The adoption of the Law of Ukraine dated February 17, 2022 "On Administrative Procedure" № 2073-IX laid the foundation for the further development of a modern European state. The mentioned Law introduces universal rules of interaction between citizens, businesses and the state. Taking into account the European integration course of Ukraine, various types of administrative procedures require improvement, among which the procedure for granting work permits for foreigners requires special attention, taking into account the positive experience of legal regulation of administrative relations to ensure the right to work for foreigners in European countries. Тhe following scientists paid attention to issues related to the employment of foreigners for work in Ukraine M.O. Day, P.I. Vasylenko, O.I. Kiselyova, D.I. Gaigara, O.E. Lutsenko, O.P. Radchuk, E.V. Stilchenko, however, insufficient attention has been paid to the study of the administrative procedure for granting work permits for foreigners in foreign countries. The administrative procedure for granting a work permit for foreigners in the Czech Republic attracts special attention, therefore, consideration of the legal regulation of this procedure and its stages in the specified country is the goal of our study. The article analyzes the issue of the administrative procedure for issuing a work permit for foreigners. The legal regulation, the stages of the administrative procedure of granting a work permit in the Czech Republic are analyzed. The requirements for obtaining a work permit for foreigners in the Czech Republic are summarized. It is determined that a work permit for foreigners in the Czech Republic can be issued only on the condition that the foreigner is legally staying in the country and is issued a corresponding residence permit. Зазначений Закон запроваджує універсальні правила взаємодії між громадянами, бізнесом та державою. Враховуючи євроінтеграційний курс України, на сьогодні вимагають удосконалення різні види адміністративних процедур, серед яких особливої уваги потребує процедура надання дозволу на роботу для іноземців, з урахуванням позитивного досвіду правового регулювання адміністративних відносин з забезпечення права на працю для іноземців європейських країн. У статті досліджено питання адміністративної процедури надання дозволу на роботу для іноземців. Проаналізовано особливості правового регулювання, стадії адміністративної процедури надання дозволу на роботу в Чеській Республіці. Узагальнено вимоги для отримання дозволу на роботу для іноземців в Чехії. Визначено, що дозвіл на роботу для іноземців в Чеській Республіці може бути виданий виключно за умови легального перебування іноземця в країні та видачі йому відповідного дозволу на перебування. Акцентовано, що правове регулювання відносин у сфері працевлаштування іноземців в Чеській Республіці врегульовується законом, в якому закріплюється правовий статус іноземців в цій країні, рядом інших законів, норми яких тим чи інших чином впливають на врегулювання цього статусу, та рядом підзаконних актів, розроблених відповідними міністерствами та відомствами, на які покладаються функції з безпосереднього надання дозволу на проживання та роботу іноземних громадян. Підкреслено необхідність впровадження позитивного досвіду Чеської Республіки правового регулювання адміністративних відносин з забезпечення права на працю для іноземців.

The bachelor thesis deals with agency employment. It describes the principle of how this form of employment works within the framework of domestic legislation. The problems that are being solved in connection with this issue are also being touched upon in thesis. Recent court decisions have also provided a significant source of information. The individual hypotheses of the thesis and the overall goal of the thesis are solved by a questionnaire survey, together with other obtained data on the topic.

