Introducción: en la ejecución de políticas públicas de salud sexual, resultan cruciales las estrategias utilizadas en la construcción de la relación agente de salud-usuario. En la literatura son pocos los artículos que exploran las estrategias que utilizan los agentes de salud para interactuar con pobladores rurales al abordar estas problemáticas. Este artículo se propone describir y comprender las estrategias que utilizan los agentes de salud en la atención de la salud sexual y reproductiva de pobladores rurales de bajos ingresos. Para ello, se conceptualiza la relación médico-paciente como una interfaz social, es decir, como un espacio de articulación entre los mundos de sentido de los actores involucrados. Materiales y métodos: se desarrolló un estudio de carácter exploratorio-descriptivo de tipo transversal. Se realizaron 21 entrevistas semiestructuradas a agentes del sistema de salud, y su análisis se hizo desde un enfoque cualitativo. Resultados: los agentes de salud utilizan un amplio repertorio de estrategias para abordar la salud sexual de los pobladores rurales. Se identificaron y caracterizaron dos tipos de estrategias (dialógicas y monológicas), con sus respectivos subtipos. Conclusión: el estudio visibiliza las estrategias dialógicas como modo alternativo de relación médico-paciente, en contraste con estrategias tradicionales, de tipo monológico. Además, contribuye a la formación de los agentes de salud, y en la conformación de los equipos que abordan la salud sexual y reproductiva en contextos rurales.

Empathy is fundamental to the physician-patient relationship and influences the clinical outcomes. The aim of this study was to determine the dental students’ empathy levels and to compare their opinions on attributes of a “good dentist”. This cohort research was included 79 dental students volunteering to participate in the study at a public university. The data were collected by the Dökmen’s Empathic Tendency Scale (ETS) and Empathic Skill Scale (ESS). In this study, from the orientation day to the end of the third-year, the dental students’ ETS mean scores (respectively 69.59 and 68.34) and ESS mean scores (respectively 142.53 and 140.00) showed a decline. At the end of the third-year, starting clinical rotations and taking patient responsibility may lead to decrease the empathy levels of students. The findings of our study show that female students have higher empathy tendency and skill scores compared to male students (p<0.001). In the ranking of the attributes required to be a good dentist, empathy was ranked 4th by the first-year students, while final-years students placed empathy in second rank (p<0.05). According to these results, it is possible to claim that the dentist candidates realized that being empathetic is necessary to be a good dentist. [ABSTRACT FROM AUTHOR]

Objective: to evaluate the use of the internet by patients to access health information and the possible implications for the physician-patient relationship. Method: descriptive, cross-sectional and quantitative study carried out in April and May 2022 in Anápolis, Goiás. A validated questionnaire on internet use was used in the study. The G test was applied to associate internet use with sex and age group, with a significance level of 5% (p<0.05). Results: among the 109 patients, there was a prevalence of females (80.7%), aged 18 to 59 years (83.5%), with complete high school (42.2%). Most spend between two and four hours a day on the Internet (68.0%; p=0.992) and had already searched for health information on the Internet (84.4%; p=0.095), especially about medications (86.2%; p=0.940). Participants of sexes used the internet for a second opinion on the medical diagnosis (men - 52.4%; women - 68.2%; p=0.185), but did not discuss their searches carried out on the internet with the doctors (men - 57, 1%; women - 86.4%; p=0.005). Conclusion: the Internet has been used quite frequently by patients to access health information, but they do not discuss their findings with professionals, which tends to weaken the doctor-patient relationship. Introducción. El consentimiento informado es un elemento importante en la relación médico-paciente, que involucra la trasmisión de un mensaje. En este contexto, se describe la teoría de la comunicación implícita en un consentimiento informado, las barreras para una transmisión adecuada del mensaje, la responsabilidad en la comunicación y los requisitos para el logro de estos propósitos. El objetivo fue analizar de forma reflexiva los procesos de comunicación surtidos y necesarios durante su diligenciamiento, con algunas propuestas factibles de implementar. Discusión. El proceso comunicativo implica evaluar la calidad, el contexto, la intencionalidad, la pedagogía y la recepción-emisión del mensaje. La naturaleza de la actividad quirúrgica requiere el perfeccionamiento de la comunicación como una competencia necesaria en los cirujanos. Se señalan oportunidades de mejoramiento para una adecuada ejecución de esta habilidad no técnica, habitualmente no contemplada en la formación médica. Conclusiones. El consentimiento informado es un acto que trasciende a la transmisión de la información y es el resultado de un proceso complejo, que involucra habilidades comunicativas. Su efectividad se deriva de una toma de decisiones respaldada por el entendimiento claro de la situación y del procedimiento a efectuar. Existen puntos críticos durante su realización que podrían ser objeto de intervenciones futuras, desde esta perspectiva comunicativa.

