3. Social security for unpaid domestic workers: Death benefits, relevant protection in the pandemic

This article analyzes the current protection of unpaid domestic workers through social security. The Organic Law for Labor Justice and Acknowledgement of Unpaid Domestic Work has included unpaid domestic workers in social security, thus assuring them financial protection against old-age, disability, and death. Analyzing the target population of such a law, as well as its intent and conditions for accessing benefits, specifically regarding death, shows that this protection is adequate for safeguarding those who perform unpaid domestic work, and mainly their right-holders because the pandemic caused by SARS-coV2 virus has impacted families not only in terms of health but also in terms of their economic situation.

Dismissal of the petition filed against the National Institute of Social Security and the General Treasury of Social Security in which it was intended gain access to the widow’s pension for life, previously denied in judgment of the third social court of Toledo. The appellant was granted a temporary widowhood pension according the article 222 of the Social Security act, due to the inability to prove the required living together period and not having children in common. The TSJCLM confirms the refusal of a widow’s pension for life by not proving the coexistence period prior the celebration of the marriage through the registration certificates requires by the law or any other means of proof admitted by law., Desestimación al recurso de suplicación interpuesto en contra del Instituto Nacional de la Seguridad Social y Tesorería General de la Seguridad Social, a través del cual se pretendía el carácter vitalicio de pensión de viudedad, previamente desestimado en sentencia dictada por el Juzgado de lo Social tercero de Toledo. A la recurrente, le fue reconocida por resolución del INSS pensión de viudedad temporal de conformidad a lo establecido en el artículo 222 LGSS al no acreditar el período de convivencia y no tener hijos en común. El tribunal confirma en suplicación la negativa a la recurrente pues no acredita la convivencia previa a la celebración del matrimonio a través del certificado de empadronamiento o cualquier otro medio de prueba admitido en el derecho.

La Ley Orgánica para la Justicia Laboral y el Reconocimiento del Trabajo en el Hogar incorporó a las personas trabajadoras no remuneradas del hogar a la seguridad social garantizándoles una protección económica frente a las contingencias de vejez, invalidez y muerte. El análisis de la población objetivo de dicha ley, de su espíritu así como de las condiciones de acceso a las prestaciones establecidas para tales contingencias, específicamente para la contingencia de muerte, muestran que dicha protección resulta adecuada para proteger en la actual coyuntura a las personas que realizan trabajo no remunerado en el hogar y principalmente a sus derechohabientes, considerando que la pandemia causada por el coronavirus denominado SARS-coV2 ha impactado a las familias no sólo en su estado de salud sino también en su situación económica.

11. Pensión de viudedad, matrimonio gitano y parejas de hecho

It is a constant judicial doctrine that unions by the gypsy rite do not produce civil effects and, therefore, do not generate the right to a widow's pension upon the death of one of its members. With the exception of the 2009 ECHR ruling, Muñoz Díaz v. Spain (known as "La Nena"), due to the particularities that concurred, based on the good faith of the contracting parties and the reasonable expectation created by the authorities of the Spanish State, the Supreme Court and the TC continue to deny access to the widow's pension , even in cases in which the deceased's death occurred after Law 40/2007, which for the first time made it possible for the surviving member of said couples to access the widow's pension. The particular vote published together with the judgment of the Supreme Court of January 25, 2.018, Appeal 2401/2016, reasons about the unnecessary of said requirement to unions celebrated in accordance with the uses and gypsy customs due to the particularities of said culture, strong family roots and unquestioned marital unity., Es doctrina judicial constante la de que las uniones por el rito gitano no producen efectos civiles y, por ende, no generan derecho a la pensión de viudedad al fallecimiento de uno de sus integrantes. Con la excepción de la sentencia del TEDH de 2009, asunto Muñoz Díaz c. España (conocido como “La Nena”), por las particularidades que concurrían, basadas en la buena fe de los contrayentes y la expectativa razonable creada por las autoridades del Estado español, el TS y el TC siguen negando el acceso a la pensión de viudedad, incluso en supuestos en los que el fallecimiento del causante se produjo después de la Ley 40/2007, que por primera vez posibilitaba el acceso a la pensión de viudedad al integrante supérstite de dichas parejas. El voto particular publicado junto a la sentencia del TS de 25 de enero de 2.018, Recurso 2401/2016, razona sobre lo innecesario de dicho requisito a las uniones celebradas conforme a los usos y costumbres gitanos por las particularidades de dicha cultura, fuerte arraigo familiar y unidad matrimonial no cuestionada.

