Gregorio López’ name is inextricably linked to his edition and commentary on the Siete Partidas, and both his contemporaries and later jurists praised him for having added »the eternal explanation« to this centrepiece of medieval Castilian legislation. The technique of commenting on authoritative texts was the basis of the scholastic method as practiced at the Spanish and Portuguese universities in the 16th century. Writing glosses or commenting was a method of making authoritative texts applicable to contemporary problems, circumstances and questions. In the Spanish context, this can be observed particularly whenever problems posed by the developments in the Americas needed to be resolved. Although the medieval tradition obviously had not discussed these issues, commenting on and interpreting authoritative texts by medieval thinkers was used as an intellectual tool to develop answers to contemporary problems. A closer reading of López’ commentary on the Siete Partidas confirms the use of this technique, especially with regard to the presence of the Americas as a topic in the glosses. The following analysis traces López’ work both as an editor and as a commentator of the Partidas to examine several examples of how he incorporated new questions into the framework of a medieval authoritative text.

En este artículo se reconstruye el proceso judicial seguido en 1823 en contra de Marcos Trujillo, un herrero iletrado que prestaba servicios al Estado en los tiempos de la incipiente República de Colombia (1821­1830). Ante las pocas raciones de comida que recibía por su labor en la Maestranza de Pamplona y la separación de su familia y de su tierra, Trujillo decide fugarse para estar con su esposa e hijos. Esta acción constituyó un delito de desobediencia contra el Estado, por lo que el Juez de la Villa de San Gil ordenó que se le apresara y se le regresara a la Maestranza para cumplir con sus obligaciones. En el camino, Trujillo se hirió un pie y según testigos, pidió una estaca para quitarse la vida antes de volver a su trabajo. Al delito de desobediencia, se le agregaron los de antipatriota y el del intento de darse muerte, basado en los hechos de herirse el pie y pedir una estaca para segarse la vida. Pese a que la legislación de la República no establecía taxativamente el intento de suicidio como una violación de la ley, a Trujillo se le abrió el juicio y encarceló por los tres delitos. La norma de la Colonia sí castigaba con el despojo de bienes la tentativa de “muerte propia” y la quema del cadáver del suicida, y en parte siguiendo la tradición religiosa prerepublicana, tanto el Juez como el Fiscal del caso Trujillo consideraron que efectivamente el herrero violó la ley por tres causas, aunque después se le indultó.

The set of manuscripts of the Siete Partidas produced in the Middle Ages testify the impact, importance, and relevance of this legal work in Castile and other peninsular kingdoms. This importance led to the commission of illuminated codices by relevant figures with images that illustrated the different laws or legal concepts and, at the same time, served as a way of ornamenting and dignifying these manuscripts. In this study the author analyses the presence of religious iconography in the codices of the Siete Partidas, classifying the most notorious religious iconographic themes, as well as possible parallels in other late medieval illuminated legal works. El conjunto de manuscritos de las Siete Partidas producidas en la Edad Media testimonia el impacto, importancia y relevancia de esta obra jurídica en Castilla y otros reinos peninsulares. Esa importancia propició el encargo de códices iluminados por parte de personajes destacados, con imágenes que ilustrasen las distintas leyes o conceptos jurídicos y que, al mismo tiempo, sirviesen como modo de ornato y dignificación de estos manuscritos. En el presente estudio el autor analiza la presencia de la iconografía religiosa en los códices de las Siete Partidas clasificando las temáticas iconográficas religiosas más notorias, así como posibles paralelos en otras obras jurídicas iluminadas bajomedievales.

