Qur'anic verses that were abrogated in view of their recitations are classified as "Types of Abrogation in the Qur'an” in some of the well-known Ulum al-Qur'an resources, paving the way for arisin some questions. Is it possible to call such kind of verses, which are abrogated in recitation, as the "Qur'an" considering that they literally lack authentic transmission? Is this classification, connotating their availability in the Qur'an despite the reality proving the contrast, a required one? Or, is the Qur'an of the utterance "types of abrogation in the Qur'an" not the Qur'an as a corpus? The questions herein are evoked by the classification in question, and needed to be replied in detail as previous works are not satisfying in quantity. This article is expected to contribute to related literature. In this article, the prologue part presents brief information on the terms Qur'an and abrogation, then "types of abrogation in the Qur'an" chapters in ulum al-Qur'an works are aligned. and the data concerning the content of chapters are analyzed in a critical manner. Finally, the paper is concluded with an overall evaluation of the data. It is concluded that the content under title "types of abrogation in the Qur'an" is not compatible with each other. The provisions entailing the authentic transmission of the Qur'an invalidates and excludes such kind of classifications, and the word "Qur'an "within the titles in relation denotes the overall revelations as of the beginning until the death of Prophet, namely not the corpus. Moreover, this article suggests a more proper denomination instead of "types of abrogation in the Qur'an" as it is eligible for getting misunderstood. Şer'î Hükümlerde Neshin Sebepleri başlıklı bu çalışma, gayeci metodla neshin maksatlarını tespit etmek amacıyla yapılmıştır. Çalışmada öncelikle nesh konusunu bilmenin önemi ve neshin hikmetleri hakkında kısa bir giriş yapılmış, daha sonra neshin sebeplerinin neler olduğu üzerinde durulmuştur. Daha önceki bazı araştırmalarda tespit edildiği üzere neshin sebeplerini dört maddeye indirgemek mümkündür. Bunlar, hükümleri kolaylaştırmak, hükümleri tedrici olarak ağırlaştırmak, hükümleri değişen ictimai duruma uygun hale getirmek ve son olarak mefsedete engel olup maslahatı celbetmektir. Neshin sebepleri ele alınırken birçok örnek verilerek tümevarım yöntemi kullanılmıştır. Hangi tür hükümlerin neshe konu olup olamayacağı meselesi makasıdla ilgili tartışmaları doğrudan ilgilendirmektedir. Zira Hanefi usulcüler arasındaki genel yaklaşıma göre başta tevhidle ilgili esaslar olmak üzere din, can, nesil, mal ve akıldan ibaret beş zaruri esasın korunmasıyla ilgili külli kaideler neshe konu değildir. Beş zaruri esasın korunduğu bazı şer'î hükümlerde meydana gelen nesih örneklerinde, belirtilen esasları koruma gayesinin devam ettiği görülebilmektedir. [ABSTRACT FROM AUTHOR]

In this article, Abū Bakr Ibn al-’Arabī's understanding of abrogation (naskh) and the reflections of this are discussed. Although it is not possible to reach a final point on the subject of naskh which has been a subject of debate since the early times and is still under discussion, it might provide a basis for further studies in the subject of abrogation to analyze the changes occurred in the meaning and content of abrogation throughout history. In this study, we dealt with Ibn Arabi’s views on abrogation and explained some basic concepts of this issue as well as examined controversial issues in this regard. We also discussed the conditions of abrogation and the relation between abrogater and abrogated verses according to Ibn al-’Arabī and compared his views to the views of other jurists and exegetes. Nesih konusu modern dönemde üzerinde en fazla tartışılan tefsir usulü konularındandır. Klasik dönemde varlığında çoğunlukla ittifak edilip miktarında ihtilaf edilen bu konu, modern dönemde varlığında ihtilaf edilen bir konu haline gelmiştir. Klasik dönemde mensuh kabul edilen âyetlerin sayısı birtakım kaynaklarda yüzlerle ifade edilirken modern dönemde bu sayı tekli rakamlara inmiştir. Bu noktada akla gelen isimlerden biri de Hindistanlı âlim Şah Veliyyullah Dihlevî’dir. (öl. 1176/1762) Tefsir usulü alanında kaleme aldığı Fevzü’l-kebîr fî usûli’t-tefsîr adlı eserinde nesih konusuna değinen Dihlevî, Süyûtî’nin (öl. 911/1506) el-İtkân adlı eserinde yirmi âyet olarak tespit ettiği mensuh âyetleri tekrar ele almış ve bunların sayısını beşe kadar indirmiştir. Modern dönemde nesih ile alakalı yapılan çalışmalarda Dihlevî’nin mensuh kabul ettiği âyetler öne çıkmış ve konu bu âyetler üzerinden tartışılır hale gelmiştir. Bu çalışma Hindistanlı âlim Müftî Saʻid Ahmed Palanpûrî’nin (1942-2020), Dihlevî’nin Fevzü’l-kebîr’i üzerine yazdığı el-ʿAvnu’l-kebîr şerhu’l-Fevzi’l-kebîr isimli şerhinde, neshe bakışını ve Dihlevî’nin mensuh kabul ettiği âyetlere yaklaşımını ele almaktadır. Aynı zamanda bu çalışma, modern dönemde Kur’an’da neshi reddedenlerin bayraktarlığını yapan Kur’ancılık ekolünün ortaya çıktığı Hint alt kıtasında Hanefî-Sünnî bir çizgi benimseyen Diyobend ekolünün neshe yaklaşımı hakkında da fikir vermektedir.

