Bu çalışmanın temel amacı, ifade özgürlüğü bağlamında siyasetname geleneğinin sahip olduğu birikimi tespit etmek, buna bağlı olarak yeni bakış açıları oluşturma potansiyelini tartışmaktır. Modernitenin geleneksel yapılara yönelik en önemli eleştirilerinden biri insanların sosyal, kültürel ve dinî gerekçelerle pek çok sınırlandırmaya maruz bırakıldığı iddiasıdır. Ağırlıklı olarak eylem özgürlüğünün sınırlandırılmasına odaklanan bu eleştiri, düşüncelerin ifade edilmesinin engellenmesi konusunda da karşımıza çıkmaktadır. Geleneksel anlayışlar bu tutumu sergilerken, sadece belirli bir otoritenin pozisyonunu korunmayı veya güçlendirilmeyi değil, yanı sıra bireysel ve toplumsal açıdan ortaya çıkabilecek sorunları da önlemeyi hedeflemişlerdir. Ancak, bu düşüncelerin her zaman belirtilen niyete sadık kaldığını söylemek mümkün değildir. Bu bağlamda, geleneksel anlayışların tarihsel bağlamlarıyla birlikte ele alınması, sadece belirli bir dönem yahut medeniyet hakkında entelektüel bir malumat yığınına vakıf olma amacı taşımamalıdır. Asıl gaye, söz konusu birikimi eleştirel bir değerlendirmeye tabi tutabilmek ve bu alandan elde edilecek anlamlı sonuçlara ulaşmak olmalıdır. Çalışma konusunun çerçevesi belirlenirken, siyasetnameler üzerinden bir okuma yapmanın, böyle bir fırsatı sunacağı düşünülmüştür. Çalışmada öncelikli olarak ifade özgürlüğünün zihni altyapısı üzerinde durulmuş; buna istinaden siyasetname kültüründe konuya ilişkin genel değerlendirmelere yer verilmiş ve özgürlüğün kapsamının belirlenmesi açısından büyük bir öneme sahip olan otorite kavramına değinilmiştir. Özellikle yönetim erkinin başında yer alan yöneticilerin, otoritelerini hangi güce dayandırdıkları ve bunun sınırlarının hangi ilkelerden hareketle belirlenmesi gerektiği vurgulanmıştır. Siyasi hayatla ilgili hem ideal ilkelere yönelen hem de realiteyi dikkate alan siyasetnamelerin bir meşruiyet zemini oluşturmak yahut var olan durumu anlamlandırmak açısından otoritenin kaynağına ilişkin önemli değerlendirmeler barındırdığı görülmektedir. Konuyla ilgili değerlendirmeler yapılırken, siyasetnamelerin, otoritenin mevcudiyetinin ve kullanımının temel amacının düzen fikri olduğuna dikkat çektikleri son derece açıktır. Bu bağlamda, düzenin sağlanması için belirlenen sınırların ihlali durumunda ne tür önlemlere başvurulacağı, siyasetnamelerin en önemli konuları arasında yer alır. Bu önlemler arasında bütün özgürlüklerin, özellikle ifade özgürlüğünün bir şekilde sınırlandırılması düşüncesi önemli bir yer tutar. Makale, farklı siyasi ve toplumsal durumlarda ortaya çıkabilecek reaksiyonlara yönelik, bu çerçevede dile getirilen önerilerin muhtemel katkılarına da işaret etmektedir. Belirtilen katkıların başında, yöneticilerin bazı gerçekleri yeterince algılayamamalarına neden olan, farklı toplum katmanlarıyla sağlıklı iletişimin önünde ciddi bir engel oluşturan ve perdelenme diye isimlendirilebilecek bir engeli aşmaya dair değerlendirmeler yer almaktadır. Makalenin odaklandığı temel meselelerden biri de, siyasetnamelerin toplumun gövdesini oluşturan geniş kitlelerin ifade özgürlüğünü nasıl kullanacaklarına yönelik önerileridir. Bu öneriler, toplumsal yapının farklı boyutları arasındaki diyalektik ilişkinin çerçevesini belirleme noktasında, yönetilenlerin de sorumluluk sahibi olduklarını ifade etmektedir. Modernite sonrası dünyada gelişen toplumsal anlayışlar geleneksel yaklaşımlara göre bireyi çok daha ön plana çıkaran bir mahiyet taşır. Bu, bir dereceye kadar olumlu etkiler üretmiş olabilir. Bununla birlikte, insanların birlikte yaşama kültüründe ciddi bir erozyonun bu vesileyle meydana geldiği görülmektedir. Bunda genel anlamda özgürlüğün, özel de ise ifade özgürlüğünün sorunlu bir şekilde kullanılmasının payı büyüktür. En üst toplumsal yapılar olan devletler açısından da bu sorunların gün geçtikçe arttığı söylenebilir. Dolayısıyla bireysel özgürlüklerin sağlanması arzusunun orta vadeli sonucu bazen kaos olarak, uzun vadeli sonucu ise yeniden daha otoriter bir yapının ortaya çıkması şeklinde belirebilir. Hatta bu otoriterleşme eğilimleri, ifade özgürlüklerinin yanlış kullanımları gibi makul gerekçelere dayandırılarak güç kazanabilir. Bu sorunların üstesinden gelinmesinde, siyasetnamelerin modern dönemin beşerî planda oluşturduğu kayıtsızlık durumuna önemli alternatifler sunarak, büyük toplumsal kırılmaları önlenmede yardımcı olabilecekleri unutulmamalıdır. Çalışma, bu bağlamda siyasetnamelere göre, ifade özgürlüğünün hangi şartlarda sınırlandırılabileceğine de değinmektedir.