15. Atención de las personas que viven con VIH en el Sistema de Salud Colombiano: perspectivas de pacientes, cuidadores y personal de salud

FUNDAMENTOS // Las políticas y programas de atención en salud a las personas que viven con VIH han obedecido a las políticas económicas vigentes, basadas en el modelo de desarrollo neoliberal y que configuran el actual sistema de salud. El objetivo de este trabajo fue analizar la influencia del sistema de salud colombiano en la atención de las personas que vivían con VIH afiliadas a las Entidades Administradoras de Planes de Beneficio del Régimen Subsidiado, atendidos en Neiva (Colombia). MÉTODOS // Se realizó un estudio cualitativo, enmarcado en el Análisis Crítico del Discurso. Participaron diecinueve personas entre pacientes con VIH, cuidadores no formales y personal de salud, captados de dos Instituciones Prestadoras de Servicios de Salud de la ciudad de Neiva, a quienes se les aplicó entrevistas en profundidad. Los datos fueron codificados, categorizados y organizados en Excel para su análisis. RESULTADOS // La relación interpersonal y el funcionamiento del sistema de salud fueron dos fenómenos que interfirieron en la atención de las personas con VIH, en cuanto a que favoreció o impuso barreras a las prácticas. Se encontraron fallos en el proceso informativo/educativo desde el momento del diagnóstico, estigma y discriminación, profundizado en las instituciones de salud no especializadas en VIH, así como múltiples barreras de acceso a los servicios de salud. El 55,5% de los pacientes expresó haber sido discriminados por el personal de salud en algún momento desde su diagnóstico. El 100% de pacientes entrevistados identificó barreras de diferente tipo para los servicios de salud, contextualizados en trato indebido, inoportunidad en la atención y abuso del poder; solo el 22,2% recurrió a la interposición de quejas, derechos de petición o tutelas para reclamar su derecho a la salud. CONCLUSIONES // La praxis de atención se realiza al margen de la situación de contexto de los pacientes, olvidando que son precisamente los ubicados en un nivel socioeconómico más bajo

Radiological contrast media play an essential role in radiology departments by facilitating more precise and detailed images. It is important to note that for radiologists the use of these contrast agents implies several legal responsibilities and ethical considerations towards patients. This article will explore the main issues related to responsibility and complication management for radiologists, referring physicians and other related professionals, as well as issues around informed consent, contraindications for their use and the benefit-risk balance assessed when deciding if a contrast-enhanced test should be carried out. In addition, we will address the crucial role of the radiologist in effective communication with patients and in obtaining informed consent. Introducción: La comunicación es una tarea esencial para la práctica médica de calidad, incluye una serie de habilidades aprendidas que colaboran en mejorar la seguridad del paciente. Explorar la competencia en comunicación de los médicos podría mejorar la calidad de atención de la institución. Nuestro objetivo fue evaluar la competencia comunicativa de médicos de planta de un hospital pediátrico y explorar factores de los profesionales potencialmente asociados a la calidad de la misma. Métodos: Estudio analítico, transversal. Se observaron 40 entrevistas médico-paciente durante diciembre 2018 - marzo 2019, en las unidades de internación de un Hospital pediátrico. Se utilizó la lista de verificación adaptada de los elementos esenciales de comunicación de Kalamazoo como herramienta para evaluar la competencia en el proceso de comunicación. Resultado: En el 62,5 % (25/40) de las entrevistas observadas, la competencia comunicativa se evalúo como aceptable (IC95% 47,03-75,78). No se halló relación entre la antigüedad en el cargo ni los años desde la graduación del médico observado y la aceptabilidad de la comunicación. El sexo femenino resultó predictor independiente para comunicación aceptable (OR: 10,3; IC95 % 1,9-53,1; p=0,005). Conclusión: Las habilidades comunicacionales del personal médico observado en el Hospital resultaron aceptables en el 62,5% de los casos. El sexo femenino se mostró como factor independiente para comunicación aceptable. Si bien la competencia comunicativa de los médicos observados en general fue aceptable, es importante llevar a cabo acciones tendientes a optimizar las habilidades comunicacionales ya que ellas no solo mejoran con la experiencia.