1 Agency employment with a cross-border element Abstract The topic of this diploma thesis is agency employment with a cross-border element. Employment agencies cover the shortage of workers on the Czech labor market by assigning foreigners to users. The thesis analyzes this process of agency employment of foreigners, by connecting the institutes of agency employment and employment of foreigners. In its introductory chapter, this thesis briefly describes and analyzes the institute of agency employment, focusing primarily on the requirements necessary to obtain a permission for agency employment and on comparable working and wage conditions. Furthermore, this work deals with the cross-border element of agency employment, where the second chapter analyzes in detail the process of agency employment of foreigners, both citizens of other Member States of the European Union and especially foreigners from third countries. Based on this analysis, the content of the second chapter is also a comparison of the legal status of Czech nationals, citizens from other Member States of the European Union and foreigners from third countries in the framework of agency employment. The topic of this diploma thesis is legal and illegal work of foreigners in Czech Republic. Both legal and illegal work are related to the performance of dependent work. Therefore, the thesis begins with the definition of this term when the author describes the individual characters of dependent work stipulated not only by the law but also by applicable case law. At the end of the first part, several tests of employment which are helpful for the identification of the performance of dependent work are explained. The second part is devoted to the conditions of foreigners' stay and employment in the Czech Republic, divided into two groups of foreigners. Firstly, the citizens of the EU, EEA and Switzerland and their family members, especially regarding the free movement of workes stipulated by the Treaty on the Functioning of the European Union and the topic of posting workers in the context of the transnational provision of services. There are various reasons for the migration of the population in the world, from those of war and military, political and economic, then migrations driven by natural disasters, technological development and instabilities in the labor market. Labor migrations in the EU are mostly caused by the general dissatisfaction with situation in the labor market. The Republic of Croatia has increased the annual quota for the employment of foreign workers in 2018 to 22, 000. Foreigners need to know the Croatian language at the level of basic communication and they easily get a job in the Republic of Croatia. Freedom of movement of workers in the EU is regulated by the acquis communautaire and represents the legal source of primary law which regulates the access of the population to the EU labor market, which implies the provision of residence and employment of foreigners and their families, and equality of treatment towards nationals of another Member State as towards their own nationals (principle of non-discrimination). It is thought that migrants pose a threat to workers of the countries they immigrate because the mobility within the EU has increased considerably in recent years. Until now, the barriers have been mainly social, cultural and economic reasons, but as we move on, this becomes less and less a difficulty of labor force movement in the labor market. A review on the employment of foreigners in Germany will be given, and the laws of the Republic of Croatia and Germany related to this issue will be considered. The method of observation, comparative method and method of analysis and synthesis will be used in this paper.

Research background: The process of globalization brought changes in society that are manifesting themselves in many areas. One of the areas in which the greatest changes occurs is the socio-economic area. The development of society, which is associated with increasing competitiveness, the creation of new job positions, rising wages, and thus the quality of citizens’ life, can be examined through various indicators. The creation of new job positions brings with it changes in the labor market, especially in its opening for the arrival of foreign employees. Purpose of the article: The purpose of the article is to point out the relationship between the development of society and the migration of the population for work. To this purpose, it is necessary to examine the development of foreigners’ employment in selected regions and the impact of this employment on the development of regional gross domestic product, wages of employees, household expenditure and other indicators. Methods: The development of regional disparities in the context of regional development will be examined through descriptive statistics and other coefficients measuring social disparities, such as the Gini coefficient. Subsequently the dependence between the employment of foreigners and individual indicators can be examined. Findings & Value added: Research findings can be used to support the development of the least developed regions and to increase their competitiveness. The findings can thus be used not only by public authorities (in the case of state support), but also by employers from the private sector (employment policy).

Magistrska naloga prikazuje problematiko zaposlovanja tujih državljanov v Republiki Sloveniji (RS) in v nekaterih drugih državah Evropske unije (EU). Osredotoča se predvsem na zaposlovanje državljanov tretjih držav. Vsaka članica EU ima svoj postopek zaposlovanja državljanov tretjih držav, pri čemer se razlike med članicami manjšajo predvsem na račun skupne evropske zakonodaje in številih direktiv. Naloga predstavi ureditev v RS in opiše postopek in pogoje, ki jih mora tuj državljan izpolnjevati, v kolikor želi pridobiti enotno dovoljenje za prebivanje in delo. Gre predvsem za prikaz in hkrati kritiko sprememb, ki jih je prinesel Zakon o zaposlovanju, samozaposlovanju in delu tujcev. Sledi krajši opis direktiv EU, ki so pomembno vplivale na ureditev področja zaposlovanja tujcev v EU kot tudi v RS. Naloga prikaže tudi zaposlovanje tujcev v Avstriji, Nemčiji in Velike Britanije, z namenom, da predstavi, kje so še možnosti za izboljšave v domači ureditvi. Išče odgovore na vprašanji, zakaj si v omenjenih državah želijo predvsem visoko kvalificirane delovne sile in na kakšne načine jih privabijo. The present Master’s thesis presents the issues of employing foreign citizens in the Republic of Slovenia and certain other countries of the European Union (EU). Its focus lies primarily on the employment of third countries’ citizens. Each EU member state has its own process of employing third countries’ citizens. Nevertheless, due to the common European legislation and numerous directives the process is becoming more unified. The thesis presents relevant regulations in the Republic of Slovenia and describes the conditions foreigners must fulfil in order to obtain the single residence and work permit. Primarily, it is a description and criticism of the changes brought about by the Slovenian Employment, Self-employment and Work of Aliens Act. Furthermore, the EU directives which significantly influenced the regulation of the employment of foreigners in the EU and the Republic of Slovenia is briefly described. In order to discover possibilities for improvement in the Slovene regulation the present thesis also presents the employment of foreigners in Austria, Germany and the United Kingdom. The thesis seeks to find the answers to the questions why the mentioned countries predominately want a highly qualified workforce and what methods they use to attract these workers.

