The material scope of the research problem presented in the text encompasses the issues concerned with operational surveillance that the Polish civilian counter-intelligence service, i.e. the Internal Security Agency (in Polish abbreviated as ABW – Agencja Bezpieczeństwa Wewnętrznego), is authorised to. The main purpose of the analysis is to assess the changes introduced as a result of the passing of the so-called Surveillance Act in 2016. The Act was supposed to introduce new regulations with regard to the powers concerning operational surveillance and obtaining of ICT data, granted to particular secret and police services. The said changes were enforced by the judgment of the Constitutional Tribunal, which in 2014 found numerous violations of the provisions of the Constitutions of the Republic of Poland caused by the existing regulations authorising the services to engage in particular operational and investigative actions. In order to elaborate the material scope of the research problem, and to present the conclusions, the following research questions have been presented in the text: Do the legal regulations concerning the powers vested in the Polish civilian counter-intelligence service within operational surveillance infringe individual rights and freedoms (e.g. the right to privacy, protection of personal information, privacy of correspondence), and if so, then to what extent? Functional and pro-constitutional interpretations have been applied to assess the provisions regulating the powers of the Internal Security Agency with regard to operational surveillance and obtaining of ICT data. The functional interpretation focuses on the function of selected legal solutions, whereas the pro-constitutional interpretation focuses on the assessment of legal solutions in the context of the principles of a democratic state ruled by law, as well as human rights and freedoms. As regards the pro-constitutional interpretation, the tool used for assessment is the test of proportionality, i.e. the rule used for interpreting legal norms according to the degree and legitimacy of the interference in individual rights and freedoms. Zakres przedmiotowy problemu badawczego w tekście obejmuje tematykę kontroli operacyjnej, do której uprawniony jest polski kontrwywiad cywilny, czyli Agencja Bezpieczeństwa Wewnętrznego (pol. skrót: ABW – Agencja Bezpieczeństwa Wewnętrznego). Głównym celem podjętej analizy jest chęć oceny zmian, które dokonano w związku z przyjęciem tzw. Ustawy inwigilacyjnej w 2016 roku. Ustawa ta miała wprowadzić nowe regulacje w zakresie uprawnień dotyczących kontroli operacyjnej i pozyskiwania danych teleinformatycznych poszczególnych służb specjalnych i policyjnych. Zmiany te wymuszane zostały orzeczeniem Trybunału Konstytucyjnego, który w 2014 roku stwierdził liczne naruszenia przepisów Konstytucji RP przez dotychczasowe przepisy uprawniające służby do stosowania poszczególnych czynności operacyjno-rozpoznawczych. W celu uszczegółowienia zakresu przedmiotowego problemu badawczego i prezentacji wniosków końcowych w tekście przedstawiono następujące pytanie badawcze: Czy i w jakim stopniu regulacje prawne dotyczące uprawnień polskiego kontrwywiadu cywilnego w zakresie kontroli operacyjnej naruszają prawa i wolności jednostki (np. prawo do prywatności, ochronę informacji o sobie i tajemnicę korespondencji)? Do oceny przepisów regulujących uprawnienia Agencji Bezpieczeństwa Wewnętrznego w zakresie kontroli operacyjnej i pozyskiwania danych teleinformatycznych wykorzystano interpretację funkcjonalną i prokonstytucyjną. Interpretacja funkcjonalna skupia się na funkcji wybranych rozwiązań prawnych, natomiast interpretacja prokonstytucyjna na ocenie rozwiązań prawnych w kontekście zasad demokratycznego państwa prawa oraz praw i wolności człowieka. W przypadku interpretacji prokonstytucyjnej, narzędziem oceny jest test proporcjonalności, czyli reguła interpretacji norm prawnych wedle stopnia i zasadności ingerencji w prawa i wolności jednostki. 3 5 23 Przegląd Politologiczny

teologia pastoralna Artykuł przedstawia możliwości zastosowania kontroli operacyjnej w parafii. Przedstawiona została najpierw istota kontroli operacyjnej, zwanej również kontrolą operacji, a następnie jej stosowanie w przedsiębiorstwach pierwszego i drugiego sektora. W dalszej części zostały ukazane możliwości zastosowania kontroli operacyjnej w duszpasterstwie parafialnym, a zwłaszcza planów i programów duszpasterskich, realizacji duszpasterstwa oraz sprawujących posługę duszpasterzy. The article presents the possibilities to use operational control in the parish. Firstly, the author defines the essence of operational control which is also called the control over the operation; next he presents how operational control is used in the primary and secondary sectors. In the further part of the article he enumerates the possibilities to use operational control in the parish pastoral care, with the emphasis on the pastoral plans and programs, on the realization of pastoral care as well as on the pastoral care priests’ ministry.