Background: medical liability is inserted in the so-called responsibilities of professionals; to determine its framework it is necessary to specify the legal nature of the doctor-patient relationship and the civil responsibility for the damages caused in the exercise of the medical activity. Objectives: to determine the nature of the doctor-patient relationship to specify the criterion of imputation of responsibility and the extent of compensable damages. Methods: a doctrinal review of important Cuban and Spanish jurists, analysis of comparative legislation and jurisprudence and valuation of Cuban legislation was carried out. The search was carried out in original texts with direct link to the subject. Development: the doctor-patient relationship is, whatever its cause, a legal relationship to which the law confers guardianship. Its legal nature is based on the obligation of means that arises among the subjects; in this sense it is important the location of medical responsibility as professional responsibility and the analysis of the damages caused, as well as the dominant imputation criteria. The damages caused by the negligent action of the medical personnel can be of patrimonial or moral nature; both must be repaired and compensated according to current regulations. Conclusions: the predominant imputation criterion in the physician's civil responsibility must be the subjective one, always assessing his expertise and skill in the exercise of his profession; this issue is not much discussed in the curricula of the careers, so this review joins others aimed at developing a legal culture among students and health professionals.

21. Consideraciones bioéticas sobre la relación médico-paciente para el uso del cannabis medicinal en Perú

En noviembre de 2017 se despenalizó en el Perú el uso medicinal del cannabis. Los desafíos que ello plantea son diversos y el presente artículo se centra en los relativos a la relación médico-paciente. Dado el status quo del cannabis medicinal, es necesario que el protocolo de tratamiento médico que el Ministerio de Salud debe elaborar, formule condiciones claras que guíen la decisión de los médicos de prescribir cannabis sin que ello afecte sus obligaciones éticas de promover el bien y de no causar daño a sus pacientes. Este artículo desarrolla tres consideraciones importantes para la prescripción de cannabis medicinal. En primer lugar, recomienda el registro y educación de los médicos que deciden prescribir cannabis medicinal. En segundo lugar, propone criterios generales que indican los casos en los que el uso del cannabis medicinal es apropiado, y finalmente, establece la necesidad de que exista una relación médico-paciente bona-fide para la prescripción del cannabis medicinal.

Objetivo: Conocer los núcleos figurativos relacionados con los tiempos de la consulta médica: el tiempo de espera y la duración de la consulta desde la perspectiva de los profesionales y de los pacientes, a fin de contraponerlos y encontrar nudos críticos que obstaculicen la relación médico-paciente. Métodos: Se abordan las representaciones sociales a partir del modelo de Abric, se trabaja con grupos focales de médicos y pacientes para encontrar el núcleo de la representación y posteriormente se realizan entrevistas semiestructuradas basadas en categorías emergentes del núcleo para finalmente analizar los discursos y contrastarlos. Resultados: El sentido común relacionado al tiempo de espera de la consulta es percibido por los pacientes como muy largo, no así el tiempo de duración de la consulta que al igual que los médicos es percibido como breve e insuficiente. Estos tiempos, más que su cronometría, son la sumatoria de las acciones e interacciones interpersonales y la lectura subyacente en la percepción de los pacientes de un tiempo con exigencias sociales (escuela, trabajo y transporte) y del tiempo tecno burocrático de los médicos (indicadores, productividad y recetas). Conclusión: El tiempo de espera y la duración de la consulta no sólo son indicadores de productividad o eficacia, más bien son espacios subjetivos y objetivos de interacción entre sujetos sociales con necesidades y tareas diferentes, por lo cual es necesario considerar estas lógicas sociales y económicas a fin de humanizar estos actos de lo contrario perpetuaremos una práctica mecanizada-homogeneizante-fugaz e insensible.