Nesh konusu tefsir, kelâm ve fıkhı ilgilendiren temel meselelerden biridir. Nesh, mahiyet itibarı ile Kur’ân tarihi ile yakından ilgilidir. Hz. Peygamber, sahabe ve nüzûl süreci neshte belirleyici etken olarak görünmektedir. İlk asırlarda neshin varlığından ziyade, kapsam ve niteliği inceleme konusu yapılmıştır. Şüphesiz bu durum, mütekaddim dönemde neshin varlığını kabul etmeyen herhangi bir görüşün belirgin bir şekilde ortaya çıkmamasıyla yakından ilgiliydi. Müteahhir dönemde Kur’ân’da neshin gerçekleşmediği sesleri yükselmeye başlamış, modern dönemde bu düşüncenin taraftarları azımsanmayacak kadar artmıştır. Nehs konusunda fikir beyân eden erken dönem âlimlerinden biri de Ebû Abdillâh el-Hâris el-Muhâsibî’dir (ö. 243/857). Zühd yaşantısıyla tanınan Muhâsibî, İtikâdî ve fıkhî mezheplerin ortaya çıkıp şekillendiği bir dönemde yaşamıştır. Muhasibî, farklı alanlarda birçok eser telif etmiştir. Bu eserlerde üzerinde durulan temel konulardan biri de neshtir. Bu çalışmada genel olarak nesh problemi ve Muhâsibî’nin nesh anlayışı çeşitli yönleri ile araştırma konusu yapılacaktır.

Nesih, ihtilaflı yapısına rağmen İslâm ilimleri içinde ayrıntılı bir şekilde işlenmiştir. Ancak modern dönem/Cumhuriyet sonrası tefsir usûlüne dair eserlerde bu konunun tartışılma şekli yüzeysel bir görünüm arzetmektedir. Oysa nesih sorunsalının sistematik bir bütünlük içinde ele alınması, gelenekteki nesih algısı üzerine yapılacak ayrıntılı bir analizle mümkün olabilir. Bu tespit ve amaçtan hareketle makalenin iki veçhesi bulunmaktadır. Makalede ilk olarak neshin kavramsal çerçevesi kısaca hatırlatılmakta ve modern dönem/Cumhuriyet sonrası tefsir usûlünde neshin ele alınış şeklini görebilmek için bahsi geçen tartışmaların bir tasviri yapılmaktadır. Akabinde tefsir geleneğinin önemli bir temsilcisi olan İbn Kesîr’in (ö. 774/1373) metodolojik ve pratik boyutuyla neshe yaklaşımı ele alınmaktadır. Neticede; rivâyetçi ve hadisçi müfessir İbn Kesîr’in öngörülenin aksine, nesih konusunda, akla/te’vîle dayalı açıklamalarda bulunduğuna dair tespitler yapılmaktadır. Buradan hareketle, İbn Kesîr’in konuyla ilgili izlediği bu yöntemin, tefsir usûlünde nesihle ilgili geliştirilmesi gerekli metodolojiye katkı sağlayacağı iddia edilmektedir.

