This article answers two questions from the perspective of United Kingdom law and policy: (i) is health information property? and (ii) should it be? We argue that special features of health information make it unsuitable for conferral of property rights without an extensive system of data-specific rules, like those that govern intellectual property. Additionally, we argue that even if an extensive set of rules were developed, the advantages of a property framework to govern health information would be slight: propertization is unlikely to enhance patient self-determination, increase market efficiency, provide patients a foothold in the data economy, clarify legal uses of information, or encourage data-driven innovation. The better approach is to rely less, not more, on property. We recommend a regulatory model with four signature features: (i) substantial protection for personal health data similar to the GDPR with transparent limits on how, when, and by whom patient data can be accessed, used, and transmitted; (ii) input from relevant stakeholders; (iii) interoperability; and (iv) greater research into a health-data service, rather than goods, model.

El avance tecnológico y la rápida difusión de la información han supuesto la creación de una nueva forma de delinquir. El ordenamiento jurídico internacional se empieza a preocupar por las consecuencias de la comisión de estos comportamientos a mediados de los años ochenta, es por ellos que en el mundo se abre la discusión sobre la necesidad de controlar estas conductas que alteran el normal funcionamiento de la sociedad y que hasta entonces eran desconocidas. A partir del año 2009 con la ley 1273, en Colombia es posible la tipificación de los delitos informáticos, esta ley representa la herramienta que brinda el legislador con el fin de proteger el nuevo bien jurídico de “la Información y los Datos” sin dejar de lado el reto que implica para la administración de justicia en cuanto a la persecución judicial de quienes a través de medios informáticos realizan dichas conductas. La región de la Orinoquia y específicamente el Distrito Judicial de Villavicencio no son ajenos a esta realidad, es por ello que el proyecto de investigación tuvo por objeto profundizar en el conocimiento de estos flagelos y de este modo conocer el estado actual de denuncia, procesamiento y persecución judicial de los ciberdelitos. Technological progress and the advent of the technology era have led to the creation of a new class of crimes. From the eighties, the world began to discuss the need to control behaviors that alter the normal functioning of society and were unknown at the time. In Colombia, it was not until 2009 with the 1273 law with which that manages to have a tool to punish and protect the new legal right "information and data". This law poses great challenges for the administration of justice in the judicial persecution of those who through computer media perform such behaviors. Orinoquia region and specifically Judicial District of Villavicencio (Meta) is no stranger to this reality and therefore it is necessary to deepen in the knowledge of these scourges for status current reporting, prosecution and judicial persecution against cybercrime. That is why our investigation focused on who commits these behaviors and how the Judicial District has faced criminal prosecution and subsequently the prosecution of these subjects. Nowadays we can observe an information and data volume growth. It arises the question: how to represent a considerable amount of information to society? One of the most common methods is to vizualize it by puting into an infographics. This bachelor thesis contains research of the infographics developement and application, content analysis, description of various aspects related to the creation and determination of the basic moments of the process. The next target of the following work is to use the obtained experience in practical project: design the infographics for Multimedia in the Economic Practice course.

El mundo jurídico y la sociedad actual se enfrentan a una nueva clase de delitos. Dichas conductas se empezaron a discutir desde la década de los ochenta, sin embargo, en Colombia, no es sino hasta el año 2009 con la ley 1273 que se logra tener una herramienta para castigarlo y proteger el nuevo bien jurídico de “la Información y los Datos”. Esta ley plantea nuevos retos para la administración de justicia en la persecución penal de estas conductas. El presente artículo presenta una investigación cualitativa realizada para describir la efectividad judicial de la persecución penal de los delitos informáticos en el Distrito Judicial de Villavicencio (Meta) a través de un trabajo que implicó la realización de entrevistas a los funcionarios públicos (fiscales) y el ejercicio del derecho de petición para el acceso a la información pública. El trabajo confirma la tesis de la criminología crítica que considera insuficiente la consagración de un tipo penal para que exista una efectiva materialización de la persecución penal que es, de acuerdo a esta teoría, selectiva. Los delitos informáticos, y esta es la conclusión parcial de este trabajo, no están siendo conocidos por el sistema penal colombiano por la ausencia de denuncias o de mecanismos adecuados de investigación oficiosa en la etapa de indagación penal. Ambos fenómenos, que constituirían hipótesis de trabajo, podrían ser nuevos campos de investigación socio jurídica en el derecho penal. The legal world and society face a new kind of crime. These behaviors are started arguing since the early eighties, however, in Colombia, it was not until 2009 with the 1273 law that manages to have a tool to punish and protect the new legal right "information and data ". This law poses new challenges to the administration of justice in the prosecution of these behaviors. This article presents a qualitative research to describe the legal effectiveness of the criminal prosecution of cybercrime in the Judicial District of Villavicencio (Meta) through a job that involved conducting interviews with public officials and the exercise of the right request for access to public information. The work confirms the thesis of critical criminology considered insufficient the consecration of a criminal offense for which there is an effective realization of the prosecution which is, according to this theory, selective. Computer crimes, this is the conclusion part of this work, not being known to the Colombian criminal justice system by the absence of adequate mechanisms complaints or informal research in the criminal investigation stage.