Introducción: durante la emergencia sanitaria por la pandemia COVID-19 se promueve el uso de la telemedicina (TM) con el propósito de facilitar la asistencia y cuidar a los profesionales del equipo de salud. El objetivo de este trabajo es analizar diferentes aspectos de la TM y su utilidad en las organizaciones de salud. Metodología: se realiza una revisión narrativa. Se hace una búsqueda en PubMed de los términos “telemedicine and organizations and quality and satisfaction”, en los últimos cinco años, en idioma inglés o español, se seleccionaron los artículos de interés, complementando con bibliografía referenciada y documentos oficiales en páginas web pertenecientes a organismos gubernamentales, académicos e internacionales. Todas las fuentes bibliográficas revisadas se listan en la bibliografía. Resultados y discusión: se define TM como la parte clínica de la telesalud, corresponde a la práctica médica, realizada a distancia, en tiempo real o diferido, por intermedio del uso de las Tecnologías de la Información y la Comunicación en Salud (TIC). Esta nueva tecnología genera nuevas formas de ejercer la medicina, si bien es necesario mantener los principios éticos del acto médico. Existen programas establecidos de teleradiología, teledermatología, telepatología, telepsiquiatría y múltiples proyectos piloto con fines asistenciales y de investigación. Se requiere mayor evidencia sobre los resultados de efectividad, calidad, acceso a los servicios y ahorro de los costos de las intervenciones sobre determinados grupos específicos y condiciones. Conclusiones: la TM puede contribuir a la mejora de los servicios de salud cuando su uso se planifica en función de las necesidades de los usuarios, los recursos y de la organización. Su implementación puede mejorar la accesibilidad a la atención médica en los diferentes niveles de atención con un menor gasto de tiempo y dinero para los pacientes y las organizaciones.

In his Theory of Recognition, Honneth states that it is the interaction between human beings that determines their constitution, being recognition, the fundamental element for said constitution in three spheres: love, law and solidarity. Pellegrino identifies that medicine is a moral enterprise, built on certain beliefs of good and bad, and presents a characterization of the medical act consisting of three elements: the fact of illness, the act of profession and the act of medicine. This article will evaluate the ethical implications of the medical act, within the framework of Honneth’s Theory of Recognition and the tripartite model of the doctor-patient relationship proposed by Pellegrino., En su Teoría del Reconocimiento, Honneth plantea que es la interacción entre los seres humanos la que determina la constitución de estos, siendo el reconocimiento, el elemento fundamental para dicha constitución en tres esferas: el amor, el derecho y la solidaridad. Pellegrino identifica que la medicina es una empresa moral, construida sobre ciertas creencias de lo bueno y lo malo, y presenta una caracterización del acto médico constituida por tres elementos: el hecho de la enfermedad, el acto de profesión y el acto de medicina. En este artículo se evaluará las implicaciones éticas del acto médico, en el marco de la Teoría del Reconocimiento de Honneth y el modelo tripartito de la relación médico paciente propuesta por Pellegrino.

Resumo Este artigo aborda as condutas preconizadas pelos conselhos de medicina do Brasil relacionadas à “alta médica a pedido”. Trata-se de uma pesquisa documental e exploratória, que buscou identificar e analisar diversas manifestações dos conselhos acerca de questionamentos e dúvidas suscitadas pelos médicos quando se deparavam com pedidos de alta médica. Para tanto, utilizou-se o método de análise hipotético-dedutivo. A partir da problemática apresentada (insegurança ético-jurídica dos médicos no deferimento dos pedidos de alta), levantaram-se as soluções propostas às questões atinentes ao tema destinadas aos conselhos de medicina. Elas foram analisadas criticamente à luz do ordenamento ético-jurídico, com vistas a proporcionar ao médico maior segurança e tranquilidade na condução desse procedimento. Abstract This paper examines the procedures recommended by Brazilian medical councils regarding “discharge against medical advice”. An exploratory and documentary research was conducted to identify and analyze several council publications regarding questions and doubts raised by physicians when faced with discharge requests. Solutions proposed to the issue at hand (ethical-legal insecurity of physicians in authorizing discharges) were analyzed based on ethical-legal frameworks, aiming to provide physicians with greater security and tranquility in conducting this procedure. Resumen Este artículo discute la conducta recomendada por los consejos de medicina de Brasil respecto al “alta médica por solicitud”. Se trata de una investigación documental y exploratoria, que pretendió identificar y analizar diversas manifestaciones de los consejos sobre los interrogantes y dudas planteadas por los médicos ante las solicitudes de alta médica. Para ello, se utilizó el método de análisis hipotético-deductivo. Con base en el problema presentado (inseguridad ético-jurídica de los médicos en la concesión de solicitudes de alta), se plantearon propuestas de solución a cuestiones relacionadas con el tema dirigidas a los consejos de medicina. Se utilizó la perspectiva ética-jurídica, con el objetivo de brindar mayor seguridad y tranquilidad al médico en la realización de este procedimiento.