The aim of this diploma thesis is to analyze the Czech labor market and assess whether there is manpower for the group AGROFERT. Furthermore to analyze foreign markets and identify potential foreign workers. Based on the analysis and theoretical knowledge of agency employment to assess whether an internal labor agency for the group AGROFERT would help solve the current problem - a shortage of workers. The thesis is divided into 2 parts - theoretical and practical. The theoretical part defines basic background of labor markets and an explanation of key concepts in the issue of agency employment and employment of foreign nationals. The conclusion summarizes the results of the analysis and proposals of measures that could improve the current situation.

This bachelor thesis focuses on implementation and adaptation of Vietnamese immigrants to the Czech labor market including all legislative conditions regarding employing of the Vietnamese, starting by explaining the meanings of basic terms all the way to complex legal aspects which are crucial for legal functioning on the employer's side. Business activities of this minority are also mentioned as well as Czech-Vietnamese relations since their beginnings including bilateral treaties. For the practical part, interviews and comparison of two generations were chosen.

The dissertation thesis is aimed at actual topic of the international labour migration and working foreigners in the Czech Republic in the period of the global economical crisis between 2008 and 2012. It is an empirical research that comes out from the qualitative and quantitative study of the topic. The subject of the research were working foreigners. The bachelor thesis looks into the topic of Employment of foreigners in the Czech Republic in the terms of dependant work. The aim is to deal with the issue of obtaining necessary the permissions by these individuals (i.e. residence permission, employment permission, blue card and green card). Furthermore, this thesis deals with the current practice of the Czech employers and job agencies and also means (gateways and government programmes) which assist foreigners in finding a job in the Czech Republic. The thesis is supplemented by a survey carried out through two electronic questionnaires among Czech employers and foreign employees.

This volume brings together ten interviews conducted by students from the Faculty of History of Lyon 2 with migrants. The topic of the thesis is to analyse the employment relationships with a foreign component. Firstly, the thesis focuses on the employment of citizens of the Union within the territory of the EU countries and the rights of these workers. The next chapter provides an outline of the third-country nationals and concentrates on problems arising for the long-term residents who require staying in one of the EU countries for a longer period. Eventually, the last chapter of the thesis deals with the legislation in the Czech Republic which differentiates between the nationals of the EU and other (third-country) nationals. The purpose of this thesis is to provide an overview of the legal regulation of employment of foreign workers within the European Union and the Czech Republic.

Diplomsko delo obravnava proces zaposlovanja v podjetju OBS d.o.o., ki sodi med mala oziroma mikro podjetja, ta podjetja pa bi po mnenju mnogih morala biti gradnik novega slovenskega razvojnega preboja. Podjetje je po naravi svoje dejavnosti usmerjeno na tuje trge in potrebuje tudi kadre iz teh okolij. V teoretičnem razdelku prikazujemo prevladujoče usmeritve za delovanje kadrovske funkcije, posebej opisujemo normativni okvir oziroma predpise pri zaposlovanju tujcev v Sloveniji. V empiričnem razdelku na osnovi poglobljenega intervjuja z zaposlenimi tujci v podjetju raziskujemo njihova stališča o zadovoljstvu z delom v podjetju in o njihovih osebnih izkušnjah pri procesu zaposlovanja in bivanja v Sloveniji. Odgovori kažejo, da so z večino stvari, na katere lahko neposredno vpliva podjetje, sorazmerno (zelo) zadovoljni, mnogo manj pa s postopki, ki so jih bili deležni pri različnih opravilih z državnimi, upravnimi in drugimi organi. Čeprav majhno število anketiranih ne dovoljuje posplošitev, pa vseeno nakazuje, da bo morala Slovenija kot država še marsikaj postoriti zlasti na praktični ravni, če želi, da se bodo tuji delavci bolje integrirali v okolje in da bo njihov splošni vtis o delu in življenju v Sloveniji boljši. The thesis deals with the process of employment in the company OBS Ltd. This company can be classified among small and micro companies, which according to prevailing opinion should be the groundstone of new Slovenian development' breakthrough. The company is by the nature of its activity oriented towards foreign markets, and therefore needs also the employees originating from foreign countries. In the theoretical part of the thesis we show the prevailing approaches to operating of human resources function with a particular pronouncement to normative framework i.e. regulations to employment of foreigners in Slovenia. In the empirical part we explore, on the basis of semi-structured interviews with foreign employees in the company their attitudes towards satisfaction with work in the company as well as their personal experiences by employment and staying in Slovenia. The results show their general (great) satisfaction with most of the things that can be directly influenced by the company, but much less on the other hand with birocracy procedures they have been experiencing during their dealing with state and public authorities in Slovenia. Despite the smallness of the sample allows for no generalisations, it nevertheless points towards conclusion that Slovenia has much to do especially in praxis if it wants the foreign employees to better integrate into its social environment and for them to have better opinions about work and life in Slovenia in general.