The purpose of this article is to provide an overview of Ibn Qayyim al- Jawziyya (d. 751/1350), one of the important commentators living in the XIVth century, was able to determine his views on naskh. In this context, the views of Ibn Qayyim in the matter of naskh were examined and the original interpretations he brought about the subject were pointed out. As a result of the article, it was understood that the concept of naskh was removed from its contents in the Qur'an over time and it was detached from its meaning in the terminology of the șaḥāba and Tābi'ūn. In the eyes of the șaḥāba Naskh has been evaluated in a wide scope. The main problem here is the deviation in the course of meaning. According to Ibn Qayyim, naskh should be considered in various meanings. For example naskh, the object is to void the words that satan tries to add to the verses, meaning that the meaning is separated from the unrelated ones in a way that does not interfere with anything else. In addition naskh, it has the meaning of making solidification of the word. The verse is protected by naskh. Perhaps this is the most important determination of our article. The main function of naskh is not to cancel the verse, but to solidify it. In addition, naskh means the elimination of hard-hearted persons. [ABSTRACT FROM AUTHOR]

The issue of whether or not a naskh exists in the Qur'an is a topic discussed among scholars. The debate stems from the lack of clear and definite evidence in this issue. Given the fact that Naskh is to lift a religious text's provision with a later religious text or is abolishment of the judgment by a canon law evidence, Naskh also interested fiqh method and jurisprudence as well as the subject of naskh interested the method of exegesis. Moreover, considering the issue of nashk is Islamic law jurisprudence, ıt can be said that nashk is a matter related mostly to jurisprudence. As a matter of fact, the methodist, generally, have defined nashk as an abrogation of a Islamic law provision with the subsequent Islamic law provision and its removal from the act. According to this, it is called nasikh to the new ruling which abolishes the previous Islamic law judgment and called mansukh to the former ruling which is abolished and called naskh to this event. In the early days, the nashk word was widely thought of as including allocation, limitation and exception. However, it is stated that beginning from of İman Shafi'i, the naskh has acquired a terminological identity. The subject of nasikh and mensukh has been discussed since the first periods. It seems that tha nashk took place as a phenomenon in the classical period canonists's works that they wrote about the succes. Especially, all four sectarian jurists have acted on this principle in the solution of the juristic affairs, as well as they accepted nashk as the principle. In the classical fiqh works, some of the verses which are accepted as nullified, there are disputes in some parts meantime alliances in others. There has always been considerable debate over one of the significant subjects of scientific study of the Holy Qur'an: Nasih and Mansuh (the abrogater and brogated) verses. An overwhelming majority of scholars acknowledge the abrogation, while for some others, there is no abrogation in the Qur'an itself. From the point of view of those who acknowledge the abrogation, the effect of the environment in which revelation occurs on the abrogation of the verses can easily be observed when considering the reason for the revelation along with the atmosphere it came down. As a matter of fact, being in touch with lives of people and revealed interactively within twenty three years, the Qur'an rules according to the perception, level and progress of the community. Its shaping the principles of life in a plausible sequence, overseeing the realities of humanbeing and the community, thus improving some provisions in time have been beneficial to the humanbeings. Taking a look at the question through a surface cause point of view, it can be concluded that historical events and processes have their roles on the abrogation itself. Naskh (abrogation) is one of the main subjects of Qur'ān and Sunna studies for its importance to understand and interpret Qur'ān and Sunna in right way. For that reason given high importance by scholars of hadīth and scholars of other sciences. However, interpreting of naskh as cancelation of one Qur'ānic verse or hadīth permanently contributed to a sense of inflexibility and misunderstanding in the Islamic thought which is unnatural and unhealthy. Naskh of a Qur'ānic verse of hadīth permanently is valid for things that are bad in their nature with some exceptions. If the abrogating had been understood as a better one or same alternative for abrogated as it is mentioned in Qur'ān there would be no so much problems. Because the problem came out as a result of termination of a divine message or Saying of Prophet by another one. In this article, from this perspective we tried to introduce the different aspects of the naskh with taking care of approach that based on illah (cause), protecting the common sense of the humanity and basic human rights that represent basic religious purposes which cannot be abrogated instead of approaches to naskh which may cause termination of these fundamental rights and religious purposes.