Introduction: The informed consent (IC) ensures respect of the patient's rights to information, freedom, and autonomy. However, when the physician neglects the obligation to inform, legal consequences may follow, including the award of damages or even imprisonment. Objective: To analyze the legal implications for a medical practitioner who fails to obtain the patient's IC. Methodology: Based on the relevant jurisprudence and legal decisions. With regards to the former, the decisions and legal precedents of the Colombian High Courts with regards to IC and medical practice were studied, emphasizing the rulings of the State Council and the Supreme Court of Justice (civil and penal chambers). With regards to the legal decisions, the analysis enabled the review, systematization and interpretation of the discussions generated around the topic of interest, pursuant to the doctrine or research on civil administrative, and criminal law. Results: There is consensus in the Colombian jurisprudence about the liability of the healthcare professional and of the state when the IC or any of its component parts is missing in the doctor-patient relationship. Nevertheless, there are different standpoints, particularly in the criminal arena, where a lack of unanimity exists with regards to this issue. Conclusion: Any violation of the IC or the lack of an IC, could give rise to the practitioner's civil liability and disciplinary actions, in addition to the administrative liability of the State, but there should be no criminal liability for the physician. In November 2017, medical use of cannabis was decriminalized in Peru. The challenges are diverse and this article focuses on those challenges related to the doctor-patient relationship. Given the status quo of medicinal cannabis, the medical treatment protocol to be developed by the Ministry of Health must formulate clear conditions to guide the physicians' decision to prescribe cannabis without affecting their ethical obligations to promote good and cause no harm to their patients. This article develops three important considerations for prescribing medicinal cannabis. First, it recommends the registration and education of physicians who decide to prescribe medicinal cannabis. Secondly, it proposes general criteria specifying the cases in which the use of medicinal cannabis is appropriate and, finally, it establishes the need for a bona-fide doctor-patient relationship for the prescription of medicinal cannabis. Objectives.To calculate the frequency and factors associated with external workplace violence (EWV) against doctors in health inpatient services in the metropolitan area of Lima (Spanish: Lima Metropolitana), Peru. Materials and methods. A cross-sectional analytic study, which included doctors from the Ministry of Health (MINSA), Social Security (EsSalud), and the private subsector, was carried out. The frequency of EWV was measured throughout the entire professional practice during the previous 12 months and during the last month. Variables related to the doctor, assailant, and health service were measured. Raw and adjusted prevalence ratios (PR) were calculated by means of a Poisson-family generalized linear model with non-parametric bootstrapping. Results. A total of 406 doctors participated; 31.5% were victims of EWV at least once during their professional practice, with 19.9% over the past 12 months and 7.6% during the last month. The chances of being threatened in the last 12 months increased if the doctor was male (adjusted PR [aPR]: 1.7; 95% confidence interval [CI] = 1.1- 2.8), had graduated from a Peruvian university outside of the metropolitan area of Lima (aPR: 1.5; 95% CI = 1.1-2.4), worked at MINSA (aPR: 7.9; 95% CI = 2.24-50.73) or EsSalud (RR: 8.68; 95% CI = 2.26-56.17), and worked in the emergency (aPR: 1.9; 95% CI = 1.2-3.6) or operating room (aPR: 1.6; 95% CI = 1.1-2.3). Age, years of professional practice, or being a medical resident were not associated with EWV. Conclusion. In the hospitals studied, a large number of doctors have been victims of EWV. Working in public services increases the possibility of violence. Implementation of support, identification, and primary prevention strategies in hospitals is recommended.