The subject of this diploma thesis is to characterize the requirements on legal stay of foreign employees in the Czech Republic, their employment and recognition of their qualification. Topics found in the literature and associated to international migration of employees in medical facilities, topics associated to their legal stay in the Czech Republic, rules of employing them and rules of recognition of their qualification are described in theoretical part of my diploma thesis. The main goal of the practical part is to find out what is the state in 2 medical facilities which took part in my research. And to compare them from the perspective of their quality, according to the structure of all professions and work adjustment of foreign employees. Also to find out if and eventually why the legal regulations are contravened. Diplomsko delo obravnava problematiko zaposlovanja kadrov v dejavnosti gostinstva. Za obdobje od leta 2000 do 2008 smo predstavili ključne kazalce. Ugotovili smo pomemben porast v dejavnosti gostinstva, a hkrati številne probleme. This final thesis discusses the issue of staff employment in the catering buisiness. We presented the key indicators such as employment, unemployment, salaries employment of foreigners, calls for applications and enrolments in high schools for time period from 2000 to 2008.

Procesi globalizacije, razvoj tehnologije, demografske spremembe … vse to so dejavniki, ki imajo velik vpliva na trg dela, ustvarjaje novih delovnih mest in hkrati spreminjaje ali celo nadomeščanje starih. Ker se delovna sila trgu dela ne prilagaja dovolj hitro, prihaja do strukturnih neskladij. Glavni namen diplomskega dela je raziskati in oceniti kateri so tisti izobrazbeni profili, ki jih na trgu dela najbolj primanjkuje. Naše ocene so pokazale, da se neskladja med ponudbo in povpraševanjem glede na izobrazbene profile v zadnjih petih letih še povečujejo. Posebej je potrebno izpostaviti problematiko deficitarnosti tehničnih profilov. Delovna mesta, za katera delodajalci na slovenskem trgu dela ne najdejo delavcev, mnogokrat zapolnijo tuji delavci. Regulacija migracijske politike stimulira selektivno migracijo tujih delavcev. Za delavce z izobrazbenimi profili, ki jih na našem trgu dela najbolj primanjkuje je pridobivanje delovnih dovoljenj lažje. Poleg kadrovskih štipendij, ki predstavljajo pomembno vzpodbudo za boljši odziv izobraževalnega sistema potrebam delodajalcev, pa se danes izvaja tudi vrsta drugih programov, ukrepov in drugih aktivnosti za zmanjšanje neskladij na trgu dela. Nekaj smo jih tudi predstavili v diplomskem delu. K uspešnemu reševanju problema neskladja bi bistveno pripomogle tudi dolgoročne napovedi potreb po profilih ali poklicih v prihodnosti. Zavedamo se metodoloških težav pri napovedih za prihodnost, vseeno pa lahko iz nekaterih napovedi strokovnjakov ocenimo, kje naj bi se potrebe po delavcih povečevale. Processes of globalization, technological and demographic change are all factors that have an important impact on the labour market performance, particularly in the process of job creation and destruction. Labour supply does not adjust fast enough to these changes, which causes structural mismatch. The main aim of the paper is to analyze and estimate which educational profiles present the biggest shortage on the labour market. Our estimation show that the mismatch between labour supply and labour demand according to educational profiles increased in last five years. The shortage of technical profiles should be especially emphasised. The analysis also shows that the vacancies not filled with Slovenes are often occupied by migrant workers. Regulation of the migration policy stipulates selective migration of workers. Workers with educational profile that is most needed in the Slovenian labour market get the working permit easily. In addition to employer scholarships that represent important stimulation for a better response of the education system to the employers' needs, there are many programs, measures and other activities for decreasing the structural mismatch on the labour market. Some of them are presented in this paper. Long term anticipation of future profiles and professions would be very useful for decreasing discrepancies. We are aware of the methodological difficulties of such forecast of future trends, however according to some expert opinions, we could estimate areas where the labour demands will increase.

