- Abstract
"An" is one of the letters of Jar, which is generally interpreted, "mojawazah" by syntacticians; But they do not mention the exact meaning of "mojawazah" and only explain "mojawazah" through some examples. Also, they mention many other meanings for "an" that have no relation between them. This paper has tried to find a single meaning for "an" in a descriptive-analytical method based on the theory of the principle of meaning and reasoning and citing the use of "an" in the verses of the Qur'an so that all uses of "an" in the Qur'an and general non-common uses. This is an attempt to analyze it in Arabic accurately and acceptably based on this main meaning. From this article, it was obtained: The meaning of "an" in the Qur'an is the same meaning everywhere that syntacticians interpret it as "mojawazah". "Mojawazah" means the permanence of the dimension and the preservation of distance, and a kind of ambiguity must be taken into account; therefore, in principle, one should not understand the meaning of beginning from "an" and the use of "Men" instead of "An" is not correct. What sometimes makes "An" resemble "Men" is the meaning of mediation, which is the result of the dimension and ambiguity used by "mojawazah". Also, none of the expressive meanings of syntacticians and commentators were used to use "an" instead of other letters, and the analysis of "an" in all these examples with a synonymous meaning was easier and more accurate. 5. The End of Originalism? Comparing-Cultures and Text Exegesis.

- Abstract
When it comes to interpreting the Constitution of the United States, constitutional scholars have long ignored the fact that the United States were a multilingual society at their inception. This essay will examine the multi-lingual situation of the eighteenth century United States (with a special focus on the German and Dutch minorities) and its relevance for the interpretation of the Constitution today, addressing theories as original intent originalism, original common meaning originalism and "living constitution." Using a translation-based approach, it will suggest that a current paradigm in constitutional interpretation, New Originalism, is based on the dangerous illusion that the text of the Constitution had a single, discernible meaning for the Founding-Era's general public, a public that was in fact heterogenous not only in terms of culture and race, but also of language, rendering any historical plain meaning approach a precarious proceeding. The question is raised about the correlation of mythological ideas with scientific information and the corresponding object of reality. It is noted that, the cognitive potential of myths continues to remain inaccessible to the perception of a modern person due to his metaphorical language. The novelty of the research is seen in an attempt to verify the semantics of the mythological image of Yuryung Aiyy Toyon in natural science discourse. The research involves a general scientific synergetic approach, lexical-semantic, contrastive-comparative, structural-semantic types of analysis, the method of mutual interpretation. In addition, special methods of depersonification, demetaphorization, and dehyperbolization of the mythological image were applied. Particular attention is paid to isolating the initial meaning of the lexeme үрүҥ — the component that generates the semantic space of the name Yuryung Aiyy Toyon. As a result of a comparative analysis, the essential content of the mythological image of a single origin and the supreme creator Yuryung Aiyy Toyon is revealed in a new light, as a basic concept of the existence of the universe from the point of view of modern science — light, the spread of which is a key factor in determining the fundamental categories of the flow of time and the length of space.

8. Originalism and the Second Amendment: A reassessment.
- Author

Smith, Craig R.
- Abstract
This article argues that the precept of original meaning is a valid hermeneutic method employed by both the majority and minority in the Supreme Court's ruling in District of Columbia v. Heller, a landmark decision that diminishes the precedents preceding it. After tracing the evolution of the precept of original meaning back to James Madison, who wrote the Second Amendment, this article demonstrates that the precept is widely used as an interpretive method by constitutional scholars and conservative and liberal members of the Supreme Court. Furthermore, embracing original meaning as a hermeneutic method requires the careful consideration of historic context to achieve a proper reading of the text at hand. This article examines the majority opinion and the two dissents in Heller to show how each of these justices used the historic context of the Second Amendment to construct its original meaning. The article then re-examines the context of the Second Amendment to determine its most relevant historiography as a basis for assessing the Supreme Court's reading of the amendment. It concludes that the most sensible reading of the amendment would return to the unanimous Miller precedent of 1939 and allow the banning of certain weapons by states and localities. 9. When Originalism Failed: Lessons from Tort Law