The main aim of the article is to provide analysis on the notion of the right to be forgotten developed by the CJEU in the ruling Google v. AEPD & Gonzalez and by the General Data Protection Regulation within the context of the processing of personal data on the Internet. The analysis provides the comparison of approach towards the notion between European and American jurisprudence and doctrine, in order to demonstrate the scale of difficulty in applying the concept in practice.

[full article, abstract in English; abstract in Lithuanian] The concept of chilling effect, formulated in the beginning of the second half of the 20th century by the Supreme Court of the United States of America, has been applicated both in common law and in continental law system. Lately, also the Polish Constitutional Tribunal more often has used it. Despite the U.S. Supreme Court bound the chilling effect with infringement of the freedom of speech, nowadays it seems to be useful to describe also interferences to other human rights. The European Court of Human Rights has developed that kind of interpretation. It has occurred that the notion of chilling effect perfectly describes any interference into right or freedom consisting of deterring of a person from undertaking by he or she an action. The Polish Constitutional Tribunal has drawn the concept of the chilling effect directly from adjudication of the ECHR. But without broad justification it also applicates this notion to constitutional issues connected with provisions concerning the system of government. This process of adaptation of the chilling effect concept provokes questions whether this notion was properly rooted in the Polish constitutional system. The Polish Constitutional Tribunal has not deeply explained how to understand the concept of chilling effect and in what occurrences it may be applied. Without clear statement of the Polish Constitutional Tribunal we can say that the chilling effect concept may not be applied only in the cases concerning rights and freedoms which imply act of deterrence, like prohibition of compelling to participate or not participate in religious practices. Moreover, we can only assume that identifying the chilling effect does not overjudge the result of constitutional review, it is just an argument for unconstitutionality.

As a consequence of the new social realities, and here we refer to the diversification of the methods of information of the public, it can be seen an increase of the cases pending before the court of laws in which there are required moral damages by natural and legal persons, damages which come from the breaching of the right to reputation, especially by the media. As it was set by the Court, the right to protect the reputation is a right protected by art 8 from the convention, being an element which belongs to the private life. It was shown that the notion of "private life" is a wide notion, which cannot have an exhaustive definition and which includes the moral and physical integrity of the person and, thus, can include the multiple aspects of the identity of a person, as well as the identification and sexual orientation, name or elements in regard to the image right. As in the last years, as a consequence of diversifying the means of global information, the cases before the courts in which it is claimed the right to reputation have increased, it is necessary to analyse some aspects regarding this matter, in the recent case-law of the European Court of Human Rights, in the cases against Romania. In our opinion, the CEDO case-law is relevant due to the incidence of the European Convention of the Human Rights in the Romanian Law. [ABSTRACT FROM AUTHOR]