V magistrski nalogi je predstavljeno aktualno in pomembno področje zagotavljanja socialne varnosti brezposelnim tujcem, njena pravna in mednarodna ureditev. Pomemben poudarek magistrskega dela je dan pravni ureditvi socialne varnosti in zaposlovanju tujcev v Republiki Sloveniji ter zagotavljanje socialne varnosti za primer brezposelnosti tako domačim kot tujim delavcem. Socialna varnost je družbena vrednota, stanje človeške varnosti ter družbene stabilnosti. Pravice iz socialne varnosti so socialne pravice in jih uvrščamo med temeljne človekove pravice. S to pravico se veže pravica do svobodnega iskanja dela in zaposlitve ter vse socialne in ekonomske pravice, do katerih so upravičeni delavci. V primerjalnem delu magistrske naloge je prikazana pravna ureditev pravic iz zaposlovanja za primer brezposelnosti za tujce, tako državljane držav članic Evropske unije kot državljane t.i. tretjih državah. This Master thesis presents current and important information in the field of social security for foreign unemployed people, its rights and the international legal regulation. The important highlight, the Master thesis is focusing on, is given to the legal regulation of social security and employment of foreigners in the Republic of Slovenia as well as social rights for unemployed domestic and foreign workers. Social security is social value, condition of human safety and social stability. Rights from social security are social rights and we place them among basic human rights. Right towards free job search and occupation and all social and economic right is connected with this right. In the omparative part of the Master thesis, the legal regulation of social security rights for unemployed workers is shown for foreign workers, who comes from EU countries and third part countries.

Zaposlovanje tujcev postane nujno v primerih, ko med domačimi iskalci zaposlitve delodajalci ne uspejo pridobiti dovolj ustreznega kadra. Delodajalci vse pogosteje navajajo pomanjkanje delavcev kot glavni omejitveni dejavnik. Če bi bilo zaposlovanje v takšnih primerih onemogočeno, bi morali delodajalci zmanjšati ali celo opustiti svojo dejavnost, ker pač brez ustreznega kadra poslovanje ni mogoče. Zato ima tudi Slovenija ustrezno regulacijo, ki omogoča zaposlovanje in delo tujcev. V tem diplomskem delu podrobneje analiziramo obseg zaposlovnja tujcev ter delež zaposlovanja tujcev glede na brezposelne osebe v Goriški regiji, kot regiji ki je bila v minulih letih namreč znana kot ena od regij v Republiki Sloveniji z najnižjimi stopnjami brezposelnosti. Primerjali smo z Zasavsko in Pomursko regijo, ki imata nadpovprečno stopnjo brezposelnosti. Poleg tega smo preveri še hipotezo, da je največ delovnih dovoljenj izdanih državljanom iz držav nekdanje SFRJ in ali se to število zmanjšuje ali povišuje. Ustrezno temu smo preverili izobrazbeno sestavo zaposlenih tujcev. Postavili smo si hipotezo, da se je izobrazbena struktura zaposlenih tujcev v Goriški regiji pomembno spreminjala v korist povečevanja deleža z višjo strokovno izobrazbo. Kakšen bo slovenski trg delovne sile v prihodnosti je težko napovedati. Upoštevaje demografska gibanja in dosedanje potrebe je mogoče predvideti da bo zaposlovanje tujcev na slovenskem trgu dela, tako državljanov držav članic EU, EGP in Švicarske konfederacije kot državljanov t.i. tretjih držav tudi v prihodnosti pomembno. The employment of foreigners becomes essential in cases where employers fail to obtain suitable staff among domestic job-seekers. Employers increasingly point to a lack of workers as their main limiting factor. If employment proves impossible, as is often the case, then employers are then forced to reduce or even suspend their activities, since, without adequate staff it is impossible to function. In regard to this, Slovenia has suitable regulations, providing employment for the work of foreigners. In this diploma thesis, we have analysed in more detail the scope of employment of foreigners and the share of employment of aliens in relation to employed persons and in relation to the unemployed in the Goriška region, as a region that has formerly been recognised as one of the regions in Slovenia with the lowest unemployment rates. We hawe compared the Zasavska and Pomurska regions, which both have above-average unemployment rates. In addition, we have verifield the hypothesis that most work permits are issued to nationals from countries of the former Yugoslavia and whether this number is decreasing or increasing. Accordingly, we have determined the educational structure of the foreign employess. We have set the hypothesis that the educational structure of foreign workers in the Goriška region has significantly changed in favour of increasing the proportion of skilled workers with higher education qualifications. What the Slovenian labour market will be like in the future is difficult to predict. Given the demographic trends and existing reguirements, it is foreseen that the employment of foreigners in the Slovene market as citizens of EU member states, EEA countries and the Swiss Confederation as citizens of these third countries will be assential in the future.