Reconocer el proceso formativo y transformador de la práctica pediátrica de docentes del Área de Niñez de la Facultad de Medicina de la Universidad de Antioquia. Materiales y método. Estudio con enfoque desde el interaccionismo simbólico en el que participaron 19 docentes, a quienes se les hizo entrevista semiestructurada. El análisis de los datos se hizo bajo los lineamientos de la teoría fundamentada. Resultados. Emergieron tres categorías: 1) cómo llegaron a ser médicos y pediatras, se resalta a los profesores como modelos; 2) lo que transforma su práctica: el tiempo, la experiencia profesional, las instituciones y los grupos de trabajo, y 3) los recursos de los docentes en las interacciones con el niño y su familia: la pregunta, la observación, la explicación, el juego y la educación para la salud. Conclusiones. La reflexión de la práctica de los docentes ha cambiado la interacción en el acto médico. La universidad debe promover la discusión sobre el modelo de interacción que sus profesores ofrecen a los estudiantes.

Resumo Este artigo discute a aplicação de teorias da argumentação e da comunicação ao campo da medicina. Com base em revisão bibliográfica procedeu-se à comparação de três enfoques selecionados pela pertença a uma concepção pragmática da linguagem: o modelo de Toulmin, a pragma-dialética, e o de Fisher e Todd, derivado da sociolinguística americana. Os principais resultados foram: a pragma-dialética caracteriza o raciocínio médico de maneira mais integral, incorporando elementos das três disciplinas da argumentação: a dialética, a retórica e a lógica; o modelo de Toulmin ajuda a fundamentar argumentativamente a declaração de hipóteses diagnósticas e terapêuticas e, como parte de uma medicina interpretativa, aproxima-se da pragma-dialética por incluir elementos dialéticos no processo de formulação de argumentos; o enfoque de Fisher e Todd permite caracterizar, por uma análise pragmática dos atos de fala, o grau de simetria/assimetria da relação médico- paciente e sustenta a possibilidade de negociação das alternativas terapêuticas.

Heart failure leads to the activation of a neurohormonal response that interacts with the hemodynamic changes, which are joined by functional and structural myocardial abnormalities, that may exist. This paper addresses the role of the renin-angiotensin system in the pathophysiology of heart failure and the use of non-invasive complementary methods that provide additional information necessary for the assessment and comprehensive management of patients, without losing the essential connection between the doctor and the patient.

