Paradiplomacy literature focuses on federations. This paper is dedicated to selected unitary states. The aim was to identify the achievement of those states in terms of cooperation between central and local governments with respect to foreign policy. The principal research method was a semi-structured direct interview. In the light of the examined examples, the French model of paradiplomacy for a unitary state appears to be the best solution. It respects both the authority of the sub-state governments to engage in foreign cooperation and the constitutional prerogative of the government as the body responsible for pursuing foreign policy of the state. - Abstract
This study analyses the implementation of legal pluralism theory in a unitary state, such as the Republic of Indonesia, for historical and political purposes. The Special District Province of Yogyakarta, formally known as Ngayogyakarta Hadiningrat Sultanate, is one of the provinces whose territory and government have existed before Indonesia's independence. When Sultan Hamengku Buwono led this province as the king, it significantly enjoyed many privileges within the Unitary State of the Republic of Indonesia, which apply to date. However, it is still possible to find discriminatory policies, especially in the agrarian sector, aimed explicitly at the Indonesian Chinese community due to the implementation of the Governor Instruction of 1975. As a result of this policy, the Indonesian Chinese are not entitled to land ownership rights in this region. This discriminatory policy serves as a window to explain how the social, cultural, political, and historical structures of Yogyakarta impact the implementation of the legal pluralism concept within the Republic of Indonesia. Village autonomy is one of the urgencies for village government. This is in line with the reform mandate which emphasizes the spirit of regional autonomy. Village autonomy is expected to increase village independence. The legal issue in this research is the legal vacuum related to the regulation of village autonomy. This study aims to construct the idea of regional autonomy within the framework of the Unitary State of the Republic of Indonesia. This research is a juridical-normative research with three legal materials, namely primary legal materials including: the 1945 Constitution of the Republic of Indonesia, the Village Law, and the Regional Government Law. Secondary legal materials include books, websites, and journal articles related to legal issues. Non-legal materials include language dictionaries and legal dictionaries. The results of this study confirm that the idea of village autonomy in the Unitary State of the Republic of Indonesia must be positioned that village autonomy is "original autonomy" that must be given by the state to villages. Legal construction related to the idea of village autonomy is carried out by amending the 1945 Constitution of the Republic of Indonesia by including the term village autonomy in the constitution, including village autonomy in the revision of the Village Law, as well as harmonizing and constructing village autonomy laws mutatis mutandis with the concept regional autonomy. more...

In many parts of the world, globalisation creates a phenomenon which integrates states into federal-like structures, even if they are not necessarily of the known, classical type, like the European Union, for instance. The international doctrine and practise also credit federal states with a higher potential for economic growth compared to unitary states. Starting from the undeniable fact that the economy and politics are closely linked together, some authors are trying to stretch the benefits of the federal system beyond what it can actually offer and argue that federalism may be the solution to other categories of political issues that the unitary states face. Minority population is one such category. This study aims at showing that the state structure is irrelevant to solving the problems arising from the status of belonging to a national minority. The unitary state is organized on the basis of the principle of unity and centralization. This form is the most widespread in the European Union (France, Portugal, Poland, Hungary, Czech Republic, Lithuania, Romania, etc.). The rule of law has the following main characteristics: - it consists of a single set of bodies through which political power is exercised at central and local level; - the governing activity is broadcast from the center in a hierarchical way; - there is only one legal order, based on a single constitution; - the population has only one citizenship. Although the state is unitary, its territory can be divided into administrativeterritorial units or into local communities. The subdivisions of the unitary state have an eminently administrative character and do not constitute states within the state. In the modern unitary state, based on the principles of the rule of law, centralization plays a role similar to that of absolute monarchies, but obviously with different means and objectives. We consider, in this sense, the fact that the centralized state apparatus (the single or main center of decision) represents, in reality, the whole nation and serves its general interests. In modern states, the centralization of power and its distribution by a single center of decision is no longer for the benefit of a single person, but of the whole people. The professed constitutional unitary state claim has been highly debated. Some argue that Indonesia shall be a unitary state in name, pursuant to Article 1 Para. III of the Indonesian Constitution, but Constitutional reforms after 1998 when the autocratic President Gen. Soeharto stepped down granted broad authority to local government, leading Indonesia to a quasi-federation situation in practice. On the other hand, some stick to the aforementioned Article, insisting that decentralization embedded in the Constitution Article 18 Para. II is by no means making Indonesia federal. This article takes the Act No. 13 of 2012 on Special Region of Yogyakarta (the Daerah Istimewa Yogyakarta) granting autonomy to Daerah Istimewa Yogyakarta as a case study to argue for the latter, asserting that the case merely exemplifies the decentralization characteristic embedded in the Constitution. This paper first examines the political features of federalism through a historical legal perspective, showing that the current state system in Indonesia is decentralized but not federalized. This paper concludes that the recognition of Daerah Istimewa Yogyakarta as an autonomous region is simply a practice of constitutional decentralization. 16. The Decentralization of Poland 1989-2018: From Partisan Disagreement to a Vehicle for Successful Absorption of EU Cohesion Funding