The following work pursues a analysis of investment incentives and their impact on unemployment in the region Plzeňský kraj. First, the reader is familiarized with the legal form of investment incentives, and then is familiarized in a brief introduction with problem of unemployment. The second part gives an analysis of unemployment, employment and employment of foreigners in the region in the context of investment incentives. Subsequently, the economic impacts upon investment incentives are under examination in this work. The last chapter targets other instruments of active employment policy in the region and compares their costs and effects with costs and effects of investment incentives, that were analyzed before.

The aim of the degree work was to chart the labour market in Ceské Budejovice district in relation to foreign countries and to specify the influences on the development of legal employment of foreigners in Ceské Budejovice district, who had been granted a work permit in last 5 years, and the impact on unemployment in Ceské Budejovice district. It also charts the influence of EU entry and its impact on the outflow of workers from the labour market in Ceské Budejovice district. The main aim is to analyze the examined region and the labour market with regard to professions demanded by the employers. It is about how this affects the legal employment of the foreigners. A comparison of Ceské Budejovice employment agency{\crq}s statistics from the years 2003 {--} 2007 and the surveys, done via questionnaire enquiries, at employers (companies) in Ceské Budejovice who employ foreigners or have the intention to employ foreigners, was made. For purpose of cross-border employing of citizens of the Czech Republic via the employees of the employment agency in Ceské Budejovice arranged a contact with an employee of the given agency Arbeitsmarketservice Freistadt, where we talked about questions concerning the way of employing people from abroad, especially the Czech Republic. Further on an analysis of the questionnaire enquiries and the statistical data assigned by the employment agency was made. The results of the questionnaire enquiries were passed on to the employment agency in Ceské Budejovice for further possible use.

The main goal of this final thesis is the analysis of the immigrant's position on the labor market in the Czech Republic and in Germany. For this purpose the thesis makes a research of particular factors and barriers which immigrants have to deal with on the labor market and define their direct effects. Furthermore, the thesis focuses on the integration policy of both countries. Based on performed analysis in the field of immigration and integration the author of the thesis makes a comparison of the attitudes of both countries towards the immigrants with the aim to set up fitting measures for improvement of the immigrant's situation on the Czech labor market. The thesis is divided into theoretical and analytical part. The theoretical part is focused on theoretical solutions in the field of migration, migration policy, integration and discrimination. In analytical part, there is carry out a proper analysis according to the set goals.