- Abstract
Two recent Supreme Court decisions upended American life. Opinions released on consecutive days in June 2022 overturned the right of reproductive choice nationwide and invalidated a statute regulating the carrying of concealed weapons in New York. The opinions were united by a common methodology. Pursuant to what one scholar terms “thick” originalism, history, as told by the majority, dictated the resolution of constitutional disputes. This Article explores the use of thick originalism in several celebrated torts cases that raised constitutional issues. These cases illustrate two significant kinds of problems associated with a rigid historical approach to constitutional interpretation. The first is practical: the historical meaning and intended application of constitutional provisions often are elusive. In some instances, courts simply commit outright errors in constructing the historical narratives on which the decisions rest. In other cases, the use of thick originalism requires judges to exercise wide discretion to determine where to begin a historical inquiry and which sources to consult. This wide discretion, and the related problem of judicial bias associated with highly discretionary interpretive practices, are the very problems originalism is said to solve. The use of thick originalism may create the appearance of objectivity, but in fact considerable subjectivity of judgment is simply buried in the construction of the histories governing the out-come in these cases. The second problem associated with the use of thick originalism is normative. The use of a rigid form of originalism to define the contours of constitutional rights interrupts the ordinary operation of the common law and imposes on today’s society the values of the dominant white, male, and propertied power structure existing at the time of the adoptions of the Constitution and the Fourteenth Amendment. Society today is different than in the largely agrarian communities that composed the United

The author set himself a goal of finding common elements of American concepts for the interpretation of the constitution and Polish descriptive-normative theories of legal interpretation of universal nature. First, he discussed the main assumptions of intentionalism, originalism and the living constitution theory. He did it on the basis of the publications of the most influential representatives of particular fields of study in the American jurisprudence, as well as giving examples of the case law of the Supreme Court of the United States. Then, he outlined the foundations of the clarification and derivative theory, comparing some assumptions with elements of American theories. As a result, despite the vast differences between the Polish and American legal systems, he identified some similarities between the derivative theory and the concept of living constitution.

- Abstract
Both law and religion (at least in the so-called religions of the Book) are often defined by their handling of texts, to which a certain authority is attributed. This similarity is the starting point of the author's exploration, which attempts to provide a perspective for answering the question of how law and religious science can learn from each other (and in particular the first from the second) on a methodological level. Compared to the field of Law and Literature, the interaction between law and religion appears to be in-depth, but limited to a number of areas. A broader interaction is therefore certainly possible, and probably also desirable. The analysis is made based on nine examples. First of all, the author examines what it means to attribute authority to a text rather than to one or more persons. In this context there appears to be an important difference between authoritative texts of a religious or legal nature. The latter are at least in principle open to amendment, which is generally not the case for the former. This has consequences for how they are dealt with and how they are interpreted. The authoritative texts have a special and probably unique position, but this does not alter the fact that they function within a broader framework. Recent evolutions in law have put pressure on the uniqueness of texts, making a more nuanced approach inevitable. The canonisation concept can be a useful tool in this respect. The question then arises as to the authorship of the authoritative texts. Neither in the religious nor in the legal context is the answer to this question self-evident. However, the question is relevant because it gives an indication of the way in which the texts were written, especially if the author's intentions are given a special status in the interpretation of the text. Nevertheless, this concept is more problematic than is usually recognised when interpreting legal texts. If one ignores the conflicting and often polemical context in which texts have been drafted, this is even more the case. Here, too, experiences with the interpretation of Bible texts can provide relevant examples for lawyers. Texts, however, do not only have authors, but also readers, who are a necessary condition for interpretation. Authoritative texts generally have temporal ambitions that transcend the contemporaries of the "authors". This temporal dimension also has consequences for the interpretation of texts, especially when a text is in fact a patchwork of sections of text, which are not necessarily written at the same time and in the same context. A possible objection to an excessive interaction between legal and religious thinking could be to emphasise the other goals of both genres of text. This remark is pertinent, but should not be exaggerated either. Just as religious texts pursue not only orthodoxy but also orthopraxy, the traditional view that legal texts only aim to regulate behaviour, and not opinions or views, is probably too sharply formulated. The tension between conviction and practice occurs in both areas, although not necessarily in the same form. Finally, we will briefly discuss the possibility of distinguishing rhetorical and literary forms and techniques in legal texts. This leads to the conclusion that lawyers have a lot to gain from having their dealings with the authoritative texts of their science enriched by taking note of the methodological discussions that have taken place within the framework of biblical science. This need not to affect the autonomy of legal science neither does it replace the familiar hermeneutical insights, but it makes it possible to detect blind spots in one's own handling of texts and to explore new traces of interpretation. There is a suffi cient number of research works devoted to the study of lexical- grammatical features of emotional lexeme fear in linguistics. But today the question of the functioning and transposition of this lexeme has not been fully studied in the modern Ukrainian language. The aim of the article is to analyze the functioning and transposition of emotional lexeme fear in the modern Ukrainian language, to reveal its semantics as a linguistic and cultural concept, and to determine the peculiarities of language expression. In the article, by means of the analysis of the defi nitions of fear in the Academic Dictionary of the Ukrainian Language, the Etymological Dictionary, and Dictionary of Synonyms, a description of the conceptual features of this lexeme is given, grammatical features are determined, and its transposition phenomena are analyzed in the system of the Ukrainian language. Lexical and grammatical features of the lexeme fea r are the same as in other abstract nouns, but similar use of the word, typical for nouns, is not limited by its functioning. Lexeme fear can be used as an adverb: 1) in the meaning of terrible; 2) in the meaning of expressing admiration, surprise, etc.; 3) in the meaning of extraordinary, very much. Regarding to the large number of someone, something, somebody or something very big, strong fear refers to exclamation The lexeme fear has a wide distributional opportunities: the noun fear + noun (where the main word is a lexeme fear , but this it can also be a dependent word); noun fea r + adjective that points to the emotional state, feelings, emotions of the person; verb + fear , where the noun fear acts as the object of action or state (a part of such word combinations is stable in its composition and structure, lexically indivisible and integral in terms of the meaning of the word combination, which have the function of separate lexeme, so they function as idioms in the modern Ukrainian language); possessive pronoun + noun fea r. The grammatical transformation of the analyzed word has affected not only at the loss of its original meaning, but also its compatibility with other words. Prospects of the research are the study of verbal representation of the emotional state of fear in a separate fi ction text.

