presented: (1) mercy killing and assisted suicide should be legally permitted in certain cases; (2) legal status should be given to living wills and other advance directives that would allow people to die with dignity, but mercy killing and assisted suicide should be legally prohibited; and (3) both mercy killings and allowing patients to die by withholding life-saving treatment should be legally prohibited. The handbook provides parents of children with disabilities guidance on planning for the child's future needs with special attention to resources and laws of Iowa. Section 1 gives a Future Planning Checklist and definitions of common legal terms. Section 2 addresses estates, trusts, and wills and provides common estate planning questions and answers, a family estate planning inventory, and a sample of a simple will. Section 3 covers guardianship and conservatorship including new Iowa legislation. Section 4 examines health care coverage and financing and includes: the major types of health care coverage; recommended pediatric benefits; Medicaid and Medicare; Iowa Comprehensive Health Association; Association for Retarded Citizens insurance programs; the Early and Periodic Screening, Diagnosis and Treatment Program; and a glossary of health insurance terms. Considered in section 5 are residential and community based services such as residential and intermediate care facilities, group foster care, respite care, the Family Support Subsidy Program, and camps. Supplemental income is examined next including Supplemental Security Income and Medicaid, federal payments and redetermination, and change of status. This pamphlet answers questions parents often ask about employment and financial assistance opportunities for their children with disabilities who are exiting the school system. The questions are organized within the topics of transition planning, eligibility for financial aid, receiving benefits, impairment-related work expenses, living arrangements, wills and trusts, and other entitlement. A bibliography lists seven suggested readings, and a list of local, state, and national organizations is included. (JDD)

The program notes were prepared to accompany the television series "New Wrinkles on Retirement." The eight units in the series are: facing inflation, which covers the decreasing value of the dollar, transportation costs, medical expenses, cutting expenses, family budgeting, investments, and places to live; vigor regained, which covers exercise and other health practices, good nutrition, and regular health checkups; a time to learn and a time to play, which covers constructive activity and hobbies, helping others, political involvement, and learning for pleasure; marriage and love, which covers marriage structure and function, relationships with children, adjustment to new roles, and mutual understanding; confronting loss, which covers loss of a spouse, loneliness, widowhood, and remarriage; your legacy, which covers wills and estates, trusts and insurance, and legal problems in retirement; quacks and frauds, which covers avoiding con-men and not being victimized by crime; and maintaining happiness, which covers keeping a healthy outlook on life and maintaining mental and physical health. This course outline provides information to be used by students in conjunction with Nursing 89, a seminar on the legal aspects of nursing to be offered starting in Spring 1982 at Diablo University (California). General information is provided first, including a class calendar, a statement defining the purpose of the course, an outline of long-range objectives, a course description, a glossary of terms, and a bibliography. The course outline then delineates the goals, learning objectives, readings, and sample test questions for each of eight course units: (1) laws in general; (2) the Nurse Practice Act and licensure; (3) contracts; (4) the Patient's Bill of Rights; (5) insurance and risk management; (6) liability, including issues such as negligence, malpractice, torts, and crime; (7) medical records audit and utilization review; and (8) wills. The first of a series, this publication consists of two symposium presentations. The first paper, "Annual Fund: Cornerstone of Development," by Robert L. Stuhr, defines the annual fund concept in the context of institutional development and provides five requisites for a successful annual fund: it must (1) be part of an ongoing development program, (2) have specific stated purposes, (3) enhance the educational program, (4) be assigned to a definite time period, and (5) be supported by a case statement. Next, the steps that lead to a successful annual fund are discussed: research and identification, evaluation, cultivation, involvement, asking for the investment, acknowledgement, and recognition. The second paper, "Estate Planning: A New Resource," by Jerry A. Jarc, sugests methods for securing charitable bequests from regular donors by encouraging them, for their own advantage and for that of the school, to include provisions in their wills for deferred gifts. A step-by-step approach is offered for developing estate planning as a potential long-term resource for school support. (TE)

The introductory one semester course is for the layman interested in obtaining a broad overview of his legal rights and responsibilities. It is not intended to provide him with the training necessary to try his own case; rather, it is intended to give him a legal framework within which he can find guidelines for his actions in various common situations. The material is presented in outline form, but with no rigid structure; each statement, question, or subheading of the outline is explained. The material is divided into 15 sessions, each designed to last from one to two hours, dealing with the following topics: wills defined, wills and estate planning, family relations, accidents, local government, criminal law, courts, litigation, contracts, real estate, negotiable instruments, business organization, and employment laws. There is also a section explaining New York's new laws governing illegal possession or sale of drugs. Appendixes explain the State's no-fault insurance system and provide a brief annotated list of relevant films available from the New York State Bar Association. (Author/PR)