SANTRAUKA Kiekviena valstybės, tame tarpe ir Lietuvos Respublika, yra suinteresuota reguliuoti užsieniečių darbą savo teritorijoje, siekiant, visų pirma, apsaugoti savo vidinę darbo rinką, iš kitos pusės, pripažįstant užsieniečių teisę į darbą ir vykdant prisiimtus pagal tarptautinius teisės aktus įsipareigojimus, garantuoti galimybę dirbti jos teritorijoje bei užtikrinti tinkamas darbo sąlygas. Atsižvelgiant į aktualijas, pastaruoju metu įvyko ne mažai reikšmingų pasikeitimų, įtvirtinant diferencijuotą užsieniečių darbo teisinį reguliavimą. Šiame darbe yra pateikiama sisteminė užsieniečių iš Europos Sąjungos ir trečiųjų valstybių įdarbinimo ir darbo Lietuvoje teisinio reguliavimo analizė. Buvo stengiamasi išryškinti darbo sutarties su užsieniečiu sudarymo, vykdymo ir nutraukimo teisinio reguliavimo specifiką. Darbe yra nagrinėjamas ne tik įsidarbinusių pagal darbo sutartį Lietuvoje, bet ir atsiųstų laikinai dirbti į Lietuvos teritoriją darbuotojų darbo teisinis reguliavimas, siekiant atkreipti dėmesį į komandiruojamų darbuotojų darbo Lietuvoje reguliavimo ypatumus, privalumus ir trūkumus. Atliekant tyrimą, buvo analizuojami galiojantys ir planuojami priimti Lietuvos Respublikos ir Bendrijos teisės aktai, dėstomos teisės mokslo atstovų nuomonės, išryškinami probleminiai užsieniečių darbo teisinio reguliavimo klausimai bei pateikiami galimi jų sprendimo būdai. SUMMARY Every State, including Lithuania, is concerned with the legal regulation of work of foreigners, first of all, in order to protect its inner labour market, on the other hand, to guarantee an opportunity to work on its territory and proper conditions of work, while recognizing the right to work and carrying out of the obligations accepted on the basis of the international documents. Lately many changes of legal regulation have taken place and various legal acts are being planed to accept, which provide for the differentiated legal regulation of employment and work conditions of foreigners, coming from European Union and third countries. This work, first of all, presents the analysis of legal regulation of work, based on the employment contracts. The purpose was to determine the peculiarities of employment of foreigners, the execution of the employment contracts and their termination. Besides that, this work also presents the analysis of legal regulation of work of temporary posted workers, aimed at determining the specific regulation of such king of work and exposing some of the positive sides and the shortcomings of national regulation. Workers' external migration, as well as internal one, have a number of causes and effects. They lead to significant changes in the countries and regions of origin, and also in the countries and regions of destination, and they affect the lives and consciousness of migrant workers and their families. Paced with the far-reaching consequences and effects of foreign workers' migration and employment, the working-class movement has made attempts from the very first beginning to take a class-based attitude to migration. Discussions and resolutions pertaining to the Second International confirmed the fact that under the conditions of imperialism two diverse class-orientated approaches were manifest, which was also reflected in different views of migration and foreign workers' employment., Vanjskim migracijama radnika, upravo kao i unutarnjim, mnoštvo je različitih uzroka, a mnoštvo je i učinaka. Migracije dovode do značajnih promjena i u zemljama i regijama porijekla, i u zemljama i regijama prijema, a utječu na život i svijest radnika migranata i njihovih obitelji. Suočen s dalekosežnim posljedicama i učincima migracije i zapošljavanja stranih radnika, radnički je pokret na nacionalnoj i internacionalnoj razini nastojao od prvih početaka migracijskih kretanja zauzeti klasno stanovište o njima. Diskusije i rezolucije Druge internacionale potvrdile su činjenicu da su u uvjetima imperijalizma izražena dva suprotna klasna pristupa migracijama, a to se odrazilo i na različite poglede na migracije i na zapošljavanje stranih radnika.

U ovom radu polazi se od jedne manje poznate zanimljivosti da se predratno jugoslovensko zakonodavstvo bavilo i pitanjima zapošljavanja stranaca, i to u okolnostima za koje se zna da su pre primerene eksportu radne snage {što je i bio slučaj), a ne njenom importu. U nastavku teksta daje se pregled našega savremenog zakonodavstva u ovoj oblasti, sa kvantitativnim podacima o obimu i strukturi strane radne imigracije u delu koji se statistički prati i evidentira. Osnovna je ocjena da ovi »obrnuti« tokovi migracija, iako su po svom obujmu možda zanemarivi, ipak se ne smiju zapostaviti jer imaju određeno društveno značenje, a neopravdano se manje prate i izučavaju., The point of departure is a curious and rather unknown fact: that Yugoslav prewar legislation dealt also with questions pertaining to the employment of foreigners, even in circumstances that were adjusted to the actual export of labour rather than to its import. An overview follows of contemporary Yugoslav legislation in the field, along with quantitative data on the size and structure of foreign labour immigration, the segment that is statistically measured and registered. The main assessment is that such “reverse” migration flows, although maybe negligible in terms of volume, should not be overlooked: they are of certain significance in society, yet unjustifiably poorly examined and studied.