Objective: To develop and validate a previously constructed instrument to assess communication and humanization with patients' relatives and family physician relationships, during the medical report, in the context of the Intensive Care Unit. Methodology: This is methodological research, with a quantitative and qualitative approach, carried out in 2020 and 2021. After the instrument was developed, the Delphi Technique was used to validate the content with the participation of eight experts. Data collection took place through interviews and questionnaires. In the data analysis, the Content Validity Index was calculated with a minimum agreement rate of 0.70. Results: The items that composed the instrument in relation to the issuer were: aspect of the professional, compliance and identification of the family, behavior of the doctor according to the reactions of the family members due to the great emotional burden, optimization of the consultation time, the doctor's behavior during the consultation; to the receiver were: in case of patients incapable of decision, before the family; to the message were: information directed to the legal representative, regarding the information passed, control over the posture; to the environment were: characteristics of the environment, confidentiality and privacy during the conversation. Conclusion: All items had a CVI greater than 0.70. The instrument is able to assess what it proposes and how promising its application is in communication actions and doctor-patient relationships. Objetivo: Desarrollar y validar un instrumento previamente construido para evaluar la comunicación y humanización con los familiares de los pacientes y las relaciones médico de familia, durante el informe médico, en el contexto de la Unidad de Cuidados Intensivos. Metodología: Se trata de una investigación metodológica, con enfoque cuantitativo y cualitativo, realizada en los años 2020 y 2021. Luego de desarrollado el instrumento, se utilizó la Técnica Delphi para la validación de contenido con la participación de ocho expertos. La recolección de datos se llevó a cabo a través de entrevistas y cuestionarios. En el análisis de datos se calculó el Índice de Validez de Contenido con una tasa mínima de concordancia de 0,70. Resultados: Los ítems que compusieron el instrumento en relación al emisor fueron: aspecto del profesional, cumplimiento e identificación de la familia, comportamiento del médico de acuerdo a las reacciones de los familiares ante la gran carga emocional, optimización de la consulta tiempo, el comportamiento del médico durante la consulta; al síndico eran: en caso de pacientes incapaces de decisión, ante la familia; al mensaje fueron: información dirigida al representante legal, respecto a la información pasada, control sobre la postura; al ambiente fueron: características del ambiente, confidencialidad y privacidad durante la conversación. Conclusión: Todos los ítems tuvieron un CVI superior a 0,70. El instrumento es capaz de evaluar lo que propone y cuán prometedora es su aplicación en acciones de comunicación y relaciones médico-paciente. Objetivo: Elaborar e validar um instrumento previamente construído para avaliação da comunicação e humanização frente a familiares de pacientes e relação médico familiar, durante o boletim médico, no contexto da Unidade de Terapia Intensiva. Metodologia: Trata-se de pesquisa metodológica, com abordagem quantitativa e qualitativa, realizada em 2020 e 2021. Após o desenvolvimento do instrumento, para a validação do conteúdo empregou-se a Técnica Delphi com participação de oito especialistas. A coleta de dados se deu por meio de entrevista e aplicação de questionário. Na análise dos dados foi calculado o Índice de Validade de Conteúdo com taxa de concordância mínima de 0,70. Resultados: Os itens que compuseram o instrumento em relação ao emissor foram: aspecto do profissional, cumprimento e identificação da família, comportamento do médico de acordo com às reações dos familiares devido à grande carga emocional, otimização do tempo da consulta, o comportamento do médico durante a consulta; ao receptor foram: em caso de pacientes incapazes de decisão, perante a família; à mensagem foram: informações direcionadas ao representante legal, quanto às informações passadas, controle sobre a postura; ao ambiente foram: características do ambiente, confidencialidade e privacidade durante a conversa. Conclusão: Todos os itens obtiveram IVC maior que 0,70. O instrumento é capaz de avaliar o que propõe e o quão promissor é a sua aplicação nas ações de comunicação e relacionamento médico-paciente.

Resumo Este estudo tem como finalidade refletir sobre os aspectos bioéticos e jurídicos implicados na relação médico-paciente testemunha de Jeová. Para isso, o trabalho abordará, inicialmente, a relação médico-paciente diante dos impasses terapêuticos desse grupo de pacientes, estudando essa relação do ponto de vista histórico e elucidando os pontos acerca dos pacientes adeptos à religião. Em seguida, abordar-se-ão os princípios bioéticos envolvidos no cuidado do paciente testemunha de Jeová, discutindo cada princípio e sua incorporação ao atendimento desse grupo. Por fim, será discutida a abordagem jurídica à luz dos direitos fundamentais do paciente, caracterizando as normas constitucionais e penais que se aplicam ao cuidado dos profissionais de saúde a pacientes adeptos a essa religião. Abstract This study aims to reflect on the bioethical and juridical aspects tied to the doctor-Jehovah’s Witness patient relationship. To that end, the work will focus, initially, on the doctor-patient relationship faced with the therapeutic obstacles of this group of patients, studying the relationship from the historical standpoint and elucidating the topics about the patients of this religion. Then, we will focus on the bioethical principles involved in the care for Jehovah’s Witness patients, discussing each principle and its incorporation to the care for this group. Finally, we will focus on the juridical approach in the light of the patient’s fundamental rights, characterizing the constitutional and criminal norms that apply to the care of health professionals to patients of this religion. Resumen Este estudio tiene como objetivo reflexionar sobre los aspectos bioéticos y legales involucrados en la relación médico-paciente de los testigos de Jehová. Para ello, se abordará inicialmente la relación médico-paciente ante los impasses terapéuticos de este grupo de pacientes desde la perspectiva histórica teniendo en cuenta a los pacientes practicantes de esta religión. Luego, se plantearán los principios bioéticos involucrados en el cuidado del paciente testigo de Jehová, discutiendo cada principio y su incorporación en la asistencia a este grupo. Por último, se discutirá el enfoque jurídico a la luz de los derechos fundamentales del paciente, caracterizando las normas constitucionales y penales que se aplican a la asistencia de los profesionales de la salud a los pacientes practicantes de esta religión.