Cuando se comparte la pensión de viudedad entre una cónyuge superviviente y otra cónyuge histórica -lo que ocurre aquí porque el causante se había divorciado previamente y concurren los derechos de dos beneficiarias a la misma- la merma en la pensión que así se obtiene debiera mantenerse mientras la prestación se lucra. No obstante, el Tribunal Supremo resuelve que la pensión de viudedad que obtiene la última esposa sí acrece cuando fallece quien fuera la histórica. When the widowhood pension is shared between the surviving spouse and the historical spouse - which happens here because the deceased had previously divorced and the rights of two beneficiaries to it concur - the reduction in the pension thus obtained should be maintained while the benefit profit. However, the Supreme Court decides that the widow's pension obtained by the surviving spouse does increase when the former spouse dies.

En numerosas ocasiones la evolución social precede a la legislativa, en tanto se van presentando nuevas realidades o alternativas que progresivamente van integrándose en la sociedad y, en consecuencia, se han de insertar en el ordenamiento jurídico. Esto está pasando con la pensión de viudedad. Por ello, resulta de gran interés y utilidad analizar cómo se encuentran las nuevas situaciones que sobrepasan la realidad imperante actualmente, como es el caso de los matrimonios polígamos. También se debe estudiar cómo se ha insertado en el ordenamiento jurídico, en lo que respecta a la pensión de viudedad, realidades ya integradas en la sociedad como son el divorcio o las parejas de hecho. Y ver cómo la violencia de género influye en esta materia y los efectos de la unión por el rito gitano. Todo ello desde la perspectiva de los últimos pronunciamientos de los tribunales de justicia. On many occasions, social evolution precedes legislative evolution, as new realities or alternatives are presented that progressively integrate into society and, consequently, have to be inserted into the legal system. This is happening with the widowhood pension. For this reason, it is of great interest and utility to analyze how new situations are found that exceed the current prevailing reality, as is the case of polygamous marriages. It is also necessary to study how it has been inserted in the legal system, with regard to the widow’s pension, realities already integrated in society such as divorce or common-law couples. And see how gender violence influences this matter and the effects of the union through the gypsy rite. All this from the perspective of the latest pronouncements of the courts of justice.

This contribution studies revenue sharing in the public pension system in Spain from a gender perspective, revealing that differences are evident in the percentage of men and women entitled to different types of pensions and in the average fiscal amount per pension for men and women. Using 2010 data, the study analyzes how labor market conditions are reflected in pension type and amount for women pensioners, yielding two important conclusions: the income of women pensioners decreases, relative to men, with age; and the degree of inequality of pensions among women is lower than that among men. These gender differences owe to the contributory character of the system, which reproduces the labor market inequalities of both genders – inequalities that ultimately derive from the social division of roles in which women remain responsible for unpaid care work. This conclusion is consistent with similar studies on other European countries and world regions. [ABSTRACT FROM AUTHOR]

