Although numerous studies have independently tested the roles of physiological integration and parental effects on the performance of clonal plant species, few have assessed them simultaneously. Moreover, the capacity for physiological integration differs greatly within species of clonal plants. We conducted a greenhouse experiment with eight genotypes of the clonal herb Hydrocotyle verticillata. In the first phase, we either severed or maintained the connections between the original proximal nodes (the basal portion) and the new distal nodes (the apical portion) of each genotype. In the second phase, the ramets in the apical portion produced in the first phase were selected and cultivated, and their connections were subjected to the same severance treatments. In the first phase, the negative effects of severance on the apical portion balanced the positive effects of severance on the basal portion, resulting in no net effect of severance on total mass, leaf mass, stem mass, and ramet number for the whole clone. In the second phase, the effects of parental severance on stem mass of the apical portion of H. verticillata varied among the eight genotypes. Additionally, the positive effect of physiological integration on offspring generations was greater in the apical portion and the whole clone of one genotype when the parental connections were intact than when they were severed, whereas it was greater in the apical portion of another genotype when the parental connections were severed than when they were intact. Our results suggest that clonal parental effects can influence the capacity for physiological integration of offspring generations and that these effects may differ among genotypes within a species. We examine the barrier effects of freeways in California. We analyze the association between freeways and nearby street network connectivity and quantify the frequency and quality of crossings—underpasses or bridges that enable pedestrians and cyclists to cross the freeway. We find that barrier effects are most pronounced in communities of color. We also find that even where crossings exist, they are unpleasant or even hazardous for pedestrians and cyclists because of high-speed traffic on on- and off-ramps, and because large volumes of traffic are funneled through a small number of crossings rather than being distributed over a wider network.

The Dodd–Fank Act mandated shareholder votes on executive's change‐in‐control (golden parachute) payments at the time the firm is sold. We study bid premiums surrounding the introduction of the vote and find that they are lower in the post‐period. Moreover, there is a positive association between the relative size of parachute payments and premiums, particularly after the parachute vote was required. In contrast, we observe no association between premiums and parachute features questioned by many shareholders. Additionally, we find lower voting support for parachutes with features that are (i) of concern to shareholders, (ii) amended in the lead‐up to the vote and (iii) identified as problematic in proxy advisor analyst reports. However, we find little evidence that directors overseeing payments with opposition from shareholders or a leading proxy advisor are penalized with lost board seats, fewer key board committee memberships or increased shareholder opposition in subsequent director elections at other firms. This article investigates two recent novels that deal with environmental and pandemic disasters: Severance (2018) by Ling Ma and Under the Blue (2022) by Oana Aristide. The analysis is based on ecocritical and posthumanist perspectives and on a division made by Chakrabarty (Planetary Crises and the Difficulty of Being Modern), in two different understandings of the globe: one connected to the planetary-focused discourse on global warming and the other on human-centered globalization. The clashes of these discourses are highlighted in the novels. They illustrate a process of understanding that humans are not separate from the natural world, through the disease itself and through the sudden need to survive without modern healthcare and all the comfort we are used to being able to buy. The gradual insight of the depicted characters, and perhaps also the readers of the novels, is that we live on a planet of extreme complexity and interdependence. [ABSTRACT FROM AUTHOR]

It has been widely argued that the Citizenship (Amendment) Act 2019 ("CAA") breaches Article 14's equality guarantee due to its under-inclusiveness i.e. it does not include within its ambit many migrants who faced persecution similar to the persons it covers. However, it is often argued that under-inclusive laws are subjected to a low standard of review, which increases the justificatory burden on those who challenge its validity. I argue that there is no support in principle or case law for the argument that under-inclusive laws are subject to lower scrutiny than over-inclusive ones. Linked to this is the question of constitutional remedies for under-inclusive laws, which I analyse drawing on jurisprudence from India and other jurisdictions. Contrary to dominant opinion, I argue that, were the CAA to be declared unconstitutional, the appropriate remedy would be to extend its benefits to those hitherto uncovered by it, rather than striking it down. Abstract Transport infrastructure such as railways, motorways and arterial roads increases regional accessibility for motorised transport but simultaneously can create barriers in local street networks that can decrease accessibility for pedestrians and cyclists. Although several tools for an objective assessment of these barrier effects have been developed, their use in practice is limited; impact assessments are instead based on subjective descriptions. This article reviews the literature on barrier effects of the last 60 years and aims to offer guidance for the use of objective methods of assessment of barrier effects. The first contribution is a conceptual model for the barrier effects of transport infrastructure and their determinants. The second contribution is an overview of tools for the assessment of barrier effects. We conclude that a multi-disciplinary approach is required, supported by the conceptual model and the overview of assessment tools. Investments in transport infrastructure can then be based on broader decision support involving not only the benefits of increasing regional accessibility but also the cost of reducing local accessibility.