This teacher's guide is designed for use in presenting a six-unit course in managing personal matters that is part of a life skills series intended to help students become more self-sufficient in their personal and professional lives. The course's six instructional units cover these topics: personal records; risk management; health, life, and property insurance; and wills and funerals. Each unit contains some or all of the following: performance objectives, suggested activities for instructors, handouts, information sheets, supplements, transparency masters, instructional supplements providing suggestions for teaching basic skills and problem solving, job sheets, written tests, and assignment sheet and test answers. Academic skills training is combined with life skills training throughout the instructional materials, and a system of icons has been used to help instructors identify activities into which training in the following basic skill areas has been infused: reading, science, creative thinking/problem solving, writing, oral communication, employability, math, interpersonal skills, and social studies. Intended for parents and legal guardians of mentally retarded persons, the manual provides guidelines for estate planning. An overview of definitions, causes, and prevalence factors in retardation is followed by reviews of the major financial assistance governmental programs such as Medicare, and Supplemental Security Income, and of legal requirements regarding private support by family members. Estate planning mechanisms are considered in four chapters on guardianships, estate and gift taxation, wills and administration of estates, and trusts. Legal requirements are noted as are recommended procedures and provisions. The concluding three chapters address tax issues with separate attention devoted to life insurance, annuities, and generation-skipping transfers. Sample will and trust provisions are appended along with a resource guide for further reading. (CL)

The handbook is designed to assist parents of handicapped children with their estate planning and to provide relevant information for other interested persons such as attorneys and advocates. Considered are various ways of providing for handicapped individuals when parents can no longer care for them because of death or long term illness. Major sections address the following areas: estate planning; estate and inheritance taxes; the importance of a will, trusts, and other alternatives to wills; guardianship and conservatorships; and the role of executors, administrators, and attorneys. This third in a series of six packages of instructional materials developed by the Pre-Retirement Rehearsal Project contains a student's pre-retirement booklet, specifically intended for adults with limited reading ability and a teacher's guide, which consider these topics: choosing a lawyer, estate planning, special situations of retirement, and important documents to file away. The student booklet contains informative materials, an activity determining one's estate value by listing assets and bills, a form for summarizing necessary records and their location, a quiz on the material covered, and a list of suggested readings. The teacher's guide suggests how to present instruction, providing three formats from which the teacher may choose. The booklet offers suggestions for parents concerned with providing lifetime protection for a child with mental retardation. Emphasis is placed on the interrelationship between the child's prospective needs of social and/or economic supports and the formal mechanisms which can be brought to bear on them. Four major topics are addressed: (1) guardianship (conservatorship, collective guardianship); (2) wills, trusts, and general estate planning (four basic estate plans, trustee selection, common trusts, importance of wills); (3) insurance benefits (the ARC plans, insurance for children, insurance planning); and (4) government benefits (the role of state government, federal programs of income support and health care coverage, interrelationship of government benefits and private income, Social Security benefits for adults, Medicare, Medicaid, Supplemental Security Income (SSI), and state utilizations of combinations of SSI and Medicaid options as they affect care of the disabled in the community). This module on managing personal matters is one of a series of modules designed to help teach students to become more self-sufficient in their personal and professional lives. This module provides teacher and student materials that are planned to help students maintain personal records, obtain insurance, and deal with funerals and wills. Six units cover the following topics: (1) personal records; (2) risk management; (3) health insurance; (4) life insurance; (5) property insurance; and (6) wills and funerals. Each instructional unit follows a standard format that includes some or all of these eight basic components: performance objectives, suggested activities for the instructor, information sheets, assignment sheets, job sheets, transparency masters, tests, and answers to tests and assignment sheets. All of the unit components focus on measurable and observable learning outcomes, and are designed for use for more than one lesson or class period. (KC)

Covered in the individual sections are the following topics: an introduction to estate planning, the Missouri Probate Code and Missouri laws of descent, property ownership, estate taxes, wills, gifts and trusts in estate planning, and selection of a lawyer. Each lesson contains an outline of the major concepts covered in the lesson, suggested activities, a list of instructional materials included in the lesson, a list of pertinent references, test questions, an answer sheet, an information outline, and transparency masters. Intended for parents of disabled children, the handbook addresses issues of estate planning and other legal matters concerning the child's future. An initial section on guardianship covers such aspects as how to obtain guardianship, duties, and alternatives to guardianships. Wills and trusts are examined in separate chapters which include information on making a will; probate, taxes, and administration; trust provisions; and selection of trustees. Life and health insurance considerations are followed by a review of such government benefits as social security, Medicare, Supplemental Security Income, and Medicaid. A chapter on military benefits charts the benefits and eligibility requirements of four programs, including the War Orphans' Educational Assistance Plan. Parents are urged to develop their own information system with data on the child's care, the family's personal affairs, the estate, and funeral or burial arrangements. Part of a series of classroom aids designed for real estate instructors, this instructional packet was developed to help real estate students understand the different types of wills recognized in Texas, their preparation, provisions, and execution. First, information about wills is presented, including definitions of relevant terms and a description of the types of wills recognized in Texas: (1) formally executed wills (i.e., wills in writing, signed by the testator, and witnessed and signed by two or more credible witnesses); (2) holographic wills (i.e., wills written and signed in the testator's handwriting); (3) noncupative wills (i.e., oral wills that can be used to dispose of personal property); and (4) shared or common wills (i.e., wills which can operate for two or more persons). The next sections consider various will provisions, including the preamble, revocation of prior wills and codicils, payment of debts and expenses, bequest of assets, appointment of an executor, independent administration, simulataneous death provisions, providing for the case of minors and incompetents, and self-proving affidavit.