The formation and development of Chinese characters have a long history; therefore, their pattern, phonology and meaning may change more or less. In this study, the primitive pattern and views on the coinage of "雷" were studied. It was found that "雷" developed from a pictographic character to a self-explanatory character, and the part of "田" was a drum glyph. Besides, some pronunciation of the character was missed in dictionaries. Furthermore, the meanings of adjectives and verbs were derived besides its original meaning. [ABSTRACT FROM AUTHOR]

The view (most prominently advocated by Justice Scalia) that original meaning entails the constitutionality of original practices has strong intuitive appeal. Indeed, as indicated above, it is a position that has been broadly, if implicitly, assumed by originalists and nonoriginalists alike. But the position is mistaken. We will suggest that a failure to distinguish between two different notions of meaning accounts for the position's wide currency. According to the first notion, the meaning of a term is roughly what a dictionary definition attempts to convey--the semantic or linguistic understanding necessary to use the term, as opposed to nonlinguistic facts about the objects or activities to which the term applies. In contrast, according to the second, looser notion, the meaning of a term incorporates the objects or activities to which the term is applied. The first notion lies behind originalism's theoretical force; it is untenable that the meaning of the Constitution in the first sense could evolve. In sharp contrast, it is not only tenable but inevitable that changes occur over time in the class of things to which a constitutional provision is applied. The assumption that originalism entails the validity of original practices derives its plausibility from a failure to distinguish between the two notions of meaning. Once recognized, the distinction undermines the seemingly natural move from the necessity of interpreting the Constitution in accordance with how it was originally understood to the necessity of upholding practices originally understood to be constitutional. By taking the distinction on board and rejecting the assumption, originalism can readily deflect the challenges based on unacceptable original practices; as a consequence, however, it will not be tenable for originalism, in any case challenging an original practice, simply to rule out the possibility of the practice's invalidity.

What is the estrangement of architecture? The concept has been incessantly mentioned by academics while there seems to be a lack of discussion systematically sorting out the significance, influence, and origins of estrangement as an architectural concept. This work aims to discern the meaning of estrangement from the beginning and its process of entering the field of architecture. The first part is expected to answer the following questions: what is estrangement's original meaning in the field of literature and its variantions? The second part determines what estrangement is in architecture and in what form estrangement is represented according to these arguments. The third part points out the difference during this translation from literature to architecture and demonstrates the reasonable inference that may actually compose the possible way of applying the estranging technique in architecture.

This paper examines the astonishing parallels in the depictions of childhood experience in the works of Polish writer Bruno Schulz and German philosopher Theodor W. Adorno, which so far have not received any attention in research. For both authors, the experience of the child−be it autobiographically remembered as in Adorno, or fantastically transformed as in Schulz−bears the characteristics of transcendental experience manifest in everyday life. As similar as the childhood images and scenes in Schulz and Adorno might be, their significance points in two different directions. While for Schulz, the experience of the child leads back to an original meaning of things and thus to myth, for Adorno, it points to the conditions of a new order and thus to utopia.

