Fıkıh usûlünde hüküm çıkarma yöntemleri arasında en önemli konulardan biri olan kıyas, asıl ile ferʿi birleştiren bir illetten dolayı ferʿi asla hamledip, aralarındaki benzerlikten ötürü aslın hükmünü ferʿe uygulamayı ifade etmektedir. Asıl, ferʿ, aslın hükmü ve illet olmak üzere dört ana temel üzerine oturtulan kıyas konusunda tartışmaların en fazla yapıldığı mesele illettir. Usûlcüler illetin mahiyeti, kısımları, şartları ve tespit yollarını ele alarak incelemiş ve bu bağlamda farklı görüşler ileri sürmüşlerdir. Usûlcülerin illet konusunda ihtilaf ettikleri konulardan birisi de illete yöneltilen itirazlardır. Her ne kadar illete yöneltilen itirazlar cedel ilminin konusu olsa da usûl eserlerinin büyük çoğunluğunda bunlara yer verilmiştir. İllete yöneltilen itirazların sayısı hakkında usûlcülerin bir ittifakı bulunmamaktadır. Hatta aynı ekole mensup usûlcüler arasında bile illete yöneltilen itirazlar hakkında farklı sayıların ileri sürüldüğü görülmektedir. Araştırma konumuz olan kalb ve akis, illete yöneltilen itirazlardandır. Kalb, illete yönelik geçerli bir itiraz kabul edilirken kalbü’t-tesviye olarak isimlendirilen ve hakikatte kalb olan akisin ise geçerli bir itiraz olup olmaması hususunda farklı görüşler ileri sürülmüştür. Kimi usûlcüler tarafından zayıf ve fasit bir itiraz olarak kabul edilen akis, kimi usûlcüler tarafından ise geçerli bir itiraz olarak görülmüştür. Bu çalışmada Hanefî usûlcülere göre illete yöneltilen itirazlardan kalb ve akis konuları ele alınıp incelenecektir, Qiyas, one of the most important issues among the methods of making judgments in the Islamic jurisprudence, means to move the ferʿ to the asl and to apply the decree of the asl to the ferʿ because of the similarity between them due to a illah that combines the asl and the ferʿ. The proceduralists have examined the nature of the illah, its parts, conditions, and ways of detection, and have put forward different views in this context. One of the issues on which the jurists disagree about the illah is the objections against the illah. Although the objections to the illah are the subject of the science of jadal, they are included in the majority of the works of method. There is no consensus among the jurists about the number of objections to the illah. It is seen that different numbers are put forward about the objections to the illah even among the jurists belonging to the same school. The qalb and aqs, which are the subject of our research are from the objections to illah. While the qalb is accepted as a valid objection to the illah, different opinions have been put forward about whether the aqs, named as qalbu al-taswiya, whose originality is qalb is valid or not. The aqs, which has been considered weak and invalid by some jurists, has been seen as a valid objection by some. In this study, the issues of qalb and aqs, which are among the objections against the illah according to the Hanafi jurists, will be discussed and examined.

Doktora Tezi, Fıkıh usûlü ve nahiv usûlü arasındaki ilişkinin ele alındığı bu çalışmada her iki usûl arasındaki ilişki boyutları incelenmiş ve aralarındaki benzer ve farklı yönler ortaya konmaya çalışılmıştır. Bu çalışma bir giriş, üç bölüm ve bir sonuçtan oluşmaktadır. Giriş bölümünde çalışmanın konusu, önemi, amacı ve kapsamı üzerinde durulmuş ve çalışmanın kaynaklarına yer verilmiştir. Birinci bölümde fıkıh ve nahiv ilimleri arasındaki ilişki boyutlarının genel çerçevesi incelenmiştir. Nahiv ve fıkıh usûlü ile nahiv usûlü ve fıkıh usûlü arasındaki ilişkiye değinilmiştir. Ayrıca her iki usûldeki telif yöntemi, dilin kökeni, hükümler, lafızların anlama delaleti ve müctehidin şartlarına yer verilmiştir. İkinci bölümde bu iki usûlde geçen ve naklî deliller olan Kitap, Sünnet ve icmâ delillerinin mahiyetleri, şartları, delil oluşları ele alınarak bu deliller arasındaki benzer ve farklı yönler incelenmiştir. Üçüncü bölümde her iki usûlde bulunan ve aklî deliller olan kıyas, istihsân ve istishâb delillerinin mahiyetleri, türleri şartları ve delil oluşları incelenmiştir. Ayrıca her iki usûldeki delillerin teâruzu ve tercih yöntemleri ele alınmıştır. Sonuç kısmında da bu araştırmayla elde edilen neticelere yer verilmiştir., In this study, which deals with the relationship between jurisprudence and Arabic grammar methodology (nahiv), the dimensions of the relationship between the two methods were examined and similar and different aspects were tried to be put forward. This study consists of an introduction, three sections and a result. In the introduction, the subject, importance, purpose and scope of the study are determined and the sources of the study are included. In the first chapter, the general framework of the dimensions of the relationship between fiqh and nahiv is examined. The relation between Nahiv and jurisprudence and nahiv methodology and jurisprudence is mentioned. In addition, the use and origin of language, rulings (ahkam), the indication of the text to the meaning and the conditions of the mujtahid are given in both methodologies. In the second part, the similarities and differences between these methodologies are examined by taking into account the nature, conditions and evidence of the Book (Quran), Sunnah and consensus (ijmâ) proofs in these two methods. In the third chapter, the nature of the proofs found in both methods, namely analogy (kiyas), istihsan and istishab are examined. In addition, the preference methods during the conflict of evidences in both methodologies are discussed. In the conclusion part, the results obtained by this research are included.