This article draws the main lines of development of the territoriality of the Polish state, taking into account the divergent dynamics of its regional evolution. Building on a historical account, it describes how the decentralization process unfolded, leading to the reform in 1998/1999, which administratively decentralized the state without, however, changing its unitary nature. By analysing the complexity and diversity of the EU’s cohesion policy, the paper also addresses questions that are central to theoretical arguments about EU influence on the divergence of regions. It concludes that even if the EU cohesion policy can be seen as a success in Poland, the amount of funding was not sufficient to reduce the differences between the Polish voivodships, which have been growing in recent decades. Paradoxically, the successful use of EU funding did not prevent the massive electoral wins of an EU-sceptic party in the poorer eastern regions, which were supported by a special EU fund. more...

The article through comparative analysis of budget figures of federal and unitary states identifies key features of forming incomes on the municipal level. Proceeding from differences in administrative and territorial arrangement of states it grounds the difference in the level of finance provision of municipal bodies. By comparing volumes of accumulated by municipal council incomes and available liabilities a conclusion is drawn about the real finance provision of municipal bodies in federal and unitary states. Findings of the analysis show higher provision of local budgets in unitary states by income sources and their sufficiency to resolve problems of local character in contrast to federal states, which declare finance autonomy of municipal administration. It allows us to come to the conclusion about the decisive role of internal and not external factors in budget functioning on the local level. more...

The purpose of this article is to give an account of how contemporary Chilean doctrine defines the unitary state as a constitutional concept. Along with presenting the hegemonic reading, it is shown that both the Unitary State defenders and those who challenge it share the same (and only) meaning of the principle. The article presents the idea that, since there is a strong consensus around its content, the legal community treats it as a wholly defined and exhausted object, losing sight of its open and interpretive character. Today, in the context of determining the structure of a country as a unitary state form, many countries' constitutions contain basic principles such as "the unity of the state", "the indivisibility of the country" or, as in the 1982 Turkish Constitution, "the indivisible integrity of the state with its country and nation". However, although constitutions affirm the principle of the unity and indivisibility of the state, it is possible to talk about the difficulties for defition of the forms of states as "unitary". The main problem is that there are some contradictory situations in terms of the principles accepted by the constitutions of the countries and the administrative organization. At this point, attention should be paid to the existence of an inconsistency between constitutions and the organizational model. Also, it can be observed that there is a contradiction between the provisions of the constitutions of some states. As a result of both the confusion at the constitutional level and the examination of various state models that are examples of unitary state, it will be understood that defining this model, which is briefly called the "unitary state" and given very simple definitions of itself in the doctrine, is actually quite difficult. In this comparative study of constitutional law, different results will also emerge and a tendency to deviate from the unitary state structure to other models will be encountered. The author thanks the panelists for their comments. He appreciated their raising questions in need of further study and he tried to answer them: the concept of core power, security fringe, limits of Russian expansion, and he himself raised additional questions. One of the most intractable questions raised by Barbara Skinner concerned the role of the Jesuits in the conflict between the Orthodox and Catholic churches; another concerned the meaning of the phrase "the partitions of Poland." The author answered them hopefully to her satisfaction. Semyonov placed the rise of the Russian Empire in the broad context of Eurasian geopolitics and the author responded by submitting a number of issues in need of further study. He only regrets that no one raised the broad issue of the roleof the law and its codification as a factor of integration, and expresses the hope that this panel will raise an awareness among interested scholars of strategic and economic issues. modern Ukraine on the way of reforming the legal system in accordance with European standards. It is concluded that at the present stage of state building the unitary form of the state structure is optimal. At the same time, practical actions are needed in the direction of decentralization of state power to create a civilized state. The great influence on the development of the modern legal system of Ukraine is due to the integration of the legal norms and principles generally recognized by the world community into its structure. Today, there are not so many states, which, having emerged as unitary, then changed the form of government into federal. The process of studying various types of unitary states should be based on a clear methodological basis. Ukrainians have confirmed that they are Europeans who profess the same values of democracy and citizens of European countries that have a decent standard of living for people. Democracy in the state, sovereignty and independence are provided not by changes in the territorial structure, but, in particular, by stable economic growth. Over the past decades, there have been processes of transformation of federal states into unitary ones, without making any changes to the constitution. According to studies by most experts, for our country the optimal form of government is the unitary decentralized state. The author defends the preservation of the unitary character of the Ukrainian state at a certain decentralization of power, development of the institution of local government and improves the structure of Parliament. We must build the newest Ukraine with a modern legal system, focusing on best practices, but not trying to copy even the best world examples. more...

