Научная работа посвящена текущей оценке состояния сферы жилищно-коммунального хозяйства. Методологической базой исследования являются труды отечественных ученых, посвященные состоянию сферы жилищно-коммунального хозяйства, а также данные официальной статистики по проблемам и состоянию данной сферы. Авторы указывают на многочисленные научные работы, которые описывают состояние сферы ЖКХ как кризисное на современном этапе развития общества и носят несистемный характер. По итогам анализа методологической базы в исследовании систематизированы параметры текущего состояния сферы ЖКХ с различных аспектов. Решение поставленных в исследовании задач осуществлялось с применением системного подхода, табличных и графических приемов обработки данных. Авторы комплексно оценили состояние сферы ЖКХ с таких аспектов, как правовой, политический, технологический, экономический, социальный, экологический. Политический аспект ЖКХ по-прежнему используется для политических манипуляций и лоббирования интересов бизнес-элит, при этом намечается позитивная тенденция в оценках деятельности данной сферы. В технологическом плане состояние сферы ЖКХ находится еще пока в неудовлетворительном состоянии, но также наметились положительные тенденции по отдельным ключевым индикаторам. Несмотря на наметившиеся положительные тенденции в отрасли, общество по-прежнему отрицательно оценивает работу сферы. Полученные данные о текущем состоянии ЖКХ имеют практическую значимость для повышения эффективности работы предприятий сферы. Предложенные оценки могут быть использованы для определения первоочередных путей повышения эффективности и решения проблем в отрасли, The scientific work is devoted to the current assessment of the state of the housing and utilities sector. The methodological basis of the study is the work of domestic scientists on the state of the housing and utilities sector, as well as official statistics on the problems and the state of this area. The author points to numerous scientific works that describe the state of the housing and communal services as a crisis at the current stage of development of the society and arenot systemic in nature. According to the results of the analysis of the methodological base, the study systematized the parameters of the current state of the housing sector in terms of various aspects. The tasks of the study were solved using a systematic approach, tabular and graphical data processing techniques. The author comprehensively assessed the state of the housing and utilities sector in terms of such aspects as: legal, political, technological, economic, social, ecological. From the point of view of the political aspect, housing and communal services are still used for political manipulations and lobbying of the interests of business elites, while there is a positive trend in assessing the activities of this sphere. Technologically, the state of the housing and utilities sector is still in unsatisfactory condition, but there have also been positive trends in certain key indicators. Despite the emerging positive trends in the industry, the society still negatively assesses the work of the housing and utilities sector. The data obtained on the current state of the housing and utilities sector are of practical importance in improving the efficiency of enterprises in the housing and utilities sector. The practical significance lies in the fact that the proposed estimates can be used to identify priority ways to improve efficiency and solve problems in the industry, №1(50) (2020)

В настоящее время в российском законодательстве существует значительное количество видов найма жилого помещения: коммерческий, социальный наем, наем жилого помещения жилищного фонда социального использования, наем специализированного жилого помещения, временный наем. Наем специализированного жилого помещения в свою очередь подразделяется на семь видов найма в зависимости от типа жилого помещения. В связи с этим возникает необходимость в систематизации видов найма, конкретизации категорий населения, к которым применимы те или иные способы съема жилого помещения. В статье анализируется региональный опыт предоставления жилых помещений тем или иным способом, приводятся конкретные примеры субъектов федерации, категорий населения и видов найма. Обобщающим элементом статьи является блок-схема всех видов найма жилого помещения., Currently, in Russian legislation there are a significant number of rental housing types: commercial, social rental, housing rental for social use, specialized housing rental and temporary rental. Specialized housing rental is subdivided into seven types of lease, depending on the type of dwelling. Summarizes the Texas Court of Civil Appeals for Dallas’s case Sims v. Century Kiest Apartments. In Sims, Sims, a tenant at Century Kiest Apartments, reported violations of various housing, building, and health codes. Sims was then given notice to vacate the premises, and the landlord brought forcible detainer proceedings to gain possession of the property. Sims claimed that his eviction was caused by retaliation for his reporting of the various violations. Reversing the trial court, the appellate court in Sims held that tenants have a cause of action for retaliatory eviction caused by reporting violations of the housing code.

Discusses Mease v. Fox, and the Iowa Supreme Court’s decision to discontinue its application of doctrine of caveat emptor, instead recognizing an implied warranty of habitability and fitness in an oral or written lease of residential property. The author states that, “hopefully, Texas will join Iowa in adopting the implied warranty theory. Such an action would conform the lease more closely to the actual expectations and needs of the modern landlord and tenant.”