The paper discusses the mode of land acquisition for public road development resulting from the process of land severance performed at the request of the owner in terms of: the legitimacy of land acquisition by the State Treasury or local government units, by virtue of law, upon the land severance approval, the compensation for taking over the land severed for roads, the possibility of restitution of partially acquired plots of land in case a road has not been constructed, and therefore the redundancy of land earmarked for public purposes. The author compares land acquisition procedures set out in historical and currently applicable regulations as well as obligation to pay compensation. The aim of the research is to answer the question of whether the regulations according to which the land allocated for roads is acquired by operation of law by public entities should be modified, and if so, to what extent. On the example of a selected city, research was carried out to determine whether the acquired land is used at a later stage for road construction and what is the scale of compensation claims paid by the municipality. The conducted research made it possible to propose solutions to modify the mode of land severance resulting in land being severed for road development, considering both rational property management and the rights of former owners for restitution in the event public entities failed to use this real property for public purposes.

In her attempt to write an apocalyptic fictional story, Ling Ma succeeds in creating an extraordinarily believable and engrossing anti-utopian image of the world. Her debut, Severance (2018), transcends the dystopian apocalyptic genre and becomes an impressive prophecy that partially comes true during the current Coronavirus crisis. It announces her as a talented author with its mix of humor, anger, terror and satire. Ma intends her book to be a critique of Capitalism. That is why she magnifies its harmful side effects through the lens of a destructive illness that starts with flu-like symptoms and develops into a pandemic. However, her book rings shocking and frighteningly true these days with the widespread of Covid-19. This research examines Ma’s Severance from a dystopian pre/post-apocalyptic perspective and highlights the similarities between its events and what happens during the current Covid-19 pandemic. The analogy between both pandemics proves that dystopian apocalyptic works are not always science fictional. First, the research briefly traces the origin of dystopian apocalyptic literature. Then, it discusses the use of common characteristics of this genre in the novel. Among them are the loss of individualism, the spread of plagues and pandemics, totalitarianism, the regimented lives of citizens, using the ‘defamiliarization’ technique, and emphasis on the theme of survivorship. Abstract Background Everyday activities, such as walking or cycling, may be a feasible and practical way to integrate physical activity into everyday life. Walking and cycling for transport or recreation in the area local to a person’s home may have additional benefits. However, urban planning tends to prioritise car use over active modes. We explored the cross-sectional association between living near an urban motorway and local walking and cycling. Methods In 2013, residents living in an area (a) near a new urban motorway (M74), (b) near a longstanding urban motorway (M8), or (c) without a motorway, in Glasgow, Scotland, were invited to complete postal surveys assessing local walking and cycling journeys and socio-demographic characteristics. Using adjusted regression models, we assessed the association between motorway proximity and self-reported local walking and cycling, as well as the count of types of destination accessed. We stratified our analyses according to study area. Results One thousand three hundred forty-three residents (57% female; mean age: 54 years; SD: 16 years) returned questionnaires. There was no overall association between living near an urban motorway and the likelihood of local walking or cycling, or the number of types of local destination accessed by foot or bicycle. In stratified analyses, for those living in the area around the new M74 motorway, increasing residential proximity to the motorway was associated with lower likelihood of local recreational walking and cycling (OR 0.63, 95% CI: 0.39 to 1.00) a pattern not found in the area with the longstanding M8 motorway. In the area near the M8 motorway residential proximity was statistically significantly (p = 0.014) associated with a 12% decrease in the number of types of destination accessed, a pattern not found in the M74 study area. Conclusions Our findings suggest that associations between living near a motorway and local walking and cycling behaviour may vary by the characteristics of the motorway, and by whether the behaviour is for travel or recreation. The lack of associations seen in the study area with no motorway suggests a threshold effect whereby beyond a certain distance from a motorway, additional distance makes no difference.

Promotion of active travel is a fixture in transport policy and planning. Yet, this paper argues, walking and the availability of comprehensive and accessible pedestrian environments have an importance for mobility justice and sustainability which is not currently recognised. The paper investigates how and why walking provision matters for justice, and explores what this means for decision-making affecting mobility systems and the built environment. It begins with an argument that a coherent conception of mobility justice would be simultaneously concerned with environmental and social implications of transport since both affect people’s physical lives, welfare and flourishing. That requirement frames the types of mobility systems which could be compatible with justice, and points to a need for prioritisation of active travel far beyond current policy and practice. Specifically, the need for environmental sustainability coupled with social inclusion creates a case for systematically prioritising provision for walking over other mobility. This means the removal of all forms of barriers to walking so that no one is excluded by severance, impassable surfaces or lack of safety.

