Постановка проблеми. Визначено недостатню вивченість ролі реалізації прав особи при виконанні судових рішень про застосування примусових заходів медичного характеру у кримінальному провадженні на фіксації першочерговості захисту прав, свобод і законних інтересів громадянина. Завданнями статті є визначення особливостей реалізації прав людини в ході кримінального провадження, обумовлення проблематичності застосування примусових заходів медичного характеру, розкрити особливості впливу сучасної судової практики на застосування примусових заходів медичного характеру. Методи. Під час дослідження застосовувались загальнонаукові методи (аналіз, систематизація) для визначення категорій права, що характеризують забезпечення прав особи при виконанні судових рішень про застосування примусових заходів медичного характеру, а також спеціальні методи, зокрема: догматичний – з метою тлумачення кримінальних процесуальних категорій; системно-структурний – для характеристики елементів прав особи при виконанні судових рішень; моделювання – для формулювання пропозицій до законодавства щодо удосконалення прав особи при виконанні судових рішень. Результати. Розглянуто регламентуючі положення Кримінального процесуального Кодексу в контексті застосування примусових заходів медичного характеру. Обумовлено обмеженість доступу до правосуддя, втрату функції додаткової гарантії реалізації прав на захисника чи законного представника в сучасному кримінальному провадженні. Розглянуто позицію Верховного Суду відносно реалізації права на здійснення судового перегляду за власним бажанням особи, яка примусово утримується у психоневрологічному закладі. Охарактеризовано варіанти припинення застосування примусових заходів медичного характеру на основі зміни рішення психіатричної комісії. Проаналізовано доцільність проведення медичного огляду осіб, відносно яких застосовані примусові заходи медичного характеру, з метою вчасного виявлення змін у клінічній картині захворювання. Відзначено, що керівництво психоневрологічного закладу та адміністрація кримінально-виконавчої установи зобов’язані гарантувати безперешкодну можливість проведення обстеження особи обраним незалежним фахівцем на території закладу. Проаналізовано завдання діяльності Прокуратури відносно застосування примусових заходів медичного характеру. Охарактеризовано роль прокуратури у реалізації наглядових функцій за додержанням законів при виконанні судових рішень у кримінальному провадженні щодо примусових заходів медичного характеру. Висновки. Зазначено, що одним із найбільш пріоритетних напрямів сучасної судово-правової реформи в Україні є вдосконалення кримінального процесуального законодавства і, зокрема, провадження по виконанню судових рішень про застосування примусових заходів медичного характеру. Problem statement. Insufficient study of the role of realization of individual rights in the execution of court decisions on the application of coercive measures of a medical nature in criminal proceedings to fix the priority of protection of the rights, freedoms and legitimate interests of citizens. The purposes of the article are to determine the peculiarities of the implementation of human rights in criminal proceedings, to determine the problems of the application of coercive measures of a medical nature, to reveal the features of modern judicial practice on the application of coercive measures of a medical nature. Methods. During the study, general scientific methods (analysis, systematization) were used to determine the categories of law that characterize the rights of the individual in the execution of court decisions on the application of coercive measures of a medical nature, as well as special methods, in particular: dogmatic – to interpret criminal procedural categories; system-structural – to characterize the elements of individual rights in the execution of court decisions; modeling – to formulate proposals to the legislation on the improvement of individual rights in the execution of court decisions. Results. The regulatory provisions of the Criminal Procedure Code in the context of the application of coercive measures of a medical nature are considered. Due to limited access to justice, the loss of the function of an additional guarantee of the rights to a lawyer or legal representative in modern criminal proceedings. The position of the Supreme Court regarding the exercise of the right to a judicial review at one's own request of a person who is forcibly detained in a psychoneurological institution is considered. Variants of termination of application of compulsory measures of medical character based on change of the decision of the psychiatric commission are characterized. The expediency of conducting a medical examination of persons against whom coercive measures of a medical nature have been applied, in order to detect changes in the clinical picture of the disease in a timely manner. It is noted that the management of the psychoneurological institution and the administration of the penitentiary institution are obliged to guarantee the unimpeded possibility of conducting an examination of the person by a selected independent specialist on the territory of the institution. The tasks of the Prosecutor's Office regarding the application of coercive measures of a medical nature are analyzed. The role of the prosecutor's office in the implementation of supervisory functions for compliance with the law in the execution of court decisions in criminal proceedings concerning coercive measures of a medical nature is described.