The aim of our work is twofold: the exploration of corpora combined with the search for an innovative modality for refining intercultural competence. For this purpose, we use the brand name Kärcher, which for many years has largely departed from its original meaning as a high-pressure water cleaner by acquiring semantic weight and discursive versatility through discourse, as it blends with other semantic-syntactic combinatorics for the linguistic needs of speakers. In a first step, we will demonstrate that the name Kärcher, which by antonomasia was associated with "scum" at its origins, evolves in discourses and affects other spheres. Namely, native French-speaking writers or not, appropriate the Brand Name Kärcher and transform it as they please by applying it to the most distant domains compared to that of cleanliness in the literal and figurative sense of the term. Finally, interculturality as a "dynamic between" escapes the seemingly fixed side of culture and manifests itself as a dynamic between different domains.

Metaphor in the Qur'an is a form of beauty in the language of the holy book which is one part of literary construction. In addition, it also influences the interpretation. In parrot science it is called majaz. The style of language that puts the meaning of the branch on the original meaning, such as the majaz mursal in the letter Asy-Syu'ara which is meticulously written. The reason for the author to research and study it is, first, the style of majaz influences, expands the meaning of the wording in the Qur'an and understands the meaning desired by Allah Swt. Second, it has implications for translation and interpretation. Third, in the Surah Ash-Syu'ara, Allah Swt uses majaz in the verse of the doom of the previous prophets. Fourth, the verses are interesting both in sentence composition and rhetorically (balāghiyyah). This study uses a descriptive-analytical method of majaz mursal in surah Asy-Syu'ara, using a linguistic approach, especially balagah, by analyzing the verses in the letter, detailing the types of majaz mursal and its 'alāqah, explaining the interpretation and message. From this research, it can be seen, first, in the letter Asy-Syu'ara, there are two majaz mursal in two verses, namely in QS. Ash-Syu'ara: 105 with 'alāqah kulliyah and in QS. Ash-Syu'ara: 208 with 'alāqah mahalliyyah. Second, the two verses depart with different contexts, as well as different themes. In verse 105, regarding Noah's people who denied Noah and the teachings of monotheism. Meanwhile, verse 208 deals with polytheists who reject the Qur'an and ask Allah SWT to hasten the punishment. In addition, the language of majaz is also used in conveying stories as ibrah or lessons. For example in the story of Noah.

Seeking to construct the implied readers of Keener’s volume, the author focuses upon Keener’s rather vague discussion of the role of the Spirit, his view of original meaning as the key to hermeneutics, the book’s rhetorically charged tone, and a certain imprecision that occurs throughout. The second part of this essay concludes with the identification of several areas in which the work missed opportunities for significant engagement within this area of hermeneutics, including the absence of original Pentecostal source materials, the absence of intentional engagement with the origins and development of contemporary Pentecostal hermeneutics, and the absence of specific examination of several NT texts that reveal much about concrete ways in which the Spirit functions in interpretation. This article investigates the various senses and derivations of the term nuna in the Inuit-Yupik languages in order to reveal its origin in referring to the Arctic tundra. These languages arguably derive from that of the ancestors of the earliest inhabitants of the North American tundra, other inhabitants of the circumpolar Arctic today having only moved up at later times. Likely etymological correspondences in Eurasian languages of the far north support the original meaning of the word, whose connotations can be contrasted with those of English land, by which it is usually translated. They include reference to the unique vegetation of the Arctic tundra and to settlement and migratory movements across it in the past. The word has survived through millennia as far apart as mountainous East Greenland and the Aleutian Islands chain, where it has been adapted (as Unangan tanaX) to the archipelagic setting.

46. Metaphors of the Law: from 'the Light' to 'the Flame'
- Subjects
Original meaning ,Metaphor ,Phenomenon ,Jurisprudence ,media_common.quotation_subject ,Analogy ,Legal fiction ,Legal history ,Sociology ,Meaning (existential) ,Epistemology ,media_common - Abstract
The paper highlights the main stages of the formation of such a philological and legal phenomenon as a metaphor. From ancient times to the present time, the "metaphorical imperative" has determined the most important aspects of the emerging legal reality. The transfer of meanings in jurisprudence took the form of analogy and the objective influence of symbolization and virtual legal structures.Metaphors were also considered as factors of the formation of legal theories acting as some kind of "preforms". Metaphors did not perceive existing similarities, but they themselves created them. This was their significance as "demiurg tools". Therefore, metaphorical expression produced effects rather than meanings, but meanings leading to change. The birth of a new legal meaning was largely spontaneous and unpredictable: it is known that law enforcement sometimes differs from the original intention of the lawmaker and legislator. For the precise establishment of the content of the law, legal knowledge of its original meaning is also necessary. The hermeneutic problem is to bridge the gap between the law and the incident. A change in the social or political situation should not determine the current law to obsolescence: the inherent irrational elasticity of a legal idea provides a field of action. There are also "resonating" metaphors that induce a large number of implications, stimulating new interpretations that reveal hidden implications. Thus, a certain loss of meaning inevitably takes place. The paper clarifies: in the history of law, the metaphor has gone from mythological and traditional ideas to modern legal fiction and "simulacrum".