Alfonso X of Castile, also known as Alfonso the Wise was one of the most eminent Medieval rulers of the Kingdom of Castile and León. This paper presents selected facts from his life, especially highlighting his achievements as a patron of science and literature, as well as propagator of the vernacular language, i.e. Castilian. A special focus herein will be on the code Siete Partidas. Written under Alfonso's auspices, this text describes knightly customs and combines the features of fiction and legal documents. The paper consists of two parts: a commentary and a translation of Title XXI of Partida II. The commentary presents the essential information on Alfonso X, including his legislative activities connected to Siete Partidas, and also the significance of the code for Spanish legislation, the contents of the seven books (partidas), as well as its authorship. In order to provide some background of the knightly culture on the Iberian Peninsula in the 13th century, knighthood rights are also presented on the basis of other contemporary texts on related subjects, such as Ramon Llull's The Book of the Order of Chivalry or the French anonymous treatise L'ordene de chevalerie. The translation presented in the second part of the article is the first and the only Polish version of a fragment of Siete Partidas dealing with duties, privileges and also customs. Prepared on the basis of the critical edition by Jerry R. Craddock and Jesús Rodríguez Velasco, the translation attempts to grasp the nature of the original language and content, providing notes, which facilitate comprehension of particularly challenging problems. En el artículo se cuentan los recientes desarrollos del proyecto colaborativo 7Partidas Digital. En concreto, se señalan los principales rasgos del trabajo filológico tradicional y se apuntan los posibles avances que pueden ofrecer los medios informáticos a la hora de realizar una edición crítica digital. Entre los aspectos más destacados, insistimos en la transcripción automatizada de testimonios impresos y en el uso de sistemas de colación automática, dos recursos que de manera concreta agilizan y semplifican el trabajo filológico.

In this study the crimes that the characters of La Celestina commit are identified according to the civil law active during that time, which is contained in Las Siete Partidas. As much as the crimes constitute the definitive actions of the principal characters, they express the ethos of a work composed with a systematic legal conscience by the «bachiller en Leyes» Fernando de Rojas. Likewise, the illegal acts have as a dominant cause the «desesperación» of the ones performing them. This conducts Pleberio to the solitude of the modern individual.

The Chilean Civil Code constitutes the most important codification of Latin America as it affected the vast majority of legal systems in the region as well as beyond it. In Chile itself, the code perfectly responded to the needs of the country which was seeking social and political consolidation and had the ambition to become a local power. The article presents the historical background of the work on the Code and presents its author whose merits for the process of codification and for the creation of a legal identity of the continent cannot be overestimated. Above all, however, it describes the method of working on the code which consisted of two basic stages - the consolidation of colonial law and, subsequently, the codification which took into account solutions developed in various legal systems and was based on a multitude of sources and inspirations. The Code was meant to achieve a balance between conservatism and tradition, as understood by the Spanish law, especially the Siete Partidas, and the latest achievements of the legal science in Chile, mainly from the Napoleonic Code, which emphasized the liberalization of economic relations. This feature turned out to be universal and timeless, which made the Code a success in Chile and popular throughout the continent. [ABSTRACT FROM AUTHOR]

El deber básico de todo investigador que aborde la edición de un texto con transmisión manuscrita, e incluso impresa, es el examen directo de todos los testimonios. Alberto Blecua indicaba, también, que “son sumamente importantes las descripciones (…) antiguas de manuscritos” (1983, p. 38). El trabajo de campo realizado en las bibliotecas y archivos que conservan algún testimonio de las Siete Partidas y el análisis de muchas de las viejas descripciones nos han mostrado que se han de tomar con cierta prevención debido a la poca atención que se le ha prestado tanto al soporte material como al contenido de esos testimonios. Producto de la revisión y análisis directo de los originales son las tres notas codicólogicas siguientes. En la primera, se establece que una copia manuscrita conservada en el Archivo Histórico de la Nobleza (Toledo) está basada en un ejemplar de la edición incunable de Díaz Montalvo (1491). En la segunda se demuestra que la tabla inicial del ms. VITR/4/6 de la BNE no está desplazada y que se reubicó en ese lugar cuando se creó el volumen definitivo a lo largo de la segunda mitad del siglo xv. En el tercero se demuestra que el ms. 8721 de la BNE contiene una copia completa, pero mutilada de la Séptima Partida.