The first attempt at institutionally settling the issue of pensions in the Habsburg Empire, and consequently in Hungary, goes back to the reign of Maria Theresa. The idea of establishing a pension, and taking care of aged officials by giving them a regular fee originates from France. It was Henry IV who first bestowed such dues, and he even took care of the widows of officials. Pensions were established in the Habsburg Empire because the officials sent innumerable petitions asking for a pension and the treasury was very much burdened by these random pensions. Therefore, the establishment of regulated pension was as much in the interest of the prince. Maria Theresa made a statute in 1771 and with it she established the right to a pension. In Europe, besides France and Austria only Prussia had a pension regulation, in which another enlightened prince, Frederick the Great attempted in 1775 to secure the provision of the widows. Nevertheless, a general regulation was introduced only in 1825 in Prussia. After the death of Joseph II the number of superannuation acts increased. These did not change the regulation radically, but rather refined the previous regulation and added corrections that the practice of the regulations made necessary, and took care of the problematic issues that had arisen in the meantime. The regal decree of December 9, 1866 was a pension regulation and not a law as it had not been made in parliamentary conditions. And yet both the Austrian and the Hungarian party upheld it after the Austro-Hungarian Compromise of 1867, and this regulation served as the basis of pensionings for decades onwards. The statute of 1885: XI. "on the superannuation of government officials, official assistants and servants" was sanctioned by Francis Joseph I on May 13, 1885. In comparison with the previous regulations this superannuation act affected the largest extent of people, and it also established pension reciprocity which broadened the borders of the superannuation act, by increasing the number of people affected by it. One of the primary conditions of being a rightful claimant was having a permanent employment. The provision was based on two factors: the accountable time spent in service and the amount of the last accountable allowance. Even those years that one spent in the Austrian state service were taken into account as a pension reciprocity existed between the Hungarian and the Austrian halves of the empire. The regular provisions were not place specific within the boundaries of the Austro-Hungarian Monarchy, meaning that if a Hungarian citizen lived on the Austrian half of the empire, they still received their Hungarian pension. Those who lived outside the boundaries of the Monarchy required a special permit from the responsible minister as well as those who wanted to utilise the educational contribution of children who were living abroad. The widows and the orphans of government officials, official assistants and servants were not only qualified to receive a widow's pension and an educational contribution, but also to receive a funeral contribution. The regulation stated that a female employee can lay claim to her rightful pension or indemnification even if her husband is still alive, or if she gets special provisions after her husband. The female employee is entitled to keep her pension even if she receives provisions after her husband only later, or if she gets remarried. The pensions of municipal and communal employees were secured by the municipal pension funds. Local pension regulations depart from those of the state as every municipality and settlement regulated the issues of pension in their own municipal ordinances of pension. Article LXV of the year 1912 replaced the 1885 statute concerning civil servants, and it turned the thirty years that had elapsed to its advantage. Pokojninsko in invalidsko zavarovanje temeljita na načelu medgeneracijske solidarnosti, vzajemnosti in redistribucije ter predstavljata temelj socialne varnosti v primerih, ko posameznik zaradi starosti ne more ali ne želi več aktivno sodelovati na trgu dela. Slovenski pravni red poleg izvirnih pravic, ki iz omenjenega zavarovanja izhajajo, loči tudi dve izvedeni pravici za primer zavarovančeve smrti, in sicer vdovsko in družinsko pokojnino. Obe sta urejeni z Zakonom o pokojninskem in invalidskem zavarovanju (ZPIZ-2) in ju ob izpolnjevanju zakonsko določenih pogojev lahko pridobijo ožji družinski člani zavarovanca oziroma uživalca pokojnine po njegovi smrti. Zakonodajalec je zavezan stremeti k vzpostavljanju in ohranjanju enakosti pred zakonom, vendar pa se v določenih življenjskih situacijah izraža neenaka obravnava posameznikov, na primer z vidika spola, spolne usmerjenosti, zakonskega stanu, časa spočetja otroka, ki se ob smrti očeta še ne rodi, kroga družinskih članov in davčne obravnave. Zakonodajalčeva naloga je tovrstne neenakosti odpraviti in sanirati, hkrati pa tudi vzpostaviti sistem, ki bo preživel demografske spremembe in spremembe v načinu življenja moderne družbe. Pension and disability insurance are based on the principle of intergenerational solidarity, reciprocity and redistribution, and lays the foundations to social security in cases when an individual is unable or unwilling to actively participate in the labor market due to the age. In addition to the original rights arising from the insurance, the Slovenian legal order also separates two derived rights in case of the insured's death, namely widow's and family pension. Both rights are regulated by the Law on Pension and Disability Insurance (IPDI-2) and can be acquired by immediate family after the death of the insured or the beneficiary of the pension in case of fulfilling all statutory conditions. The legislator is obliged to strive for the establishment and maintenance of equality before the law, but in certain life situations, unequal treatment of individuals is expressed, for example, in terms of gender, sexual orientation, marital status, conception of a child, who is not born at the time of the father's death, family members and tax treatment. The legislator's task is to eliminate and remediate such inequalities and at the same time to establish a system that will stand demographic changes and life changes of a modern society.

RESUMEN: El presente trabajo tiene como principal objeto visibilizar la situación de discriminación que sufren las mujeres en el matrimonio islámico. Para ello, se analizará de forma amplia el matrimonio islámico, poniendo mayor atención a los problemas que suscitan en España, ciertas figuras jurídicas del Derecho de Familia musulmán, ajenas a nuestra cultura jurídica, como son la poligamia y el repudio. En lo que respecta a la poligamia, habrá de diferenciarse dos supuestos: aquel matrimonio que pretende ser celebrado en territorio español, y aquel otro celebrado en el extranjero, y que se quiere hacer valer en España, el cuál presenta una mayor problemática. En este trabajo nos centraremos en el posible reconocimiento de la pensión de viudedad de las diversas viudas. Igualmente, se profundizará en las dificultades que la institución del repudio plantea en DIPr. español, principalmente en Derecho aplicable y en reconocimiento de resoluciones extranjeras de repudio o exequátur. To this end, Islamic marriage will be analysed, paying more attention to the problems posed by certain legal figures of Muslim family law in Spain outside our legal culture, such as polygamy or repudiation. With regard to polygamy, two cases will have to be differentiated: that marriage that is intented to be celebrated in Spanish territory, and that other marriage celebrated abroad, and which is intended to be enforced in Spain, which presents a greater problem.In this work we will focus on the possible recognition of the widow's pension of the various widows. Las prestaciones por muerte y supervivencia se regularon en unas circunstancias sociales diferentes a las actuales. La normativa aplicable está siendo modificada continuamente con el fin de adaptar estos beneficios a las necesidades de cada momento. En este trabajo, en primer lugar, se trata de poner en evidencia la evolución más significativa en la flexibilización de las condiciones exigidas tanto a los beneficiarios como a los causantes. Pero, entendiendo positivo la extensión de la protección, en todo el análisis lo que realmente se pretende sugerir es la necesidad de sustituir los beneficios por prestaciones propias que reconozcan las carencias concretas como ciudadanos, al margen de sus relaciones personales.