This article discusses the meaning of jihad in QS. Al-'Ankabut: 6-7 and its relevance in preventing the covid-19 virus. This type of research is literature, using qualitative descriptive-analytical methods with the Ma'nÄ Cum MagzhÄ approach, namely by describing the meaning of jihad in the 7th century (linguistic analysis), looking at asbabun nuzul (historical analysis), the relationship of verses with other verses/munasabah verse (intratextual analysis), the relationship of the verse with the text outside the Qur'an (intertextual analysis), the meaning of the verse (maghza dates), and contextualization of the verse with the present era (maghza al-mutkharik al-mu'ashir). This study will focus on three aspects of the discussion, firstly related to the original meaning of jihad which was seen in the 7th century, namely when the Qur'an was revealed, Second, discussing the original meaning of jihad contained in QS. Al-'Ankabut: 6-7. The third explains the relevance of the meaning of jihad to current contemporary issues, namely COVID-19. The results of this study indicate that the first jihad is the ability to be serious in the face of difficulties or trials in fighting enemies, demons, and against oneself, namely fighting lust with the sole purpose of seeking the pleasure of Allah SWT. The second jihad in QS. Al-'Ankabut verses 6-7 are jihad to do good, do good deeds, and preach to invite mankind to convert to Islam, and be patient in facing trials. The third relevance of the meaning of jihad to the current contemporary issue, namely covid-19, can be seen when someone tries to fight jihad against COVID-19, namely by complying with government regulations such as self-isolation, PSBB, physical distancing, and implementing a healthy lifestyle. In addition, it also strives in terms of spirituality by doing good deeds such as practicing special prayers to avoid the plague and getting closer to Allah SWT.

Linguistics ,Discourse marker ,Sentence - Abstract
The extension particles are not considered as discourse markers by all researchers mainly considering the grammatical function the connectors which they are based on can present. However, as for discourse markers which “desemantisation” has been revoked, other researchers argue that extension particles maintain part of their original meaning while endorsing an intersubjective value. I try to study this question in this article for the Mauritian Creole extension particle sipa ki which is formed on the connector sipa. A fine-grained conversational and pragmatics analysis of 6 hours of ordinary conversations, collected in 2014 shows how sipa ki plays a part in conversational relation co-construction. While helping the enunciator to construct their own discourse and showing their attitude towards it, sipa ki provides information on the way the sentence has to be interpreted by soliciting (assumed) shared experience by interlocutors for message reconstruction. I argue that speech effects provided by extension particle sipa ki partly rely on the meaning of connector sipa on which it is constructed and which also holds an intersubjective value.

Aesthetics is a subject focusing on studying the nature and significance of beauty (including beauty in language, art, literature, etc.). Moreover, the development of aesthetics, within the broader context of literary systems, is of significant importance. Chinese Literature (which in essence differs from that of English Literature) expresses beauty using its unique ways, especially with the employment of fuzzy language (also known as “vague language”). By including a certain degree of “fuzziness”, Chinese Literature grants readers room fir imagination. However, the process of translating Chinese fuzzy language into other languages is not an easy feat to accomplish. Such translations can, to a large extent, seriously affect the original meaning of the text. To explore proper ways of “fuzzy language” translation, this paper ventures to analyze the processing methods used in the translated work “Dr. Zha’s Diary of Fighting the COVID-19”. Categorizing vague language into three perspectives, namely, semantic vagueness, cultural vagueness and rhetorical vagueness, the paper analyzes the way to tackle fuzzy language with 16 detailed cases. Based on the case analyses, the paper proposes that the proper translation of fuzzy language in literature will be more conducive for readers to appreciate the works and helps to improve the translation quality. By exploring the ways of processing fuzzy language, this paper hopes to bring some suggestions and inspiration to other researchers.
