Worldwide, an increasing number of transgender individuals turn to gender identity clinics for gender-affirming medical care: interventions to affirm and express their experiences gender. A central ethical challenge faced by those receiving and providing such care is: How should we go about making and sharing decisions? In other words: what does good shared decision-making entail? This thesis has two central aims. First, to gain insight into the moral and conceptual landscape of shared decision-making in this specific care practice. Second, to co-create an ethics support tool that fosters (a joint reflection on) good shared decision-making making and aids stakeholders in practice in recognizing and handling related ethical challenges. Amid polarization, we sought to bring together and encourage deliberation among healthcare professionals and clients through a participatory design, qualitative methods, and ethics. This thesis highlights that shared decision-making in gender-affirming medical care is characterized by ontological ambiguities, epistemic uncertainties and normative contestations. We hope the findings and tool presented in this thesis provide a foothold for ongoing, critical-constructive dialogues toward better shared decision-making in transgender healthcare and beyond.

Niet in de laatste plaats omwille van noodzaak of morele rechtvaardigheid, maar eerder omdat kennis en ervaringen die studenten opdoen logischerwijs van invloed zijn op hun wereldbeeld, de (on)mogelijkheid tot participatie in de samenleving en hoe ze hun beroepsidentiteit in relatie tot hun burgerschap zien. In de onderzoekswerkplaats burgerschap Democratisering van kritisch denken (hierna werkplaats) is handen en voeten gegeven aan het burgerschapsvormende karakter van het beroepsonderwijs. This dissertation addresses the research question of what demands us to be ethical after the ‘death of God’ and the ethico-political critique of the modern Subject. It moreover explicates the implications of the proposed answer to this question for the debate on race and rehumanization. The question is addressed in conversation with the French philosopher Jean-Luc Nancy and Cameroonian philosopher and historian Achille Mbembe. Accordingly, the study argues for the position of an ontological demand that situates the ethical demand in being obligated to take responsibility for our disposition of existing in the world always already with others, a demand that concerns our ethos or conduct of existing in the world. The implications of this claim is considered in conversation with Nancy, who first outlined this stance, and Mbembe, who pushes it further in terms of a critical engagement with the question of race—more specifically, regarding the relation between the ethical demand and the reparation of the dignity of those historically dehumanized under a racialized worldview. As Mbembe notes, it concerns reparation not reduced only to its economic meaning. Instead, it concerns the reparation of the broken relations within our shared world. Correspondingly, the main research question is divided into three sub-questions: how does Western metaphysics constitute ethics, and why is it problematic? (chapters 2 through 5); how do Nancy and Mbembe help us reconceive what demands us to be ethical, given the critique of Western metaphysics and the limits of the Self-Other schema? In the Netherlands, physician assisted death (PAD) is possible for patients who are competent in their death wish and who suffer from a medical condition that is unbearable and irremediable. These criteria, which are codified in the 2002 law on euthanasia, are the outcome of a long societal debate that started in the 1970s, when physicians emphasized the tension between the duty to alleviate suffering and the duty to preserve life. They argued that in certain cases actively assisting in the death of a patient was the only merciful option. Although the debate mainly focused on patients suffering from somatic suffering, PAD is legally allowed for psychiatric suffering since the 1990s. Only a very limited number of cases have been reported until 2011. From then on, there has been a rise in assisted deaths for patients with a psychiatric disorder. The increasing clinical experience accompanying the rise in PAD-requests made it clear that psychiatrists struggle with establishing irremediability. This dissertation therefore examines the concept of irremediable psychiatric suffering (IPS) in the context of PAD. We do this in three steps. First, we establish the moral relevance of IPS in the context of PAD. Secondly, we identify the main challenges clinicians face while establishing IPS in the context of PAD. And finally, we establish consensus criteria for IPS in the context of PAD. Based on this dissertation we recommend that clinicians adopt a retrospective view when establishing irremediability in the context of PAD. We also suggest that they are mindful of ‘treatment fatigue’ when working with patients that have a PAD request or persistent psychiatric complaints. On an organizational level we suggest that the consensus criteria can be used when the Dutch and Belgian guidelines on PAD for PPD are updated. For future research we recommend to include the perspectives of other stakeholders, especially patients, on IPS. Also, we recommend to repeat the research in other countries. We suggest to study treatment fatigue in patients with persistent psychiatric complaints and recommend to make the national registry of the Regional Euthanasia Review Boards available for in-depth research. In conclusion; establishing IPS in the context of PAD is a morally relevant and complex activity. Psychiatrists are asked to make a life-or-death decision while facing profound uncertainty. However, by engaging in a meaningful dialogue with the patient and by adopting a retrospective view on irremediability, it is possible to come to a careful decision that finds the right middle between carelessness and overcautiousness. Consensus criteria are now available to help the psychiatrist with the challenging - but not impossible - task of establishing the irremediability of psychiatric suffering in the context of physician assisted death.

De coronacrisis geeft het thema fiscale ethiek een bijzondere urgentie. De overheid geeft veel geld uit om bedrijven en andere sectoren van de maatschappij te ondersteunen. De vraag is dan uiteraard: wie draagt wat bij? Wie betaalt loyaal belastingen en wie drukt zich - bijvoorbeeld door uitgekiende estate planning? Wie voelt zich verantwoordelijk voor de ondersteuning van de maatschappij en individueel welzijn via de staat?In deze bijdrage ga ik in op de noodzaak van vertrouwen in relatie tot het belastingstelsel. Daaraan voorafgaand maak ik een onderscheid tussen twee soorten vertrouwen: vertrouwen op instituties en het vertrouwen in medemensen. Het belastingstelsel is zo’n institutie. Vertrouwen is de kurk waarop een goed functionerend en rechtvaardig belastingsysteem drijft. Bovendien zijn belastingen een moreel fenomeen: zij stellen de overheid in staat belangrijke waarden te realiseren ten behoeve van de maatschappij. Vervolgens zal ik betogen dat fiscaal vertrouwen alleen gedijt als burgers en hun adviseurs accepteren dat zij een (gedeelde) verantwoordelijkheid dragen voor de integriteit van het belastingsysteem. Tot slot wijs ik vanuit dit perspectief op een aantal morele kwesties die bij estate planning kunnen spelen.

Waardenwerk is, zo schrijft Harry Kunneman, in situaties waar het aankomt op het omgaan met tegenstellingen veeleer emotioneel en psychisch werk dan argumentatief denkwerk. De bijdrage van Fernando Suárez- Müller laat zien dat het redelijk afwegen nog steeds kan blijven meedoen, maar toch… hoe dichterbij het komt, hoe meer de onwil om de ander te begrijpen mee gaat doen. Bij verschil van mening gaat het om gelijk denken te hebben, gelijk willen krijgen en de ander geen gelijk willen geven… Het hebben, krijgen en geven van gelijk, staat in contrast met het toelaten, erkennen en misschien zelfs vieren van verschil. Wat behelst de opdracht tot emotioneel en relationeel waardenwerk in deze?