Básicamente, en el trabajo aquí expuesto se presenta un breve comentario y análisis de la Sentencia del Tribunal Constitucional (Sala Segunda) 115/2014, de 8 de julio de 2014, concerniente al recurso de amparo interpuesto por el demandante sobre una supuesta vulneración de los derechos a la igualdad y a no padecer discriminación por razón de orientación sexual, tras habérsele denegado la pensión de viudedad como supérstite de una unión homosexual. Basically, the work here exposed is related to a brief commentary and analysis about the Judgment of the Constitutional Court (Second Chamber) 115/2014, of July 8, 2014 related to the “recurso de amparo” number 1326-2007, filed by the complainant on alleged violations of the rights to equality and freedom from discrimination on grounds of sexual orientation after being denied at the plaintiff the widow's pension as survivor from a homosexual union.

La institución matrimonial ha sufrido numerosas e importantes modificaciones operadas por la Ley 15/2015, de 2 de julio, de la Jurisdicción Voluntaria. Este trabajo se centrará en analizar aquellas que afectan a los matrimonios en forma religiosa. En concreto, la ampliación de las formas de celebración con eficacia civil en España y los cambios en la regulación de las formas matrimoniales religiosas ya reconocidas. Esto se hará mediante un estudio comparativo entre la situación hasta ahora vigente y la que resultará de la entrada en vigor de la norma citada., The institution of marriage has been recently amended by the Voluntary Jurisdiction Act 15/2015. This paper will focus on analysing the changes related to the religious form of the civil marriage. In particular, the expansion of religious forms of marriage with civil efficacy in Spain and the changes in the regulation of marriages already recognized. This will be done through a comparative study of the current situation and that will result when come into force the mentioned regulation.