W pierwszej części artykuł ogniskuje wokół problematyki kontroli operacyjnej, podejmując próbę jej analizy w odniesieniu do przepisów międzynarodowych praw człowieka, prawa konstytucyjnego oraz ustaw regulujących dotychczasowe funkcjonowanie tzw. kontroli operacyjnej. W dalszej części omówione zostały nowe kompetencje, szefa ABW oraz zmiany wprowadzone ustawą do k.k. oraz k.p.k. W końcowej części wyszczególniono ponadto zmiany wprowadzone przedmiotową ustawą do innych ustaw szczególnych (w tym do prawa lotniczego, odnoście dronów oraz prawa bankowego w przedmiocie dostępu do tajemnicy bankowej). The article focuses on the implementation of new solutions in the field of counteracting terrorism in Poland. In the first part it discusses the issue of operational control, which is analysed in the context of international constitutional law, domestic constitutional law and law on operational control. Further on, it focuses on the new competence of the chief of ABW and the implementation of changes to Polish criminal and criminal procedure law. Last but not, it enumerates the changes to other branches of laws (to name but a few; aviation law in the context of drones and bank law in the aspect of access to bank secret).

The object of analysis in the present text is the issue of operational control and data retention in Poland. The analysis of this issue follows from a critical stance taken by NGOs and state institutions on the scope of operational control wielded by the Polish police and special services – it concerns, in particular, the employment of “itemized phone bills and the so-called phone tapping.” Besides the quantitative analysis of operational control and the scope of data retention, the text features the conclusions of the Human Rights Defender referred to the Constitutional Tribunal in 2011. It must be noted that the main problems concerned with the employment of operational control and data retention are caused by: (1) a lack of specification of technical means which can be used by individual services; (2) a lack of specification of what kind of information and evidence is in question; (3) an open catalogue of information and evidence which can be clandestinely acquired in an operational mode. Furthermore, with regard to the access granted to teleinformation data by the Telecommunications Act, attention should be drawn to a wide array of data submitted to particular services. Also, the text draws on the so-called open interviews conducted mainly with former police officers with a view to pointing to some non-formal reasons for “phone tapping” in Poland. This comes in the form of a summary.

Autorzy koncentrują się na zagadnieniach etycznych w przeprowadzaniu tzw. czynności operacyjno-rozpoznawczych. Artykuł zawiera szerokie omówienie oraz podział tych czynności na podstawie „ustawodawstwa policyjnego”. Na podstawie materiału z rozmów przeprowadzonych przez autorów z funkcjonariuszami operacyjnymi zostały zanalizowane problemy natury etycznej, jakie najczęściej towarzyszą konkretnym czynnościom operacyjnym. Szczególną uwagą obdarzono tzw. osobowe źródła informacji i metody ich pozyskania, stosowanie techniki operacyjnej, a także wpływ pracy operacyjnej na relacje funkcjonariuszy z rodziną i otoczeniem. The authors focus on ethical issues in conducting so-called operational and reconnaissance activities. The article contains a broad overview and breakdown of these activities on the basis of “police legislation”. The material from interviews conducted by the authors with the operating officers, constituted the basis of the analysis of ethical problems, which often accompany specific operational procedures. Particular attention was paid to so-called personal source of information and methods for obtaining it, the application of operational techniques and the impact of operational work on relations of officers with family and the environment. Авторы концентрируются на этических вопросах во время проведения т.н. опе- ративно-поисковых мероприятий. В статье широко рассмотрены виды таких мероприятий, предусмотренных «полицейским законодательством». На ос- новании материала собранного во время разговоров, проведённых авторами с оперативными служащими, были проанализированные этические проблемы, которые чаще всего сопровождают конкретные оперативные мероприятия. Особое вниманием обращено на т.н. доверительные источники информации и методы их получения, применение оперативной техники, а также влияние оперативной работы на отношения служащих с семьей и окружением.