This study analyzes the mystical attribute of invocation (dhikr) in some of the most important mystical works up to the seventh century AH. The ground of this research is based on the analysis of dhikr from the perspective of steps of mystical journey. This study, written in a descriptive-analytical way, shows that the attribute dhikr in the words of some mystics, in each of the three levels of wayfaring, has been treated with a different approach and has undergone a change in content. In the first stage of the spiritual journey, which is the status of severance, dhikr has a positive and active nature so that in this step, the wayfarer tries to be attributed to dhikr and its implications. In the second step which is the status of annihilation, however, the Divine attraction annihilates the seeker’s virtual existence and all his attributes. Therefore, dhikr in the mystic finds a negative and purifying characteristic, his effort is lost and he is no more attributed to dhikr. But in the third stage, that is, the level of persistence, the mystic becomes the manifestation of the Divine names and attributes, so that dhikr again appears in the mystic in a positive but transformed state. The result of this study shows that although the statements of most mystics about dhikr are consistent with the characteristics of severance step, the words of some of them conform with the characteristics of all the three levels of severance, annihilation, and persistence [ABSTRACT FROM AUTHOR]

The most commonly recited anecdote regarding Dante Gabriel Rossetti recalls the incident surrounding the burial of his bound manuscript of poetry in 1862 alongside his wife Elizabeth Siddal. Buried in an act of contrition encouraged by his brother, the manuscript was retrieved from the exhumed coffin at Rossetti's behest in 1869 by his friend Charles Augustus Howell and returned to the poet in a severe state of decay and smelling of disinfectant. Three of the poems recovered would famously form an integral part of the 1870 Poems. This essay situates Rossetti's action in undertaking the exhumation as a trope for the way his poetry consistently revisits and reconfigures conceptualisations of life and death, often with regards to physical and spiritual embodiment. Without seeking to offer ethical justification for Rossetti's actions in retrieving his poems, I will focus rather on the ways in which his poetic vision is dominated by the language of exile and return, of burial and retrieval, and how these twin concerns are manifest in the poems of the little green book. These three long poems, which it appears he was most eager to recover through the distasteful act, are identified collectively as 'the exhumation poems': 'Dante at Verona', 'A Last Confession', and 'Jenny'. This study explores the puzzle of CEO severance agreements by examining the association between the existence of ex ante severance agreements and the timeliness of bad news disclosures. Classifying severance agreements by type and the way boards grant them, this article documents a positive association between the timeliness of bad news disclosures and the existence of an ex ante single-trigger severance agreement, especially when it is granted alone. This association remains positive in the CEO’s last year of tenure where performance is poor. Further analyses show that this association is stronger among CEOs with a high-variable pay structure than among CEOs with a low-variable pay structure. These results suggest that an ex ante single-trigger severance agreement may play a role in forming timely disclosures of bad news and that paring it with a high-variable pay structure enhances the chance of its success. A 49-year-old female patient with carpal tunnel syndrome at both hands was performed open carpal tunnel release. 4 months later, on the left hand, severance of the thenar branch was found by electromyography. On the 138th day, re-exploration was performed for direct nerve repair. During exploration, we identified the transligamentous variation of recurrent motor branch. Direct nerve repair was successful. At 6 months after direct repair, the nerve function began to return. At 2 years after direct repair, the nerve function has almost returned. There are some variations on the recurrent motor branch. And we overlooked transligamentous variation when we perform more decompression around the median nerve. The law-making role of judges has always been the subject of much controversy. For a good many a year and especially during the apartheid regime, the approach to statutory interpretation that dominated the South African courts was the orthodox textual position. According to the textualists, as they were referred to, the position that was adopted was that legislation was to be interpreted within the framework of the words used by the legislature. The courts were not empowered to make any modifications, alterations or additions to the legislative text, as this function was solely the responsibility of the legislature. The paradigmatic shift in emphasis since 1994 from a system of parliamentary sovereignty to constitutional supremacy changed this position significantly. The key consideration of statutory interpretation was that the aim and purpose of legislation was to be considered with the values of the Constitution forming the over-arching principle in the process of interpretation. The courts were enjoined to reconcile the purpose of the legislation with the provisions of the Constitution, and in particular, the Bill of Rights. The emerging view in support of the purposive or the teleological theory has been that judges do indeed have a law-making function in the process of interpretation. Since the early 1990's, it has been observed that the judiciary has been able to assert its influence on the development of the law and the emerging jurisprudence, as a result of the powers derived from the Constitution, and in particular section 39(2). The article examines the extent to which the judiciary can use this power in a post-democratic constitutional era, in South Africa, to achieve justice. From the repository of cases, which forms the basis of the discussion, the article proposes a set of factors that ought to be heeded by our courts in the application of section 39(2).

The construction of new urban roads may cause severance, or the separation of residents from local amenities or social networks. Using qualitative data from a natural experimental study, we examined severance related to a new section of urban motorway constructed through largely deprived residential neighbourhoods in Glasgow, Scotland. Semi-structured and photo-elicitation interviews were used to better understand severance and connectivity related to the new motorway, and specifically implications for individual and community-level health and well-being through active travel and social connections. Rather than a clear severance impact attributable to the motorway, a complex system of connection and severance was spoken about by participants, with the motorway being described by turns as a force for both connection and severance. We conclude that new transport infrastructure is complex, embedded, and plausibly causally related to connectedness and health. Our findings suggest the potential for a novel mechanism through which severance is enacted: the disruptive impacts that a new road may have on third places of social connection locally, even when it does not physically sever them. This supports social theories that urge a move away from conceptualising social connectedness in terms of the local neighbourhood only, towards an understanding of how we live and engage dynamically with services and people in a much wider geographical area, and may have implications for local active travel and health through changes in social connectedness.