The Siete Partidas, compiled in the mid-13th century for the Castilian king Alfonso X el Sabio, constituted the code of law for Castile and later Spain. Despite the practicality of their instructions and principles on warfare, they are not well studied. This article will review the military provisions, paying special attention to commanders, the battlefield formations for infantry and cavalry, and the rules on booty and ransom, in the context of the time. While it is difficult to pinpoint unequivocal influences, the passages are demonstrably practical within the contemporary military doctrine and the ideals of chivalry. As such, they offer a unique insight into the mechanics of leadership, the battlefield formations of the High Middle Ages, as well as the crucial function of spoils as a source of status-compatible income for the knightly estate and lower nobility, so adding depth and texture to this little-studied yet essential aspect of mediaeval military, economic, and political organisation.

La caballería es uno de los elementos esenciales de la configuración del personaje de don Quijote y su influencia en la obra cervantina va más allá de su relación con la narrativa idealizante. Las «leyes de caballería» a las que tanto alude el hidalgo hacen referencia a un cuerpo de leyes y tratados medievales y renacentistas de temática militar, que regulaban los retos y desafíos y atendían a otras cuestiones relativas a la milicia, como la vexilología o incluso la albeitería. El estudio detallado de esos tratados permite encontrar un gran número de referencias en el texto de Cervantes.

From the Roman sources, in the Corpus Iuris Civilis, until the Nineteenth-Century codifications, the fortuitous event was central both in Public Law and in Private Law. The study of the Castilian and Indian Laws Compilations and of Chapter XIX of Comentarios a las ordenanzas de minas, published by Francisco Xavier de Gamboa in 1761, will allow to emphasize how in the Indian Order recourse was made exclusively to the Siete Partidas to discipline this important legal category, even in the last decades of the XVIII Century. L’étude s’appuie sur les définitions du mot pueblo dans les dictionnaires de l’époque, de ses usages dans les Siete Partidas ainsi que dans quelques traités politiques des XVIe et XVIIe siècles. Il s’agit de s’interroger sur les valeurs et la portée de ce terme ambigu et polysémique dans les discours politiques du temps et sur les différentes façons de nommer un sujet politique collectif.

The medieval hunt and hunting manuals have been studied by historians as sources for the history of medieval science and geography, and for their insights into the daily lives of the elite societies that practiced hunting as a ritualized sport. This article examines two medieval hunting manuals, Juan Manuel's Libro de la caza, and the Libro de la montería, commissioned by King Alfonso XI of Castile, and King Alfonso X's law code, the Siete partidas, for their rhetorical and ideological portrayals of hunting and falconry as expressions of aristocratic power and sovereignty over the natural world. The article concludes with a study of an imagined debate between the merits of falconry and hunting with hounds in the Libro de la caza and Libro de la montería that sheds light on Juan Manuel and Alfonso's competing views on nobility, informed by the political history of war and rebellion that shaped the lives of both men. El presente artículo estudia la presencia de la Ética aristotélica en Las Siete Partidas de Alfonso X y el influjo de la obra vernácula alfonsí en Brunetto Latini, a raíz de la visita que éste hizo a la corte alfonsí in 1260. Su discute el tema de las primeras traducciones de la Ética aristotélica así como las mutuas relaciones e intercambios literarios y culturales entre ambos estudiosos. This article discusses the presence of the Aristotelian Ethics in the Siete Partidas of King Alfonso X and, in the light of Brunetto Latini’s visit to Alfonso’s court in 1260, the impact of Alfonso’s vernacular endeavors in Latini’s works. The topic of the early translations of Aristotelian Ethics is also discussed as well as the mutual relations and literary exchanges between the two scholars.

The Siete Partidas, the famous law code, of Alfons X. of Castile, written in the 13th century offers us a great variety of topics which have to be investigated more detailed. The central question is, which functions has the text besides being a law code? The encyclopedic character of this work, provides an insight into daily life of medieval Castile and mirrors the historical frame in which it was written. One of the central ideas of the Siete Partidas was to unify the existing „laws” in the Kingdom of Castile. But, unification also means a centralization of the power which was embodied by the king. The fact, that this was not completely accepted by other powerful people of that time made it necessary for Alfons X. to legitimate his own power. This article highlights different functions of the Siete Partidas of King Alfons X. of Castile based on a discourse analysis and a hermeneutical interpretation. [ABSTRACT FROM AUTHOR]