26. The Origins of Post-Authoritarian Federalism: Iraq 1992-2003: Historical Traditions, Internal Threats and International Allies

Studies of the federal system have generally focussed on the consequences of its application. Most often, the reasons for the adoption of the federal system in its various forms are not examined in depth. A case study like Iraqi federalism may provide an additional building block to the literature on federalism and might also help to explain the rise of federalism elsewhere, especially in countries with deep-rooted diversity (DRD). The debate about whether federalism is a durable, sustainable alternative to the unitary state for purposes of tackling ethnic, cultural, or religious strife has raised fundamental questions. Federal experiments have resulted in failed outcomes as well as successful ones. To better understand the dilemma of federalism’s successes and failures, I have chosen to study the origins of federalism, which might help explain the successes and failures of some federal systems. Hence, Iraqi federalism is just a case that will elaborate on that. In order to accomplish this, the dissertation focuses on the macro-level of Iraqi society; the major ethnocultural groups that are based on territory, and have participated in both the 1991-2002 federal process and, ultimately, the post-2003 federal process. However, in my final chapter of this dissertation, I will look at the key current issues, particularly militias as well as the rise of Al-Qaeda and ISIS in the Sunni region and elsewhere in Iraq, and whether it is connected to the federal system. We show that a A-linear map of Hilbert A-modules is induced by a unitary Hilbert module operator if and only if it extends to an ordinary unitary on appropriately defined enveloping Hilbert spaces. Applications to the theory of multiplicative unitaries let us to compute the equivalence classes of Hilbert modules over a class of C*-algebraic quantum groups. We, thus, develop a theory that, for example, could be used to show non-existence of certain co-actions. This paper is concerned with a scenario of multiple attackers trying to intercept a target with active defense. Three types of agents are considered in the guidance: The multiple attackers, the target and the defender, where the attackers aim to pursuit the target from different directions and evade from the defender simultaneously. The guidance engagement is formulated in the framework of a zero-sum two-person differential game between the two opposing teams, such that the measurements on the maneuver of the target or estimations on the defending strategy of the defender can be absent. Cooperation of the attackers resides in two aspects: redundant interception under the treat of the defender and the relative intercept geometry with the target. The miss distances, the relative intercept angle errors and the costs of the agents are combined into a single performance index of the game. Such formulation enables a unitary approach to the design of guidance laws for the agents. To minimize the control efforts and miss distances for the attackers, an optimization method is proposed to find the best anticipated miss distances to the defender under the constraint that the defender is endowed with a capture radius. Numerical simulations with two cases are conducted to illustrate the effectiveness of the proposed cooperative guidance law. more...

In the Kingdom of Serbs, Croats and Slovenes (SCS), the Radical Party sought to establish and preserve the unitary state order. In the first half of 1921, the official newspaper of the Radical Party 'Samouprava' (Autonomy) consistently defended this concept during the constitutional debate preceding the adoption of the Vidovdan Constitution (adopted by the Constitutional Assembly on St. Vitus' Day, 28 June 1921). Numerous arguments were made in favor of political centralization, while challenging federalism as a good constitutional solution to internal political, national and economic relations. The arguments proposed by 'Samouprava' were based on the fact that a unitary state best suited the interests of a single nation which included three Slavic tribes, where's the federal system of government would trigger the development of 'tribal' and provincial separatism. State unity was also sought for foreign policy reasons because it was believed that the federation would be resistant to external pressures, especially in the event of any confrontation with the neighboring countries. more...

Heinrich Hertz dedicated the last four years of his life to a systematic reformulation of mechanics. One of the main issues that troubled Hertz in the customary formulation of mechanics was a ‘logical obscurity’ in the notion of force. However, it is unclear what this logical obscurity was, hence it is unclear how Hertz took himself to have avoided it. In this paper, I argue that a subtle ambiguity in Newton's original laws of motion lay at the basis of Hertz's concerns; an ambiguity which led to the development of two slightly different notions of force. I then show how Hertz avoided this ambiguity by deriving a unitary notion of force, thus dispelling the obscurity that lurked in the customary representation of mechanics. more...

Although it is often assumed that spatial attention exists in the form of a unitary focus, the split-attention hypothesis proposes that attention can be simultaneously divided into two spatially noncontiguous positions and that the space in between can be ignored. However, whether split attention occurs directly based on the generation of attentional benefit or whether it requires a gradual divide from a unitary focus over time has not been clarified. In the present study, by using two spatial salient cues to direct the attention allocation of participants, we aimed to investigate whether attention requires time to divide from a unitary focus and whether the appearance time of split attention varies when the task difficulty level increases between experiments. The results showed that attention required time to divide from a unitary focus, and the position between the two cued positions was not excluded by attention when the stimulus-onset asynchrony (SOA) was 60 ms. However, as the task difficulty increased between experiments, the appearance time of split attention was earlier. These findings suggest that the appearance time of split attention has a certain flexibility and can be changed according to the task requirement, thus implying that split attention and unitary attention present some common attention mechanisms and that a split or unitary mode can be flexibly selected for an attention system. more...