Z namenom urediti in zaščititi istospolno partnersko skupnost je zakonodajalec leta 2005 sprejel Zakon o registraciji istospolne partnerske skupnosti /ZRIPS/. Menil je, da bi bilo najustrezneje, da jo uredi v institutu registracije partnerske skupnosti ter ločeno od družinskopravne zakonodaje, ki ureja položaj zakoncev in zunajzakonskih partnerjev. Nabor pravic in obveznosti, ki jih je zakonodajalec zagotovil, bi utegnil pripeljati do sklepa, da istospolna partnerska skupnost služi v največji meri zadovoljevanju čustvenih in ekonomskih potreb partnerjev, ne pa tudi družinskih in socialnih potreb. Zakonodajalec pri sprejemanju ZRIPS ni upošteval družbene realnosti, to je, da v Sloveniji obstajajo istospolne družine in da zato istospolna partnerja v partnerski skupnosti lahko uresničujeta tudi družinske potrebe. Pravno praznino, ki je zaradi tega zazevala na družinskopravnem področju, je bilo mogoče zapolniti v okviru veljavne zakonske ureditve. Da tudi istospolni partnerji gojijo željo po oblikovanju družine, ki vključuje otroke, je jasno. Ker je možnost starševstva istospolnih parov na eni strani omejena v reproduktivnem smislu, na drugi strani pa z zakonsko ureditvijo, ki velja v Sloveniji, se istospolni pari večkrat poslužujejo rešitev, ki so negotove in nevarne, zlasti z vidika koristi otrok. Področja socialnih pravic, razen nekaj izjem, ZRIPS ni posebej uredil. Tako je bila ureditev, ki zadeva socialne pravice, v večji meri prepuščena vsakokratnemu zakonskemu usklajevanju. Do danes se je položaj istospolnih partnerjev spremenil. Drži, da je obseg pravic, ki so istospolnim partnerjem zagotovljene, večji kot pred osmimi leti ob sprejetju ZRIPS. K temu so v veliki meri prispevali istospolno usmerjeni aktivisti, nevladne organizacije, pravni strokovnjaki, kot tudi slovenska sodišča. Kljub temu pa o polnopravnem dostopu istospolnih partnerjev glede ekonomskih, družinskih in socialnih pravic ne moremo govoriti. Zato postajajo vse glasnejše zahteve, da je zakonska ureditev potrebna prenove na način, ki bo k ureditvi pravnega položaja istospolnih partnerjev pristopil celoviteje in bolj sistematično. Pri tem ni zanemarljivo niti vse večje število sodb Evropskega sodišča za človekove pravice in Sodišča Evropske unije, iz katerih izhaja, da tudi istospolni pari uživajo pravico do zasebnega in družinskega življenja, ki so jo države dolžne spoštovati, ter da razlikovanje v obravnavanju na podlagi spolne usmerjenosti ni dopustno. Slednje je tudi Slovenija kot članica Sveta Evrope in Evropske unije dolžna vzeti v obzir. Jasno je, da je enakopravno obravnavanje oseb temeljni gradnik vsake demokratične družbe, zato se ne postavlja vprašanje, ali so istospolni pari upravičeni do polnopravnega obsega pravic, ampak le vprašanje časa, kdaj bodo politične elite uspele doseči konsenz o tem vprašanju. In 2005 the legislator passed the Registration of the Same-Sex Civil Partnership Act /ZRIPS/ in order to regulate and protect the same-sex partnership. The idea was that it would be the most appropriate if this is regulated in the institution of registration of partnership and separately from family code that regulates the status of spouses and cohabiting partners. The set of rights and obligations provided by the legislator might point to a conclusion that the same-sex partnership serves mostly for meeting the emotional and economic needs of partners but not the needs of a family or a society. The legislator has not taken into account the society’s reality when passing the law. The reality is that same-sex familys do exist in Slovenia and therefore same-sex partners also can exercise family needs in a partnership. The consequence of this is the legal void which could be fixed in the context of a valid legal system. It is without a doubt that same-sex partners also foster the desire to create a family that includes children. Because the option of parenthood is limited on one hand, in a reproductive sense, and because of the legal system valid in Slovenia on the other hand, same-sex couples are many times forced to pick out solutions that are risky and dangerous, especially from the view of the benefit of children on the other hand. The ZRIPS Act (Registration of the Same-Sex Civil Partnership Act) has not regulated the field of social rights separately, except in some individual cases. Therefore the regulation that concerns the social rights had to be harmonized with the law more or less every time a case like that occurred. Up to the present day the status of same-sex partners has changed. It is true, however, that the scale of provided rights for the same-sex partners is greater than eight years ago when the act was passed. The latter is the result of actions by gay and lesbian activists, non-governmental organisations, legal professionals as well as Slovenian courts. Despite the above the full legal access of same-sex partners concerning the access to the economic, family and social rights still does not exist. Therefore the demands to amend the legal system are getting greater and greater. The amendments should be done in a way to regulate the legal status of same-sex partners in a more comprehensive and in a more systematic way. We cannot, however, neglect the growing number of judgements by European Court of Human Rights based on which the same-sex couples also enjoy the right to private as well as family life that they are obliged to respect and the fact that differences in treatment based on person’s sexual orientation are not allowed. The latter should also be given consideration by Slovenia as the member of Council of Europe and European Union. It is also clear that equal treatment of persons is a foundation of every democratic society therefore it is not a matter of whether same-sex couples are eligible to receive access to full scale of rights but a matter of time when the political elites will manage to reach a consensus on this issue.

La Ley 40/2007, de 4 de diciembre, de medidas en materia de Seguridad Social reconoce el derecho a la pensión de viudedad para las parejas estables, o de hecho, y como tal constituye una decisión importante en términos sociales de derecho de familia. La distinción entre matrimonios y parejas estables a efectos de pensiones de viudedad ha sido una cuestión polémica en las últimas dos décadas. Esta reforma del Régimen de Seguridad Social supone un nuevo análisis de los requisitos personales, económicos y de acreditación de las parejas estables. La diversidad de legislación entre las diferentes Comunidades Autónomas que gozan de un Derecho Civil propio conduce a situación de carácter discriminatorio, según la Sentencia del Tribunal Constitucional 40/2014, de 11 de marzo de 2014 Law 40/2007 of 4 december, on measures relating to Social Security recognizes the right to a survivor's pension to life partners, or in fact, and as such is an important decision in social terms of family law. The distinction between stable marriages and couples for the purposes of widow's pensions has been a contentious issue in the past two decades.
